PROPERTY FACTS/DESCRIPTION: The subject property consists of a total lot area of 12,200+ -
sq. ft. with 41 ft. frontage along Deep Hole Drive and average depth of 213 feet. Existing is a
one-story, one -family frame house. The applicant's sketch shows the dwelling at 4.5+- feet at its
closest point to the north property line, 21 feet to the south property line. The applicant notes a
63+- ft. setback to a tie line along the high water mark.
For informational purposes, prior ZBA determinations were rendered regarding this property under
Appl. No. 4232 for lot width and area in a lot -line change application for Thomas Palmer and J.
Gibbs, Appl. No. 4232, and Appl. No. 3871 for the location of an accessory building by J. Gibbs.
BASIS OF APPLICATION: Building Inspector Notice of Disapproval dated January 8, 1999 citing
Article XXIV, Section 100-244.6 for the reason that the Code requires "a combined side yard area
of twenty-five (25) feet" on nonconforming lots having less than 20,000 sq. ft. of land area. The
northwest side yard is proposed to remain at 4.5 feet, and the south side yard is proposed to be
15 feet. The combined side yard total is 19.5 feet.
AREA VARIANCE RELIEF REQUESTED: Applicant requests a Variance for a proposed
addition/alteration to an existing one -family dwelling which will have a combined side yard total at
19.5+- feet at its closest points (corners). Applicant proposes an extension at the north side of
the dwelling, the corner of which will be within the existing 4'6" setback and an addition, reducing
the south side yard setback to 15 feet at its closest point. No other variance has been requested
through this building permit/appeal process.
REASONS FOR BOARD ACTION: After consideration of the entire record, testimony at the public
hearing and other evidence, the Board finds the following facts to be true and relevant:
1. The lot is very narrow but fairly deep. The north setback of 4.5 feet is far less than the
required minimum of 10 feet. Any expansion of the house on that side, even maintaining the
current setback, would increase the volume of the house that is undesirably close to the
property line, adding to the appearance of crowdedness and infringing privacy.
2. Because the north setback is so small, any reduction of the south setback would lead to an
undesirable increase in the appearance of overcrowdedness.

3. Because applicant proposes to increase the height and bulk of the house, there are substantial
issues of increased crowdedness and encroachment on neighbors. The Board therefore
concludes that grant of the requested variance would produce an undesirable change in the
character of the neighborhood or detriment to nearby properties.
4. It is possible to expand the house within the present footprint or to expand the footprint to the
north, and these alternatives enable applicant to expand his house without the variance
requested in this application.
RESOLUTION/ACTION: On motion by Member Collins, seconded by Member Dinizio, it

RESOLVED, to DENY the variance as applied for.
Vote of the Board: Ayes: Dinizio, Tortora, Collins. Nay: Chairman Goehringer. This Resolution
was duly ADOPTED (3-1). (Member Horning of Fishers Island was absent.)

PROPERTY FACTS/DESCRIPTION: The subject property consists of a total lot area of 12,200+ -
sq. ft. with 41 ft. frontage along Deep Hole Drive and average depth of 213 feet. Existing is a
one-story, one -family frame house. The applicant's sketch shows the dwelling at 4.5+- feet at its
closest point to the north property line, 21 feet to the south property line. The applicant notes a
63+- ft. setback to a tie line along the high water mark.
For informational purposes, prior ZBA determinations were rendered regarding this property.under
Appl. No. 4232 for lot width and area in a lot -line change application for Thomas Palmer and J.
Gibbs, Appl. No. 4232, and Appl. No. 3871 for the location of an accessory building by J. Gibbs.
BASIS OF APPLICATION: Building Inspector Notice of Disapproval dated January 8, 1999 citing
Article XXIV, Section 100-244.B for the reason that the Code requires "a combined side yard area
of twenty-five (25) feet" on nonconforming lots having less than 20,000 sq. ft. of land area. The
northwest side yard is proposed to remain at 4.5 feet, and the south side yard is proposed to be
15 feet. The combined side yard total is'19.5 feet.
AREA VARIANCE RELIEF REQUESTED: Applicant requests a Variance for a proposed
addition/alteration to an existing one -family dwelling which will have a combined side yard total at
19.5+- feet at its closest points (corners). Applicant proposes an extension at the north side of
the dwelling, the corner of which will be within the existing 4'6" setback and an addition, reducing
the south side yard setback to 15 feet at its closest point. No other variance has been requested
through this building permit/appeal process.
REASONS FOR BOARD ACTION: After consideration of the entire record, testimony at the public
hearing and other evidence, the Board finds the following facts to be true and relevant:
1. The lot is very narrow but fairly deep. The north setback of 4.5 feet is far less than the
required minimum of 10 Feet. Any expansion of the house on that side, even maintaining the
current setback, would rease the volume of the house that is undesirably close to the
property line, adding to the appearance of crowdedness and infringing privacy.
2. Because the north setback is so small, any reduction of the south setback would lead to an
undesirable increase in the appearance of overcrowded ness.

3. Because applicant proposes to increase the height and bulk of the house, there are substantial
issues of increased crowdedness and encroachment on neighbors. The Board therefore
concludes that grant of the requested variance would ,produce an undesirable change in the
character of the neighborhood or detriment to nearby properties.
4. It is possible to expand the house within the present footprint or to expand the footprint to the
north,, and these alternatives enable applicant to expand his house without the variance
requested in this application.
RESOLUTION_ /ACTION: On motion by Member Collins, seconded by Member Dinizio,, it

RESOLVED, to DENY the variance as applied for.

have an actual survey on behalf of John Metzger, indicating sideyard
at one point of 4-1/2 feet and at the other side 15 feet, total
combined side yard is 19-1/2 feet proposed and I have a copy of -the
Suffolk County Tax Map indicating this and surrounding properties
in the area. I see you have some green cards for us. You are Mr.
Ludlow?
MR. LUDLOW: Yes.

MR. LUDLOW: Fine. How are you this evening?
CHAIRMAN GOEHRINGER: Good, thank you. Anything else he owes

MR. LUDLOW: I'm Tom Ludlow and I'm acting on behalf of Stephen
and Barbara Friedman for some additions and renovations proposed
to their residence at 2140 Deep Hole Drive. As you just stated, the
reason we need a, we're asking for relief, side yard relief because
of the combined side yards being less than 25 feet. The reason we
feel that the relief isn't too drastic and the neighbors should be
rewarded is go on the original setbacks would be 10 or 15, 10 and
15 and we do have that on the side we want to add to. Of course
the exsiting side of 4-1/2 feet is what is causing the problem. And
also the fact that the house is built not parallel with the lot line
or either lot line and the actual relief as far as square footage of
the house is really quite small. It's just a corner sticking over or
infringing on that. And, to change though, even if it's a small part
of the house, to change it is a really drastically changing the whole
thought of the house. We'd never get the three rooms downstairs
facing the water. You know it would be terribly disappointing to
them and basically in a nut shell like I said, you know, we feel it's
not too much to ask and that's why we decided 'to ask. Thank you.
CHAIRMAN GOEHRINGER: Mr. Ludlow, we have a non precedence
that you must leave one side yard opened and for the record, 15

feet is adequate in my opinion. The purpose of that is to of course
gain access to the rear of the property which in this case is the
water side. So, I do not have a particular problem with your
application or your agent, your owner's application. We'll start

house, the yellow house next door.

concerned of what is going on here.
CHAIRMAN GOEHRINGER: Can I just ask a question? You're on
5.1 or 3.
You're on 5. 1, tax map what 5. what? You have the larger lot
which is like 32 feet on the run? 107 feet or something like that
on the run?
MEMBER COLLINS: She has the little one.
CHAIRMAN GOEHRINGER: Oh, she has the one on the other side?
OK.
MS. VILLANO: And we renovated about ten years ago and we
stayed within our original cottage and went up. What concerns me
is 4-1/2 feet from their house to the property line and as I spoke
with Mrs. Friedman, she explained to me that part of the house is
going to be straightened out and therefore, it's on an angle so the
house closest to the part of the house closest to the water, is going
to get closer to my house. My house is 10 feet from the property
line and their house is going up. I don't want it to be like Queens
or -
CHAIRMAN GOEHRINGER: Did you see the plans?
MS. VILLANO: I did and Mrs. Friedman could not tell me how many
feet closer to my property that house was going to come as it gets
built.
CHAIRMAN GOEHRINGER: And that really isn't. Come up and we'll
show you. I'm not pushing this application. I'm just saying, it
really isn't closer to your property because it's going to be

sure, never going to get any closer than it is now.

So, you're going to have -

consider these plans they're not to be altered.

approve. You don't go back and alter it later. So, if you have
plans to alter it, let us know.

MR. LUDLOW: As of right now, there's nothing altered and I don't
know if -

MEMBER LUDLOW: There's a couple of things with this close
setback. You may have access for a fire truck on that side. You
couldn't fight the fire without going on to your neighbor's property
on tht side, 4-1/2 feet, nor could you get a ladder there
to repair the house. So, in my personal view I'd like to see you
come back with the plans with at least 8 foot from that property line.
MR. LUDLOW: You mean demolish part of the house?
MEMBER TORTORA: How much of this is this being built?
MR. LUDLOW: Well the addition is all- on the, as is, is all on this
side. This whole side as existing. Now we're raising that existing.
CHAIRMAN GOEHRINGER: How high are you raising?
MR. LUDLOW: I'd say about 1 foot 9 or something like that.
CHAIRMAN GOEHRINGER: Yes, so I mean it's still going to be a one
story structure?
MR. LUDLOW: Yeah we're just, I mean, adding to the foundation to
put on to.
MEMBER COLLINS: Excuse me, Mr. Chairman. This drawing Mr.
Ludlow that shows in hatched marks, where you want to put the
addition on which we're seeking var, you're seeking a variance, it
also shows that the area we were just talking about on Mrs. Villano
side of the property is to become a two story. That's, that's why I
was making the comment about David and Goliath.
MEMBER HORNING: The map shows that.
MR. LUDLOW: I don't even see that. Where did that come from?
CHAIRMAN GOEHRINGER: Actually we're dealing with three maps.
One has the original footprint, one is the survey and is the penned
in map.
MEMBER TORTORA: Lori, you're looking at the faxed one.
MEMBER COLLINS: The one with hatched marks. Yes, which shows
that on that side of the property they're not changing the profile of
the house, but going up and adding a second floor.

you give us the best map you can, footprint map and then a copy of
the plan so we know exactly what we have.

MEMBER DINIZIO: That I'm to understand that the 4-1/2 feet exists
right now?
CHAIRMAN GOEHRINGER: That is correct.

MEMBER DINIZIO: So, it's not the subject of this?
MEMBER TORTORA : No.
MR. LUDLOW: Right.
MEMBER DINIZIO: The subject of this variance is the fact, that
both side yards don't add up to 25 feet?
CHAIRMAN GOEHRINGER: That is correct.
MS. VILLANO: Plus I'm questioning if they're going to come out
anymore on that side which Mrs. Friedman had said, they thought
they would come out anywhere in our conversation which I like Mrs.
Friedman by the way. They're very nice neighbors. Maybe two
more feet, she wasn't sure and I'm just concerned about it.
MR. LUDLOW: Well that's understandable.
MEMBER DINIZIO: Yes. I mean I can say this, you can't go any
further than that. He's not asking us for that. He can't possibly
do that.
MS. VILLANO: But I wanted to be sure that that's not going to
happen.
CHAIRMAN GOEHRINGER: We will make sure.

these teeny little cottages and they're allowed to make these huge
mansions on these small pieces of property and maybe somewhere
down the road before it's too late that the zoning could be changed
sothat they can't go beyond the footprint that they have or that it
can't occupy more than a certain percentage of their piece of
property.

Based on the information you have submitted, the New York State
Department of Environmental Conservation has determined that:
The property landward of the wood bulkhead which was constructed
prior to Septa 20, 1977, as shown on the survey prepared by
Roderick VanTuyl dated Oct. -1, 1975, is beyond Article 25
jurisdiction.
Therefore, in accordance with the current Tidal Wetlands Land Use
Regulations (6NYCRR Part 661) no permit is required under the Tidal
Wetlands Act . Please be advised, however, that no construction,
sedimentation, or disturbance of any kind may take place seaward of
the tidal wetlands jurisdictional boundary,, as indicated above,
without a permit. It is your responsibility to 'ensure that all
necessary precautions are taken to prevent any sedimentation or
other alteration or disturbance to the ground surface or vegetation
within Tidal Wetlands jurisdiction which may result from your
project. Such precautions may include maintaining adequate work
area between the tidal wetland jurisdictional boundary and your
project (i.e. a 15, to 20, wide construction area) or erecting a
temporary fence, barrier, or hay bale berm.

ACTION OF THE BOARD OF APPEALS
Upon Application of THOMAS PALMER and JOAN GIBBS.
This is a request for a variance under Article IIIA, Section
100-30A.3, based upon the March 2, 1994 Notice of Disapproval
for a lot -line change of two substandard parcels,. having
insufficient area and width as exist and as proposed. Location
of Property: 2140 and 2200 Deep Hole Drive, Mattituck, NY;
County Tax Map Parcels 1000-123-4-4 and 5.
WHEREAS, on. March 2, 1994 a _ Notice of Disapproval was
issued by the Building Inspector concerning an application to
relocate center property line between _ two existing parcels, each
improved with a single-family dwelling; and
WHEREAS,. on April 6, 1994, this area application
concerning lot area and width for each of the two parcels was
filed together with a single -and -separate search; and
WHEREAS,'. after due notice, a public hearing was held by
the Board of Appeals on May 4, 1994, at which time all those
who desired to be heard -were heard and' their testimony
recorded (and no opposition was submitted) ;
WHEREAS, .the Board has carefully considered all testimony
and documentation submitted concerning this application;
WHEREAS, Board Members have personally viewed and are .
familiar with the premises in question,_ its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the followingTindings of Fact:
1. This is an application concerning two parcels of land,
each as more particularly shown on the February 23, 1994
survey map prepared by Roderick VanTuyl, P.C. from which the
following information was obtained:
a) Parcel 1 consists of a total lot area of 21,500 sq.
ft., and is referred to as Tax Map Number 1000-123-4-4 as
conveyed 6/10/90 to Joan C. Gibbs.

b) Parcel 2 consists of a lot area of 11,900 sq. ft.
and is presently referred to as County Tax Map No. 5 as
conveyed to Mr. and Mrs. Thomas Palmer 6/3/91.
2. By this variance application, appellants are requesting
permission to re -draw the center division line as shown on the
Sketch Map preared February 23, 1994 by Roderick VanTuyl
with the following:
a) Parcel 1 will change from 21,500 sq. ft. to 12,200
sq. ft. and from 82.0 feet to 41.0 feet in lot width;
b) Parcel 2 will change from 11,900 sq. ft. to 21,200
sq. ft. in area and from 41.0 feet to 82.0 feet in lot width;
3. This property is located in the R-40 Low -Density
Residential Zone District which requires 40,000 sq. ft. of lot
area per new lot to be created (Article III, Section 100-30A.3,
Bulk Schedule applicable to the R-40 Zone District) . Since the
two lots are substandard in size as exist (before this proposed
change in the lot division line), an area variance is required
to reduce the lot 'area of one - while at the same time
increasing the lot area of the other. A single -and -separate
search was submitted to show that these two lots were existing
in single and separate ownership since prior to enactment of
one -acre zoning in 1971. Each of the two lots is improved with
a single-family, one-story dwelling structure.
4. The percentage of relief sought by this application is
zero for the reason that there is merely an exchange in lot size
between Lot 1 and Lot 2 - without any other conveyance or
split, and there is no increase in density or affect on the
total area of the lots (combined total) .
5. In considering this application, the Board also finds
and determines:
(a) the relief as granted is not substantial in
relation to lots established in the close vicinity of this
property and does not create increased lot density;
(b) the circumstances are uniquely related to the
property and there is no method feasible for appellant to pursue
other than a variance;
(c) the relief requested will not cause a substantial
effect on available governmental facilities;

(d) the variance will not in turn be adverse to the
safety, health, welfare, comfort, convenience, or order of the
town, or be adverse to neighboring properties;
(e) the relief sought by applicant cannot be achieved
by a method other than an area variance;
(f) the proposed variance will not have an adverse
effect or impact on the physical or environmental conditions in
this neighborhood or zone district - the new location of the
division line is for record purposes and is not visible to the
lands;
(g) the difficulty is related to the uniqueness of
the property and is not self-created;
(h) the relief requested is the minimum necessary to
afford relief .
(i) in view of the manner in which the difficulties
arose, and in considering all the above factors, the interests
of justice will be served by granting the variance, as
conditionally noted below.
Accordingly, on motion by Member Wilton, seconded by
Member Villa, it was
RESOLVED, to GRANT the relief as 'requested under Appeal
No. 4174 in the Matter of THOMAS PALMER and JOAN C. GIBBS
in this re -adjustment of lot lines for two substandard parcels,
shown as Parcel 1 and Parcel 2 on the survey map prepared by
Roderick VanTuyl, P.C. dated February 23, 1994.
Vote of the Board: Ayes: Messrs. Doyen, Goehringer,

regular scheduled meeting. How are you tonight Sir?
MR. LUDLOW: I'm fine. How are you guys doing?
BOARD SECRETARY KOWALSKI: Could he state his name.
CHAIRMAN GOEHRINGER: Yeah, just state your name for the
record.
MR. LUDLOW: I'm Tom Ludlow. I'm acting on their behalf and then
I say contractor.
CHAIRMAN GOEHRINGER: OK, we noticed that a the a portion of the
side yard that brings it down to that 4.6 is filled in, it's squared
out to a certain decree?
MR. LUDLOW: Yes.
CHAIRMAN GOEHRINGER: OK. That in that location is a one story
structure, is that correct?
MR. LUDLOW: Yeah, that's correct.
CHAIRMAN GOEHRINGER: OK, are there any other changes?
MR. LUDLOW: ' No, that was it.
CHAIRMAN GOEHRINGER: Alright, we'll see what develops
throughout the hearing. Any questions of Mr. Ludlow?
MEMBER DINIZIO: No.
CHAIRMAN GOEHRINGER: Mrs. Tortora? I see. you pondering.
MEMBER TORTORA: No, they just put a, you just filled in the area
of that addition on that one. side that you talked about before. So
that's what's new?
MR. LUDLOW: Yeah, correct.
CHAIRMAN GOEHRINGER: Which actually ends up to be a bedroom?
MR. LUDLOW: Yeah, the area now is two small bedrooms, and a
microscopic bathroom and it's basically even with the addition. It's
just one bedroom and a bathroom.

the hearing Mr. Ludlow. We thank you. Is there anybody else

would you come up. Hi, how are you tonight.
MS. VILLIANO: Good, thank you.
CHAIRMAN GOEHRINGER: Just state your name for the record
again if you would.
MS. VILLANO: I'm Elaine Villano . I live on one side. I'm not
opposed to the renovation per se but, I can oppose . to the renovation
the way it comes out closer to my property.
CHAIRMAN GOEHRINGER: Right.
MRS. VILLANO: I took some pictures and I'd like to share it with
the Board. You can keep those.
CHAIRMAN GOEHRINGER: Thank,you. Now this is off the. side of
your house?
MRS. VILLANO: That's correct.
CHAIRMAN GOEHRINGER: OK.
MRS. VILLANO: What also concerns me is it possible for the
renovation at a later date in making that one story into a two story
would certainly bring it a lot closer . as you go up? I'm also
concerned if there ever were a fire in even one of our houses. How
much quicker .one home would affect the other home.
CHAIRMAN GOEHRINGER: You said, I don't mean to correct you
only I apologize.
MRS. VILLANO: That's alright.
CHAIRMAN GOEHRINGER: Or break into your conversation is what
I really did. You said your house was exactly 10 feet off the line?
MRS. VILLANO: I believe so. I have a copy of my survey.
CHAIRMAN GOEHRINGER: OK, could we see that for one second.
MRS. VILLANO: Sure. This one is from several years back.
CHAIRMAN GOEHRINGER: OK, but this is the finish product, right?
MRS. VILLANO: My survey?
CHAIRMAN GOEHRINGER: Yes.
MRS. VILLANO: Yeah, I mean I have another story on there. This
one says one story. But, that's the out frame.

MRS. VILLANO: The footage is the same.
CHAIRMAN GOEHRINGER: We're talking the side that says Gibbs

CHAIRMAN GOEHRINGER: Because that shows 9 feet.
MRS. VILLANO: OK, I'thought it was 10 feet.
CHAIRMAN GOEHRINGER: OK.
BOARD SECRETARY KOWALSKI: Actually it's 9-1/2 feet.
MRS. VILLANO: This extension is going to house a bedroom and of
course that will bring it closer again to my property. My property
perhaps has a walkway and I just hope in the future we're not going
to be concerned about disputes over noise levels.
CHAIRMAN GOEHRINGER: Right.
MRS. VILLANO: And of course the possible resale value of the
home. I know we're close already but you just never know how
somebody may feel that we're I believe they're going to go up to 4
feet 6 inches.
CHAIRMAN GOEHRINGER: Right.
MRS. VILLANO: From the property line as it extends down.
CHAIRMAN GOEHRINGER: Can .we keep this?
MRS. VILLANO: Yes, you may. And I'm also concerned either way
however you decide how it's going to effect the existing trees and
my fence. I wouldn't want to have any disputes during this
renovation either.
CHAIRMAN GOEHRINGER: Right. OK. Any questions of Mrs. Villano?
MEMBER DINIZIO: No.
CHAIRMAN GOEHRINGER: No, thank you very much.
MRS. VILLANO: Thank you.

MR. FRIEDMAN: I'm the owner. We've taken great lengths I think
to make sure we maintain privacy between the properties . We are
very close. We're very aware of that. We don't believe that moving
the bedroom back the way we designed it will create a furtherance
problems of privacy. We spent a considerable amount of money
adding landscaping fees. In fact put $5,000 into new trees and
the porch. Once again to preserve the privacy and to dampen
the noise. Certainly it has endurance but it has maintenance in
continuing that if there's a problem with trees between our
properties we would like to make sure the trees are there.
CHAIRMAN GOEHRINGER: OK, the same question that occurred in
the last hearing but probably a little bit different. Assuming we
can't agree, OK, on this situation are you willing to accept
alternate relief?
MR. FRIEDMAN: Yeah, I believe in compromising.
CHAIRMAN GOEHRINGER: OK, and the second part of that story
is, or. situation is, do you object to a restriction at that side of
the house remain as one story?
MR. FRIEDMAN: No.
CHAIRMAN GOEHRINGER: OK, any questions of Mr. Friedman?
MEMBER DINIZIO: No.
CHAIRMAN GOEHRINGER: Mrs. Tortora?
MEMBER TORTORA : All I can say is ' that you should be looking at
the pictures. Mrs. Villano does make a very compelling case for
some privacy.
MR. FRIEDMAN: If I may address that?
CHAIRMAN GOEHRINGER: Surely.
MR. FRIEDMAN: The currently the way the house is set up, one of
the bedrooms is a very, very tiny bedroom. You can fit in a queen
size bed and that's about it, that's where I sleep. But, there is a
window that looks back into the a, my neighbor's property and
certainly it's true that if somebody comes in along the walkway and
goes into the upper deck, you can see them and hear them and the
way this has been redesigned, there will not be a window there,
OK, so, I believe that the design will be comparable although it
moves the house two feet- closer. In fact, we've eliminated
windows. As I said, -we're, we're as interested in privacy as my
neighbor. So, we've certainly taken enough steps needed to
preserve that. I don't think, the fact of the matter -is, the houses
are very close already. I think that this redesign actually results
in more privacy if nothing else.

MRS. VILLANO: I just wanted to make mention that, Steve, when
Barbara had sent me the plans -
CHAIRMAN GOEHRINGER: You, you have to a -
MRS. VILLANO: Oh, I'm sorry. When Mrs. Friedman faxed me
what they were going to do, I believe that there was going to be
three windows on that side.
CHAIRMAN GOEHRINGER: Well we have the a, why don't you take a
look at the plan?
MRS. VILLANO: Gladly.
CHAIRMAN GOEHRINGER: I don't see any window on that side. I
only see two: I see two right here.
MRS. VILLANO: OK, she says and be replaced by I mean this is
what she had said to me.
CHAIRMAN GOEHRINGER: Here's the plan. I see no window on
this side. I see two here.
MRS. VILLANO: OK, because she had said, that's her notes, OK.
And the other thing I just wanted to mention. The plans are great
but I do understand that they did submit two or three other plans
to the ZBA that would not encroach it. It wouldn't go further out
because that's what stopped the meeting the last time was when you
said to me, . oh no, it's not coming closer to your home and I said,
well Mrs. Friedman had said to me, it may come over 1, 2, maybe 3
feet and we had determined what it was, and it was 4 feet 8 inches I
believe that would be coming over at some point.
CHAIRMAN GOEHRINGER: Yes.
BOARD SECRETARY KOWALSKI: That's right.
CHAIRMAN GOEHRINGER: 4 feet 6 inches. 4 feet 6 inches, yeah.
Yeah, well it's, it's interesting the way it comes out because it, it
holds the original side yard, the established, side yard 4.6 but then
you have the opening and then it cuts back, it scallops itself back,

because your further exacerbating it and already established really
undersized -

CHAIRMAN GOEHRINGER: Post quarters side yard.
MR. LUDLOW: I can understand that.
CHAIRMAN GOEHRINGER: That's was the purpose of asking your
client about the alternate relief aspect because we really don't know
how everybody feels about it and you know we will address it on the
7th of June if we don't do it tonight.

Dear Applicant:
Please find enclosed a copy of the Legal Notice describing your recent application. The
Notice will be published in the next issue of the Suffolk Times newspaper, the Town's
official newspaper for 2/1999-2/2000.
Pursuant to Chapter 58 of the Southold Town Code (copy enclosed), formal notice of your
application and hearing must be mailed and shall include a map or sketch showing the new
location with the setbacks and use noted. Send this Notice, as soon as possible, with the
map to all owners of land (vacant or improved) surrounding yours, including land across
any street or right-of-way that borders your property. Use the current addresses shown on
the assessment rolls maintained by the Town Assessors' Office (765-1937) or the County
Real Property Office in Riverhead. If you know of another address for a neighbor, you may
want to send the notice to that address as well.
Please submit your Affidavit of Mailing to us by the Friday before the hearing date, with the
post office receipts postmarked. Later, when the green signature cards are returned to you
by the Post Office, please mail or deliver them to us. If any signature card is not returned,
please advise the Board at the hearing.
You must post the enclosed sign no later than. 4/14/99. Post the sign facing the street, no
more than 10 feet from your front property line bordering the street. (If you border more
than one street or roadway, a sign is enclosed for the front yard facing each one.) The
sign(s) must remain in place for at least seven (7) days, and if possible, should remain

SPECIFICATIONS
1. GENERAL REQUIREMENTS:
The plans and specifications are mutual and cooperative. All labor and material required to fully carry)
out the intentions of the plans and specification are part of this contract, whether or not specifically
documented. The Contractor shall provide each item mentioned, indicated, or implied to achieve the
intended building according to the methods of best construction practice. In no event is any article,
operation, method or material to fall below the standards set by FHA Minimum Property Standards for
One and Two -Living Units, latest edition, and all amendments to date. (The Contractor will comply with
all State and Local codes even in the event of conflicting requirements in the plans and specifications a
no additional cost to the Owner.) All equipment and materials are to be installed according to
manufacturers' recommendations, and are to be new. The Architect shall be the final judge of the
quality of the workmanship, and reserves the right to reject any work which he considers inferior.
2. SITE WORK:
The general provisions of the Contract, including the conditions of the contract (General, Supplemental -
and other Conditions) and Division I as appropriate, apply to the Work specified in this section.
A. TIDAL WETLANDS PROTECTION: Contractor to erect a hay bale berm
between area of construction and bulkhead to prevent runoff as required by N.Y.S.D.E.C.
B. DEMOLITION & CARTING: Contractor shall take all necessary precautions to insure the safety of
the existing structure and shall be responsible for the protection of all existing and new conditions
and materials within the construction area. Contractor shall take all due care to protect the site
including all trees, shrubs and landscaping from damage during demolition, construction and
carting. Contractor shall be responsible for the prompt removal of all demolition and construction
debris including all disposal fees.
C. CONSTRUCTION: Clear as required, remove and store topsoil. Excavate as required for
foundations, mechanical and electrical work. Any back fill to be well compacted. Grade as per fina
contours on drawings and to permit positive drainage away from structure. Restore topsoil ready
for seeding.
3. CONCRETE:
The general provisions of the Contract, including the conditions of the contract (General, Supplementan
and other Conditions) and Division I as appropriate, apply to the Work specified in this section.
Minimum strength 2500 psi. Reinforcing bars as detailed, mesh reinforcing of all footings and slabs of
6"x6" x 10/10 wire mesh lapped 6". Provide 1/2" thick pre -molded filler at perimeter of all slabs.
4. MASONRY:
The general provisions of the Contract, including the conditions of the contract (General, Supplementan
and other Conditions) and Division I as appropriate, apply to the Work specified in this section.
Concrete block, thickness as shown with Dur -O -Wall, or equivalent, steel reinforcing every other
horizontal course.
5. METALS:
The general provisions of the Contract, including the conditions of the contract (General, Supplementary
and other Conditions) and Division I as appropriate, apply to the Work specified in this section.
A. FLASHING: All roof penetrations for plumbing vents, chimneys or juncture of old and new
construction shall be properly flashed. All flashing is to be copper.
B. FASTENERS: All anchor bolts, framing anchors, and hangers to be galvanized. Zinc chromate
primer of all other steel.
6. CARPENTRY & MILLWORK:
The general provisions of the Contract, including the conditions of the contract (General, Supplementary
and other Conditions) and Division I as appropriate, apply to the Work specified in this section.
A. FRAMING: All structural framing to be of Douglas Fir construction grade, 1200 psi unless
otherwise specified. Bridging and blocking at maximum of 8'-0" o.c. for all walls and floors.
Exterior walls to be 2"x6" kiln dried studs @ 16"o.c. Interior walls to be 2"x4" kilndried studs @ 16"
O.C.
B. PLYWOOD: All plywood sheathing of roof, walls and sub floors to be '/_," exterior grade.
C. ROOF: All rafters to be tied down to plate with 16-18 gauge steel anchors (hurricane straps).
Exterior grade plywood to be covered with #15 asphalt -impregnated roofing felts lapped 6" in all
directions. Pitched roofing to be a Class A, 30 year architectural asphalt shingle. Provide a 3'-0"
wide band of waterproof membrane (ice and snow shield) at eave edge of roof. Provide continuous
vents in roof eaves and ridge.
D. SIDING: Exterior plywood sheathing to be wrapped in Typar housewrap. Exterior siding to be SH
'of clear cedar with 5" exposure.
E. DECKING & POSTS: All exposed decking and posts shall be of pressure treated lumber.
F. INTERIOR WOODWORK: All baseboards, window and door trim to be of 92 grade pine or poplar,
1"x4" flat casing. Nails to be countersunk, with all holes and joints filled, sanded and ready for
paint.
7. THERMAL & MOISTURE PROTECTION:
The general provisions of the Contract, including the conditions of the contract (General, Supplementary
and other Conditions) and Division I as appropriate, apply to the Work specified in this section.
A. FOUNDATION: All exposed foundation walls to be Stucco finished.
B. DAMPROOFING: Two (2) coats bituminous waterproofing on all outside
faces of foundation wall.
C. INSULATION: All exterior walls and roof to be insulated to meet energy codes. Provide fiberglass
batt insulation between floor joists above crawl space. Provide 1" rigid insulation where indicated
on drawings.
D. SEALANTS: All joints to be sealed with an elastomeric silicone sealer, color by architect. Where
opening is more than 3/8" deep, pack with Neoprene joint filler to within 3/8" of surface then seal
with silicone sealer.
8. DOORS, WINDOWS AND GLASS:
The general provisions of the Contract, including the conditions of the contract (General, Supplementary
and other Conditions) and Division I as appropriate, apply to the Work specified in this section.
A. See window and door schedule.
B. EXTERIOR TRIM: All exterior trim to be of 1'x4" clear cedar.
C. WEATHER STRIPPING: Provide weatherstripping to all windows and doors not factory stripped at
top, sides and sill.
D. HARDWARE: To be supplied by Owner, installed by contractor.
9. FINISHES:
The general provisions of the Contract, including the conditions of the contract (General, Supplementary
and other Conditions) and Division I as appropriate, apply to the Work specified in this section.
A. WALLS: All walls to have'/" gyp. board both sides with comer beads. All bathroom and kitchen
walls to be 1/2" green board. To be installed in accordance with USG "Gypsum Drywall Construction
Handbook", latest edition.
Shower and tub areas to be tiled are to be sheathed with 1/2" Hardee tile backer board.
B. ICEILING: All ceilings to be 1/2' gyp. board in accordance with "Gypsum Drywall Construction
Handbook", latest edition.
Master bedroom and study ceiling to be 1"x5" ship lap or tongue in groove common pine #2 grade.
C. FLOORING: All wood flooring to be sanded, sealed and given three coats of matte finish oil base
ureathane.
D. TILE: All floor and wall tile to be supplied by Owner and installed by contractor. Installation to be
thinset unless otherwise specified. Tile grout cement to be tinted to match tile color and approved
by Architect.
E. PAINTING: See painting schedule.
10. SPECIALTIES:
The general provisions of the Contract, including the conditions of the contract (General, Supplementary
and other Conditions) and Division I as appropriate, apply to the Work specified in this section.
Install all bathroom fixtures and accessories furnished by Owner.
11.EQUIPMENT:
The general provisions of the Contract, including the conditions of the contract (General, Supplementary
and other Conditions) and Division I as appropriate, apply to the Work specified in this section.
Install Fireplace unit "Majectic Super Hearth 42," wood burning firebox with metal flue following
manufacturers installation and operations instructions. Install kitchen and laundry equipment furnished
by Owner, providing all necessary ducts, wiring and plumbing.
12. MECHANICAL: The general provisions of the Contract, including the conditions of the contract
(General, Supplementary and other Conditions) and Division I as appropriate, apply to the Work
specified in this section.
A. HEATING, VENTILATING AND AIR CONDITIONING: Contractor to analyze capacity and
condition of existing system. System to be upgraded to provide cost efficient heating and cooling
sufficient to service existing and new construction.
B. PLUMBING: All work to comply with National Plumbing Code and all state and local codes. All
hot and cold water piping shall be 95/5 type L copper tubing per code. Under ground services and
gas lines to be galvanized iron. Hose bibs to be non -freeze type.
Repair all existing plumbing where damaged by demolition or new
construction. Any removed piping shall be properly terminated and
capped or plugged.
13. ELECTRICAL:
The general provisions of the Contract, including the conditions of the contract (General, Supplementary
and other Conditions) and Division I as appropriate, apply to the Work specified in this section.
Licensed Electrician to confirm that sufficient power exists to service the herein specified electrical
requirements. All work to be preformed in accordance with the required Building Codes. Upon
completion, if required by the municipal authorities, Electrician shall furnish and file a Certificate of
Electrical Inspection. Install smoke alarms in accordance with the Building Code.
14.PAINTING:
The general provisions of the Contract, including the conditions of the contract
(General, Supplementary and other Conditions) and Division I as appropriate,
apply to the Work specified in this section.
The color is to be selected by the Architect.
A. Exterior:
1. Siding — semi -transparent stain.
2. Trim, Columns, Fascias — Latex enamel — primer and two coats.
3. Doors — entrance and service — Latex enamel — primer and two coats.
4. Porch and Railings — Latex enamel — primer and two coats.
B. Interior:
1. Walls — Flat latex — primer and two coats.
