FINDINGS OF FACT
PROPERTY FACTS/ DESCRIPTION: The applicant's property is located in the Limited Business (LB)
Zone District and consists of 3.563 acres (155,204.28 sq. ft. in area) with 337.83 ft. frontage along
the north side of Middle Road (a/k/a Middle Road and C.R. 48), and 428.85 ft. frontage along the
west side of Cox Neck Road, Mattituck. The property is vacant land.
BASIS OF APPLICATION: Building Department's May 7, 1999 Notice of Disapproval citing Article
VIII, Section 100-83C of the Zoning Code, stating that:
"...the proposed construction on corner lot has two road frontages, two (2) structures on
proposed project will exceed sixty (60) foot linear frontage on one of those road frontages
while maintaining the required frontage on the other frontage."
INTERPRETATION REQUESTED: Applicant's attorney asked the Board to rule that Section 100-
83C applies to frontage on "one (1) street"; in that case, since the building sides fronting Route 48
are within the 60 -foot limit of Section 100-83C, the buildings would be in compliance. The Board
agreed to hear this interpretation question and, after giving public notice, did so on July 22, 1999.
Specifically, the Board addressed the question "whether the proposed winery building is required
to have sixty (60) linear feet of frontage on one (1) street or on two road frontages."
The legal notice read for the hearing held on July 22, 1999 was advertised as follows:
"This is a request for an Interpretation under Article VIII, Section 100-83C which states: A project
shall be divided into separate structures so that no single structure shall have more than sixty (60)
linear feet of frontage on one (1) street. Applicant proposes to construct a winery on this corner lot
with two road frontages (at intersection with Middle Road a/k/a C.R. 48) and requests the Board to
interpret whether or not the proposed winery building is required to have sixty (60) linear feet of
frontage on one (1) street or on two road frontages, as determined by the Building Department's
May 7, 1999 Notice of Disapproval. Site Address: 35 Cox Neck Lane, Mattituck; Parcel 1000-121-

BOARD ACTION/RESOLUTION: The Board heard testimony on the question to be addressed. The
Board is cognizant of the legal principle that since zoning ordinances are in derogation of common
law property rights, they must be construed strictly. On motion by Member Collins, seconded by
Member Dinizio, it was
RESOLVED, that the Board interprets the meaning of Section 100-83C to be that a structure
shall have no more than sixty linear feet of frontage on one street, so that a structure with two
street frontages satisfies Section 100-83C when it measures no more than 60 linear feet on one of
those frontages; and further
RESOLVED, that the Building Inspector's Notice of Disapproval dated May 7, 1999 is
hereby reversed pursuant to this Board's authority under section 267-bi of New York Town Law.

Reasons Supporting This Determination:
This project involves the construction of a winery consisting a 7,800 square foot
production building, a 10,200 square foot storage building and a 2,400 square
foot future tasting building. A winery is a permitted use in this Limited Business
zone, thus the proposed action is consistent with zoning.
An Environmental Assessment Form has been submitted and reviewed,
and it was determined that no significant adverse effects to the
environment were likely to occur should the project be implemented
as planned.
There has not been any correspondence received from the Department of Health
Service in the allotted time. Therefore, it is assumed that there are no comments
or objections from that agency.
There has not been any correspondence received from the New York State
Department of Environmental Conservation in the allotted time.
Therefore, it is assumed that there are no comments or objections
from that agency.
The applicant will have to comply with the requirements of the Suffolk
County Sanitary Code (SCSC) and all relevant standards of water supply
and sewage disposal systems. Design and flow specification, subsurface
soil conditions and site plan details will have to be approved by the Suffolk
County Department of Health Services (SCDHS). This impact is not
considered significant due to the anticipated project compliance with
established requirements of the SCSC and the SCDHS and the required
relevant permits.

I have again reviewed the language of the Local Law continuing the Temporary
Moratorium on Issuance of Approvals within the Route 48 Corridor. I would like to
submit that should you decide that our first position, that the ordinance by its terms does
not require a variance, such a decision would not be precluded by the moratorium.

The applicant's position, as set forth in detail at the hearing, is that the language of
the ordinance requires a 60 foot restriction along one (1) street, and as such, the
application complies with the ordinance. We therefore requested that the Board overrule
the decision of the Building Inspector and interpret the Code as not requiring a variance.

variance is appropriate should the Board not adopt the applicant's first position.

II. PUBLIC HEARINGS:
6:35 p.m. Appl. No. 4685 - VINCENT TORRE. This is a request for a Variance under
Zoning Code Chapter 100, Article III, Section 100-31C(2) based upon the October 20, 1998
Notice of Disapproval (updated January 27, 1999) regarding a building permit application to
convert accessory barn for retail sales in conjunction with applicant's Art Studio and Gallery,
disapproved for the reason that retail sales and a gallery for public viewing in the accessory
building is not a permitted use in this A -C Zone. Location of Property: 100 Sound Avenue,
Mattituck, NY; Parcel ID 1000-120-3-1. (No appearances were made.) Applicant, by his
agent Proper -T Services, Inc., requested a postponement. Motion was made by Chairman
Goehringer, seconded by Member Tortora, to recess the hearing to the July, 22, 1999
hearings calendar, pursuant to applicant's request.

6:38 p.m. Appl. No. 4687 - PRISCILLA STEELE. This is a request for a Lot Waiver
under Chapter 100, Article II, Section 100-26, for a substandard (vacant) lot known as 275
Village Lane (west side), at Mattituck, NY, situated approximately 122 feet north of the Main
Road, identified as Parcel 1000-114-6-5. This request is based upon an application for a
building permit and the Building Department's March 22, 1999 Notice of Disapproval which
states that Article II, Section 100-25 merged this lot with an adjacent house lot to the west
referred to as 15405 Main Road, Mattituck, Parcel No. 1000-114-06-03. Richard F. Lark,
Esq. spoke in behalf of the application. Also present was Mrs. Steele. After receiving
testimony, motion wasmade by Chairman Goehringer, seconded by Member Tortora, and

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town Law and the Code of the Town of
Southold, the following application will be held for public hearing by the SOUTHOLD TOWN BOARD OF
APPEALS, at the Southold Town Hall, 53095 Main Road, Southold, New York 11971, on THURSDAY,

7:40 p.m. Appl. No. 4708 - LIEB CELLARS. This is a request for an Interpretation under
Article VIII, Section 100-83C which states: A project shall be divided into separate structures so
that no single structure shall have more than sixty, (60) linear feet of frontage on one (1) street.
Applicant proposes to construct a winery on this corner lot with two road frontages (at intersection
with Middle Road a/k/a C.R. 48) and requests the Board to interpret whether or not the proposed
winery building is required to have sixty (60) linear feet of frontage on one (1) street or on two road
frontages, as determined by the Building Department's May 7, 1999 Notice of Disapproval. Site

improved) surrounding yours, including land across any street or right-of-way that borders
your property. Use the current addresses shown on the assessment rolls maintained by the
Town Assessors' Office (765-1937) or the County Real Property Office in Riverhead. If you
know of another address for a neighbor, you may want to send the notice to that address
as well.
Please submit your Affidavit of Mailing to us by the Friday before the hearing date, with the
post office receipts postmarked. Later, when the green signature cards are returned to you
by the Post Office, please mail or deliver them to us. If any signature card is not returned,
please advise the Board at the hearing.
You must post the enclosed sign no later than 6/17/99. Post the sign facing the street, no
more than 10 feet from your front property line bordering the street. (If you border more
than one street or roadway, a sign is enclosed for the front yard facing each one.) The
sign(s) must remain in place for at least seven (7) days, and if possible, should remain
posted through the day of the hearing. If you need a replacement sign, please contact us.
After the signs have been in place for seven (7) days, please submit your Affidavit of
Posting to us for the permanent file.
If you do not meet the deadlines stated in this letter, please contact us promptly. It may
