PROPERTY FACTS/DESCRIPTION: The applicant's lot is 1.4+- acre in size with frontage along
three streets: Oriental Avenue, The Gloaming, and Montauk Avenue. The lot is improved with a
single-family dwelling (to be relocated herein) and an accessory garage.
BASIS OF APPLICATION: Building Inspector's March 24, 1999 Notice of Disapproval based on
Article XX, Section 100-244 of the Zoning Code and applicant's request to relocate the existing
dwelling and construct an addition. The reasons stated in the Notice of Disapproval are:
(a) the proposed front yard from Montauk Avenue is approximately forty-five (45) feet
instead of the required fifty-five (55) feet, with the October 14, 1999 construction plans
showing the proposed patio will be raised above natural grade on fill; and
(b) the proposed rear yard setback is thirty-five (34) feet instead of the required seventy-
five (75) feet.
AREA VARIANCE RELIEF REQUESTED: Applicant requests a Variance in this relocation of an
existing dwelling, with a proposed rear yard setback at thirty-four (34) feet. Also, the map
submitted initially to the building department had a patio proposed at 45 feet for a front yard
setback at its closest point. On December 14, 1999, a modified plan was submitted to the Board
showing removal of the entire patio and conformity for all front yard lines from the proposed
dwelling.
REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record before
the Board and personal inspection, the Board makes the following findings:
1. Moving of this single-family to another location on the applicant's R-80 Residential parcel will not produce
an undesirable change in the character of the neighborhood or a detriment to nearby properties because the
one neighboring house is also located on the highest elevation within its own parcel, and is a considerable
distance from the proposed location of the dwelling.
2. The benefit sought by applicant cannot be achieved by some method, feasible for appellant to pursue
other than an area variance. The applicant seeks to relocate an existing single-family residence to another
location on the same parcel. The proposed relocation site is 165+- feet from the Town right-of-way called
Oriental Avenue, where the existing building is set back 31 feet. This change is explained by the applicant

as being necessary to create a larger buffer between the house and Hay Harbor Golf Course immediately
across the street, also on Oriental Avenue. The applicant wants to retain a southwesterly view of the Sound
by moving the building away from the Sound and locating it on higher elevation than where it now exists.
Because of the irregular shape of the property and the fact that the property contains three front yards, an
area variance is necessary for the applicant to proceed with this plan.
3. The requested area variance is substantial. The proposed rear yard (34 feet) is an approximate 55%
reduction from the R-80 Code requirement of 75 feet. However, the applicant's difficulty in locating a
conforming rear yard is greatly exacerbated by the existence of three front yards and no side yard.
4. There is no evidence that grant of the variance will have an adverse effect or impact on the physical or
environmental conditions in the neighborhood or district because there will be only one single-family
dwelling on this parcel and there are no wetlands or other significant environmental features on the property
that will be adversely affected by the proposed dwelling re -location.
5. In considering this application, the Board deems this action to be the minimum necessary and adequate
to enable the applicants to enjoy the benefit of a new location for a dwelling, while preserving and
protecting the character of the neighborhood and the health, safety, welfare of the community.

REASON FOR APPEAL

is requested for the reason tlrot your applicant desires to relocate the existing residence
on their.property to a better and safer location. The present location of your
applicant's residence is 31' from Oriental Avenue and 48' from The Gloaming. Because
` of its proximity to Oriental Avenue over the years during the summer months it has
become extremely busy and the noise of the traffic is undesirable. Further, stray balls
from Hay Harbor Golf Club frequently hit the house. Your applicant's property has a
unique situation in that the Building Department has determined that under the Zoning

Ordinance it has three front yards (Oriental Avenue, The Gloaming and Montauk Avenue).
Due to the topography of the property the only practical place to relocate the house is
as shown on the attached mapy prepared by Chandler, Palmer & King dated 9:/2/99 & 10/01/99
Under theBuilding Department's interpretation of the Zoning Ordinance this will then.
have a rear yard of 34' instead of the required 75' for which a variance is sought.

REASONS FOR AREA VARIANCE ONLY to be completed by applicant):
Do not use `these standards for "use variance" or "special
exception." (Also attach sheets if necessary, with signatures.)
1. An undesirable change will NOT be produced in the character of
the neighborhood or a detriment to nearby properties, if granted
BECAUSE: there will still only be one residence on the property just in a
different location and the proposed location will not interfere with the
property of the neighbor to the east.
2. The benefit sought by the applicant CANNOT be achieved by some
method, feasible for the applicant to pursue, other than an area
variance BECAUSE: if the house is to be relocated away from Oriental Avenue,
due to the topography, the only practical place to locate it is on the highest
point on the property which is also fairly level.
3. The amount of relief requested is not'substantial BECAUSE
the proposed relocation of the house will have a 34' separation from the
easterlyproperty line which is deemed the rear yard. By relocating the house as
shown on the attached map, the separation from the easterly property line is in
reality a side yard which requires only 20'.

This will confirm that by Board Resolution adopted February 23, 1999, the following- shall
be used to clarify the Zoning Code regarding allowable height for patios, replacing the
lawn mower standards established by Building Inspectors:
PATIO: The height shall be limited at zero inches, flush (level) with the
ground at one end, and limited to a height of 16 inches from ground level
at the opposite end, with at least 50% of the entire structure built below
grade. The patio would also be flat and level and meet safety
requirements.
Other present code restrictions are, of course, unchanged.
Vote of the Board: Goehringer, Dinizio, Collins, Horning. Member Tortora abstained.
This .Resolution was duly adopted (4-0, plus one abstention).

Dear Applicants:
Please find enclosed a copy of the Legal Notice describing your recent application. The Notice will
be published in the next issue of the Suffolk Times.
Pursuant to Chapter 58 of the Southold Town Code (copy enclosed), formal notice of your
application and hearing must now be mailed and shall include a map or sketch showing the nevv.

(765-1937) or the County Real Property Office in Riverhead. If you know of another address for a
neighbor, you may want to send the notice to that address as well.
Please submit your Affidavit of Mailing (copy enclosed) to us by the Friday before the hearing date,
with the post office receipts postmarked. Later, when the green signature cards are returned to you
by the Post Office, please mail or deliver them to us. If any signature card is not returned, please
advise the Board at the hearing.
A sign is also necessary for posting at the property by you, not later than 12/7/99, and therefore
must be picked up by you or your representative on or before 12/6. Town Hall is open from 8 to 4
p.m. (M - F). The sign must be located on the property no more than. 10 feet from the front
property line bordering the street. (If you border more than one street or roadway, a sign is
enclosed for the front yard facing each one.) The sign(s) must remain in place for at least seven (7)
days, and if possible, remaining until the day of the hearing.
After the signs have been in place for seven (7) days, please submit your. Affidavit of Posting (copy
enclosed) to us for the permanent file. When convenient for you, please return the sign to us.
If you do not meet the deadlines stated in this letter, please contact us promptly. It may be
