FINDINGS OF FACT
PROPERTY FACTS/DESCRIPTION: The applicants' property consists of a total lot area of 24,300+- sq. ft.
with three street frontages: 170.94 ft. along Theresa Drive, 246.54+- feet along Theresa Drive and 200 ft.
along Donna Drive, Mattituck. The property is improved with a one -family, one-story frame dwelling
situated 75+- ft. from Theresa Drive and 42 ft. from Donna Drive at its closest points. The property is a
corner lot with three front yards, with the remaining yard on the north side of the house as the rear yard.
BASIS OF APPLICATION: Building Inspector's May 6, 1999 Notice of Disapproval citing Article III, Section
100-33 with regard to the location of a storage building in a front yard, and Article XXIII, Section 100-231
with regard to proposed fence height above four feet in a front yard area. (No other variance relief is noted
in this Notice of Disapproval.)
AREA VARIANCE RELIEF REQUESTED: Applicant requests a Variance to locate (a) a 12' x 12' accessory
storage shed to be located at 15+- (applicant's notation states 4' within fence line); (b) new fence
enclosure with gates at a maximum height of 6 ft.
REASONS FOR BOARD ACTION. DESCRIBED BELOW: Based on the testimony and record before the Board,
and personal inspection, the Board makes the following findings:
1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood
or a detriment to nearby properties for the reason that applicant's very small rear yard is the neighbor's side
yard.
2. The benefit sought by applicant cannot be achieved by some method, feasible for appellant to pursue,
other than an area variance because the code does not provide for a feasible rear yard area after
designating three yard areas as front yards.
3. The requested area variance is not substantial.
4. There is no evidence that grant of the variance will have an adverse effect or impact on the physical or
environmental conditions in the neighborhood or district.
5. The difficulty has not been self-created and is due to conflicting provisions in the Town Code (creation of
three front yards).
In considering this application, the Board deems this action to be the minimum necessary and adequate to
enable the applicants to enjoy the benefit of a new accessory storage shed and fence enclosure for their

pets, while preserving and protecting the character of the neighborhood and the health, safety, welfare of
the community.
RESOLUTION/ACTION: On motion by Member Dinizio, seconded by Member Tortora, it was
RESOLVED, to GRANT the variances, as applied for.

NOTICE IS HEREBY GIVEN, pursuant to Section 267 c, the Town Law and the Code of the Town of
Southold, the following application will be held for public hearing by the SOUTHOLD TOWN BOARD OF
APPEALS, at the Southold Town Hall, 53095 Main Road, Southold, New York 11971, on THURSDAY,
]UNE 24, 1999 at the time noted below (or as soon thereafter as possible):
8:25 p.m. Appl. No. 4712 - HENRY AND LINDA KOZEN. Variances are requested under
Article III, Section 100-33 for placement of an accessory storage building in a front yard area, and
under Article III, Section 100-231 for placement of a fence along and within front yard areas at a
height above the four -ft. limitation. Location of Property: Corner of Theresa Drive and 1520 Donna

Do not use these standards for "use variance" or "special

1. An undesirable change will NOT be produced in the character of
the neighborhood or a de-LrimenL to nearby properties, if granted
BECAUSE: of the existing treeline. The wooden fence is to be
purchased, not homemade. The manufactured shed will match the house
and quality materials will be used. (See enclosed plans)
2. The benefit sought. by the applicant CANNOT be achieved by some
method, feasible for the applicant to pursue, other than an area
variance BECAUSE: The fence will afford privacy for the applicant as
well as provide a secure area for our pets. The shed is needed to
store garden equipment, etc.
3. The amount of relief requested is not substantial BECAUSE
It is well within the property line in the rear of the yard.
4. The variance will NOT have an adverse effect or impact on the
physical or environmental conditions in the neighborhood or district
BECAUSE the treeline with existing trees will act as a natural
buffer between the fence and the road. Furthermore, the fence and
shed will be of high quality.

Re: Chapter 58 — Public Notice for Thursday, June 24, 1999 Hearing
Dear Mr. and Mrs. Kozen:
Please find enclosed a copy of the Legal Notice describing your recent application. The
Notice will be published in the next issue of the Suffolk Times.
Pursuant to Chapter 58 of the Southold Town Code (copy enclosed), formal notice of your
application and hearing must be mailed and shall include a map or sketch showing the new
location with the setbacks and use noted. Send this Notice CERTIFIED MAIL, RETURN
RECEIPT REQUESTED, as soon as possible, with the map to all owners of land (vacant or
improved) surrounding yours, including land across any street or right-of-way that borders
your property. Use the current addresses shown on the assessment rolls maintained by the
Town Assessors' Office (765-1937) or the County Real Property Office in Riverhead. If you
know of another address for a neighbor, you may want to send the notice to that address
as well.
Please submit your Affidavit of Mailing to us by the Friday before the hearing date, with the
post office receipts postmarked. Later, when the green signature cards are returned to you
by the Post Office, please mail or deliver them to us. If any signature card is not returned,
please advise the Board at the hearing.
You must post the enclosed sign no later than 6/17/99. Post the sign facing the street, no
more than 10 feet from your front property line bordering the street. (If you border more

Upon application of HENRY S. KOZEN, 1520 Donna Drive, Mattituck, NY
for a Variance to the Zoning Ordinance, Article III, Section 100-35 for
permision to construct 6 -foot high fence in the frontyard (which would
exceed the 4 -foot height limitation) at 1520 Donna Drive, Mattituck;
Deep Hole Creek Estates Subdivision, Filed Map No. 4256, Lot No. 33;
County Tax Map Parcel No. 1000-115-15-14.
The public hearing concerning this appeal was held earlier this
evening, at which time the hearing was closed pending deliberations.
The board deliberated, and made the following findings and deter-
mination:
By this appeal, appellant seeks permission to construct a six-foot
high "L -Shaped" fence a length of 32' by 161, a distance of 45 feet from
Theresa Drive. The parcel in question is pentagonal in shape with three
sides fronting public streets, lending itself to the practical difficulties
herein. If this parcel were not considered a "corner lot" as defined by
the zoning code, a variance for the,relief requested herein would not be
required. The board agrees with the reasoning of appellant.
In considering this appeal, the board determines that the variance
request is not substantial in relation to the code requirements; that
the circumstances herein are unique; that by allowing the variance no
substantial detriment to adjoining properties would be created; that
the difficulty cannot be obviated by a method, feasible to appellant,
other than a variance; that no adverse effects will be produced on
available governmental facilities of any increased population; that the
relief requested will be in harmony with and promote the general pur-
poses of zoning; and that the interests of justice will be served by
allowing the variance as indicated below.
On motion by Mr. Goehringer, seconded by Mr. Grigonis, it was
RESOLVED, that the application of HENRY S. KOZEN for permission to
construct "L-shaped" 6 -foot high fence in the frontyard area be and
hereby IS APPROVED AS APPLIED FOR in Appeal No. 2990.
Location of Property: 1520 Donna Drive, Mattituck, NY; County Tax
Map Parcel No. 1000-115-15-14.
Vote of the Board: Ayes: Messrs. Goehringer, Doyen, Grigonis,
Douglass and Doyen. This resolution was unanimously adopted.
