a. This application must be caopletely filled in by typewriter or in ink and submitted to the Building Inspector wi

streets or areas, and givitg a detailed description of layout of property must be drawn on the diagram which is part of
this application.
c. The Bork covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant, Such
permit shall be.kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose whatever until a Certificate of

I. Chapter 100 (Zoning) of the Code of the -Town of Southold Is hereby
amended as follows t

hereby amended to read as follows:
Applications to the Board of Appeals for any relief herein shall be
accompanied -by a fee as hereinafter provldedi
A. ' For applications involving fences, accessary structures or
• accessary buildings; alterations' or additions containing less
than two hundred (200 square feat In floFr.area, the fee
shall be one hundred fifty dollars ($160-00).

commercial property, 'containing a single request (for
example, an application requesting cne (1) variance or an

AREA VARIANCE
Amendments to Law at K267b-3 Effective July 1, 1992:
AREA VARIANCE: is authorization by the ZBA for the use of land
in a manlier ' which is not allowed by the dimensional or topographical
requirements of the applicable zoning code regulation. K267(1) of
Town Law.
The new Statute no longer includes the term "practical difficulty" .or
any particular test, and now provides that ZBAs consider two basic
things:
1. • the benefit to the applicant if the variance is granted; and
2. the detriment to the health, safety and general welfare of
the neighborhood or community that would occur if the
variance were to be granted.
BALANCING TEST: In balancing the interests above, ZBAs must
also consider the following five factors for an AREA VARIANCE:
1. whether an undesirable change will be produced in the
character of the neighborhood or a detriment to nearby
properties, if granted;
2. whether the benefit sought by the applicant can be achieved
by some method, feasible for the applicant to pursue, other
than an area variance;
3. whether the area variance is substantial;
4. whether the variance will have an adverse effect or impact
on the physical or environmental conditions in the
neighborhood or district; and
5. whether the alleged difficulty was self-created, which
consideration shall be relevant to the ZBA's decision but
shall not preclude the granting of an area variance.
Also, as part of the "balancing concept," the new Statute provides
that the ZBA shall grant the minimum variance that it shall deem
necessary and adequate, and at the same time preserve and protect
the character of the neighborhood and the health, safety and welfare
of the community. (K267 -b(3 -c) of Town Law.

I Eugene Heacock, authorize John Romanelli to act as my agent for the purpose of
acquiring Zoning Board of Appeals approval for my property at 3515 Cedar
Beach Rd Southold.
Mr. Romanelli is in contract to purchase my property and the only approval
needed to satisfy the lending institution is approval from the Zoning Board on a
pre-existing nonconforming structure, which I have made minor improvements to
over the years.
