PROPERTY FACTS/DESCRIPTION: The subject property is a corner lot with frontage along the
northerly and easterly property lines with Hiawathas Path, Southold. The property is improved
with a single-family dwelling and small metal shed, shown on the October 23, 1998 survey
prepared by Young & Young, L.S.
BASIS OF APPEAL: October 27, 1998 Building Permit application, and Notice of Disapproval issued
by the Building Department December 16, 1998, for the reason that the proposed deck does not
meet the 35 ft. minimum setback from the rear property line as provided by Article XXIV, Section
100-2446. (No other reasons were noted in the Notice of Disapproval.)
AREA VARIANCE RELIEF REQUESTED: To construct a 12 ft. by 14 ft. open deck addition 20.4+ -
feet from the westerly (rear) property line and 21+- feet from the southerly (side) property line.
REASONS FOR BOARD ACTION, DESCRIBED BELOW: After considering the testimony and record
presented and personal inspection, the Board makes the following determination:
1. Grant of an area variance will not produce an undesirable change in character of neighborhood
or a detriment to nearby properties because the lot has two front yards, each larger than the
remaining rear yard on a lot with 15,000+- sq. ft. in size.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for applicant
to pursue, other than an area variance because the westerly (rear) yard setback for the dwelling is
nonconforming at 27+- feet and there is no other land area available.
3. The requested area variance is not substantial being an open deck extension proposed in the
westerly (rear) yard approximately six (6) feet.
4. No evidence has been submitted to show that the grant of the variance will have an adverse
effect or impact on the physical or environmental conditions in the neighborhood or district.
5. The alleged difficulty has not been self-created because the dwelling and lot have existed with
setback nonconformities.

In considering this application, the Board deems a six-foot extension past the westerly side of the
dwelling for an open deck is the minimum necessary and adequate to preserve and protect the
character of the neighborhood, and the health, safety, welfare of the community.
RESOLUTION/ACTION: On motion by Member Dinizio, seconded by Member Tortora, it was
RESOLVED, to GRANT the variance as applied, with the CONDITION that the deck remain open to
the sky, unroofed and unenclosed as applied.

TUESDAY, FEBRUARY 23, 1999
NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town Law and the Code of
the Town of Southold, the following application will be held for public hearing by the
SOUTHOLD TOWN BOARD OF APPEALS, at the Southold Town Hall, 53095 Main Road,
Southold, New York 11971, on TUESDAY, FEBRUARY 23, 1999 at the time noted below (or as
soon thereafter as possible):
7:00 p.m. Appl. No. 4656 — JOSEPH H. KOLLEN. This is a request for a
Variance under Article XXIV, Section 100-244B, based upon issuance of a Notice of
Disapproval dated December 16, 1998 in applicant's request for a building permit to
construct an accessory deck at less than the required 35 feet from the rear property
line. Location of Property: 1010 Hiawathis Path, Southold, NY; 1000-78-3-50.2.
The Board of Appeals will at said time and place hear any and all persons or
representative desiring to be heard in the above application or desiring to submit
written statements before concluding the hearing. Each hearing will not start earlier

Dear Applicant:
Please find enclosed a copy of the Legal Notice describing your application. The Notice will
be published in the next issue of the L.I. Traveler Newspaper, the Town's official newspaper
for 1998-99.
Pursuant to Chapter 58 of the Southold Town Code (copy enclosed), formal notice of your
application and hearing must be mailed and shall include a map or sketch showing the
location of this project with the setbacks and use noted. Send this Notice, as soon as
possible, with the map to all owners of land (vacant or improved) surrounding yours,
including land across any street or right-of-way that borders your property. Use the current
addresses shown on the assessment rolls maintained by the Town Assessors' Office (765-
1937) or the County Real Property Office. If you know of another address for a neighbor,
you may want to send the notice to that address as well.
Please submit your Affidavit of Mailing to us by the Friday before the hearing date, with the
post office receipts postmarked. Later, when the green signature cards are returned to you
by the Post Office, please mail or deliver them to us. If any signature card is not returned,
please advise the Board at the hearing.
You must post the enclosed sign no later than 2/Z/99. Post the sign facing the street, no
more than 10 feet from your front property line bordering the street. (If you border more
than one street or roadway, a sign is enclosed for the front yard facing each one.) The
sign(s) must remain in place for at least seven (7) days, and if possible, should remain
posted through the day of the hearing. If you need a replacement sign, please contact us.

A regular meeting of the Southold Town Board of Appeals
was held at 7:30 P.M. (E.S.T.), Thursday, February 5, 1976,
at the Town Office, Main Road, Southold, New York.
There were present: Messrs: Robert W. Cillispie, Jr.,
Chairman; Robert Bergen; Fred Hulse, Jr.; Charles Grigonis,
Jr.
Also present: Sherley Katz and John Rather of the
Long Island Traveler-Mattituck Watchman.
7:30 P.M. (E.S.T.) Appeal No. 2095, Angelo & Joan Accardo,
54 March Court, Selden, New York. A public hearing was held
on this appeal on January 15, 1976. The location of the
property involved is Wabasso Street & Hiawatha's Path, Southold.
A decision was postponed until tonight's meeting as Mr. Accardo
was not present on January 15th and the Board needed further
information regarding the division of property.
THE CHAIRMAN: Is Mr. Accardo here?
MR. ANGELO ACCARDO: Yes.
THE CHAIRMAN: The Board is in general agreement with what
you want to do but would like to know how you wish to divide
this property. The Board is willing to go along with two lots
but not with three lots. How do you wish to divide this propert

MR. ACCARDO: Is there any reason why we can't have
three lots? (Mr. Accardo indicated'he would accept two lots).
THE CHAIRMAN: A final decision has not been made yet
but the reasoning of the Board is that these lots were created
by Mr. C. H. Wickham a good many years ago without regard to
zoning. Some have been combined into one or more lots and
some left in three lots. In the meantime, the Town has made
studies of water and sewage, etc. and the zoning ordinance
has been modified at least twice. The zoning ordinance now
calls for 40,000 sq. ft. lots. The conclusion of the Board
was that an equitable division would be to divide three
into two. The reason we did not make a decision at the hearing
on January 15th was that you were not here to help us.
After investigation and inspection the Board finds that
applicant requests permission to divide property with insufficient
width and area located at Wabasso Street & Hiawatha's Path,
Southold, New York. The findings of the Board are that an
equitable division of this property would be to combine Lots
36 and 37 to make one new lot, and Lot 24 will be a separate lot;
making a total of two lots. The Board agrees with the reasoning
of the applicant subject to the property being divided into
two lots rather than three lots.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by
all properties alike in the immediate vicinity of this property
and in the same use district; and the variance will not change
the character of the neighborhood, and will observe the spirit
of the Ordinance.
On motion by Mr. Grigonis, seconded by Mr. Hulse, it was
RESOLVED, Angelo & Joan Accardo, 54 March Court, Selden,
New York, be GRANTED permission to divide property into two
/ lots (Lots 36 and 37 to be combined as one new lot, and Lot
V24 to be a separate lot). This approval shall become effective
subject to applicant furnishing the Board with a survey des-
cribing the exact location of these lots.
Vote of the Board: Ayes:- Messrs: Gillispie, Bergen,
Hulse, Grigonis.
