Box 1179 Southold, New York 11971 ZBA Fax (516) 765-9064 Telephone (516) 765-1809 PROPERTY FACTS/ DESCRIPTION: The applicants' property is a vacant lot consisting of Lots 17, 18 and 19 on the Amended Map of Mattituck Heights File No. 1184, and containing 30,000 sq. ft. of land area as shown on a June 30, 1999 survey prepared by Joseph A. Ingegno, L.S. This lot adjoins other lands to the north referred to as CTM Lot 4.1 and 3.1 (shown as part of Mattituck Heights Lot No. 16), from which this Waiver of Merger is requested. BASIS OF APPEAL: Building Inspector's September 10, 1999 Notice of Disapproval which states that the "Subject lot is nonconforming and held in common ownership with adjacent lot CTM #1000- 139-3-4.1 and 3.1" and that pursuant to Article II, Section 100-25A, a merger resulted. RELIEF REQUESTED BY APPLICANT: The request made by applicants is for a Lot Waiver with respect to 2850 Wickham Avenue, Mattituck, County Tax Map Lot 1000-139-3-6.1, as confirmed for Lots 17,18 and 19 (combined) shown on the former Amended Map of Mattituck Heights and current deed dated March 18, 1999 (and former deed dated March 1, 1943.) With respect to the Mattituck Heights Subdivision, the lots in this area were recognized up until the late'80s, however, the lots were not placed in single and separate ownership since 1983 to avoid a merger under Section 100-24 and 100-25. INFORMATION AND EVIDENCE CONSIDERED BY THE BOARD: 1. The applicant purchased the subject lots by separate deeds dating back to 1944 and 1928. 2. Applicant's attorney discussed lot sizes in the neighborhood. The Zoning Board of Appeals has carefully reviewed all documentation and evidence and finds that most of the lots are smaller in size than the applicant's .68 -acre combined Subdivision Lots 17, 18 and 19 on the Amended Map of Mattituck Heights. REASONS FOR BOARD ACTION: After consideration of the entire record, testimony at the public P,lige 2 - December 14, 1999 Appl. No. 4763: John and MaryAnne Lucey Board of Appeals (1000-139-3-6.1 and 3.1) hearing and other evidence, the Board finds the following facts to be true and relevant: 1. The waiver will allow for construction of an additional single-family residence, which will not' result in a significant increase in the density of the neighborhood. 2. The two lots were created by subdivision. The waiver will recognize a lot that is consistent with the size of lots in the Mattituck Heights subdivision neighborhood. Most of the subdivision is developed with single-family residences on lots similar to, or smaller than, this parcel. 3. No environmental conditions on the lot or nearby area have been identified that would be negatively impacted by grant of this waiver. The natural details and character of the lots will not be substantially altered nor will there be significant filling of the land affecting nearby environmental areas or flood prone lands. RESOLUTION: On motion by Member Dinizio, seconded by Member Horning, it was RESOLVED, to GRANT the Waiver, as applied for. VOTE OF THE BOARD: Ayes: Goehringer, Dinizio, Horning, Collins. Lots which are recognized under § 100-24 and meet any of the following categories shall be exempt from the merger provision set forth above and shall not be deemed merged by operation of this chapter. (1) The nonconforming lot has a minimum size of forty thousand (40,000) square feet, or (2) The nonconforming lot obtained a lot size variance from the Zoning Board, or (3) If the lot is not on the maps described in former § 100-12,4 the nonconforming lot has been held in single and separate ownership from July 1, 1983 to date, or (4) [Amended 3-41997 by L.L. (2) A copy of the current tax map and survey of the lot. (3) A copy of the original survey of the lot. (4) A title search showing single and separate ownership of the property from July 1, 1983, to the present time, prepared by a Suffolk County title insurance company indemnifying the Town of Southold with $25,000 of insurance. } (5) Other additional information or documentation as may be deemed necessary. E. Effect of merger. No building permit or other development entitlement will be issued by the town until this section has been complied with.
