Dear Mr. Fitzgerald:
This will confirm the status of the application which was delivered for reviews with
respect to the October 15, 1998 Notice of Disapproval by the Building Inspector and the
request for a rear yard setback reduction.
a) Our records show that the property in 1987 exceeded the 20% lot coverage
limitations of the code for maximum of 23.8%. Please furnish all calculations
for existing buildings, deleting the marsh and wetland areas from the lot
calculations, and the proposed square footage of lot coverage.
b) Please furnish a statement or Notice of Disapproval which will state whether
or not the applicant will require other zoning relief with regard to lot coverage
and with regard to the accessory buildings (new side yard with the proposed
dwelling addition).
c) Please provide a copy of the Town Trustees' determination with regard to
the setback from the existing marsh and wetlands.
d) Please provide amendments to the variance application for other zoning relief
regarding the lot coverage and side yard location of existing sheds, if deemed

The following application(s) have been incomplete for quite some time. Please advise
whether you wish to leave the application(s) status quo, as submitted in incomplete form,
or whether the applications should be returned to the applicants for re -submission with
the required information. The items missing from the application submissions are noted
below:
Faith Reform Baptist request for Interpretation' as to need for a Special Exception
Attorney has not submitted a Site layout with Special
Exception elements; missing data about current principal use
(or uses) of property. (Last communications were 5/13/99
and again on 9/21/99 stating that site mapping was discussed
with Garrett Strang, although no indication was given as to
whether Mr. Strang was hired or when the map would be
submitted. We are also awaiting a variance application
based on the October 1998 Notice of Disapproval.)

of a lot coverage determination and map showing the location of current wetland

REASONS FOR AREA VARIANCE:
1. An undesirable change will NOT be produced in the character of the neighborhood or a det-
riment to nearby properties, if granted BECAUSE:
The proposed addition is very modest in size (300 sq. ft. footprint) and it will result in a
house of only about 1180 sq. ft. total. This is certainly in keeping with the other houses in
the neighborhood, and it will also be suitable from an esthetic standpoint because its design
is similar to the existing house and the others in the neighborhood.
2. The benefit sought by the applicant CANNOT be achieved by some method, feasible for
the applicant to pursue, other than an area variance BECAUSE:
The design of the existing house (the location of the rooms) and the size and configuration
of the lot dictate that the proposed expansion be located as proposed.
3. The amount of relief requested is not substantial BECAUSE:
The required rear yard setback is 35'; the proposed rear yard setback is 30'
4. The variance will NOT have an adverse effect or impact on the physical or environmental
conditions in the neighborhood or district BECAUSE:
The expanded residence will not result in a significant adverse change in the neighborhood
since it will be of a size and design consistent with the other residences in the neighbor-
hood; it will have no significant environmental impact.
5. Has the alleged difficulty been self-created?
