Together with the benefits and subject to the burdens of the
Declaration of Condominium and By-Laws attached thereto recorded
by the Sponsor, The Cove at Southold, Inc. , dated August 25, 1989
and recorded in the Office of the Clerk of Suffolk County on the
25th day of August 1989 , in Liber 10917 of Conveyances at Page
477 and any present or future amendments to said Declaration.
TO HAVE AND TO HOLD the premises herein granted unto the
party of the second part, the heirs or successors and assigns of
the party of the second part forever.
The use for which the Unit is intended is that of a one-
family residence, subject to the applicable governmental regula-
tions and the restrictions contained in the Declaration.
AND the party of the first part covenants that the party of
the first part has not done or suffered anything whereby the said
premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section
13 of the Lien Law, covenants that the party of the first part
will receive the consideration for this conveyance and will hold
the right to receive such consideration as a trust fund to be
applied first for the purpose of paying the cost of the improve-
ment and will apply the same first to the payment of the cost of
the improvement before using any part of the total of the same
for any other purpose.
The Grantee herein, by taking title to the premises above
described, hereby becomes a member of Bayview Water Homeowners
Association, Inc. , a not-for-profit corporation, which holds or
will hold title to the certain land by which the water supply
system servicing the Condominium is located. Grantor and Grantee
both covenant that membership in the Bayview Water Homeowners
Association, Inc- is a condition of and ownership of the premises
herein conveyed and the ownership and membership cannot be sepa-
