PROPERTY FACTS/DESCRIPTION: The subject property is known as Lot 44 on the Map of Harbor
Lights Estates, Section 2, with 100 ft. frontage along the north side of Harbor Lights Drive and a
depth of 200 feet. Existing is a two-story, one -family frame dwelling with a footprint (lot
coverage) area of 3,748 sq. ft. it is situated 36.7 feet from the front property line, 13.5 feet from
the west side line, 12.4 feet from the east side line, and contains a lot area of 20,000 sq. ft. In
the original application, a building permit was requested for a 20 ft. by 40 ft. in -ground swimming
pool structure at 50 feet from the bulkhead and 18.5 feet from the westerly side property line, and
a brick patio at approximately 45 feet from the bulkhead and 13.5 feet from the westerly side line.
The proposed lot coverage was requested at 29.03%, or 5,818 sq. ft.
BASIS OF APPLICATION: Building Inspector Notice of Disapproval dated February 26, 1999 citing
Article IIIA, Section 100-30A.3 for lot coverage, and Article X(III, Section 100-239AB for reduced
setback from bulkhead.
AREA VARIANCE RELIEF REQUESTED: Applicants request a Variance for the placement of an
inground swimming pool as follows:
1) Lot Coverage. The proposed lot coverage with the original request was 29.03%, or
5,818 sq. ft. The lot coverage calculation was reduced by applicant, after discussions at the April
22, 1999 hearing, from 29.03% (5818 sf.) to 24.06% (4812 sf.). An amended survey was
submitted April 23, 1999 confirming applicant's revisions.
2) Bulkhead Setback. The proposed setback for the swimming pool was revised for a
distance of 52 feet from the bulkhead at its closest point. A fence will surround the pool as
required by the NYS Building Code.
REASONS FOR BOARD ACTION: In considering this application, the Board finds that variances to
allow construction of a 18 ft. by 38 ft. swimming pool with a minimum setback from the bulkhead
of 50 feet, and to allow for construction of a 10 ft. by 38 ft. decking for a total lot coverage of
24.04%, or 4812 sq. ft., is the minimum necessary and adequate and at the same time will
preserve and protect the character of the neighborhood, and the health, safety, welfare of the
community.
1. Grant of the area variances will not be a detriment to nearby properties because the pool will

be located at grade level and conforms to the required side yard setbacks from adjoining
property owners. No evidence was presented to suggest that the minimum relief hereby
granted will produce an undesirable change in the character of the neighborhood. Many
residences in the neighborhood enjoy in -ground swimming pools.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than area variances, because the property is nonconforming in size
and there are no other locations on the property which would not require variances to
construct a swimming pool.
3. The variance granted for lot coverage of 24% is not substantial and represents a 16 percent
increase in the code required 20% maximum. The variance granted for the bulkhead at 52
feet is substantial and represents a 31% reduction in the code -required 75 foot setback.
4. The difficulty has been in part self-created and relates to the applicant's desire to enjoy a
swimming pool, and is in part due to the small size and shape of the lot.
5. The proposed variance will not have an adverse effect or impact on the
physical or environmental conditions in the neighborhood or district.
RESOLUTION/ACTION: On motion by Member Tortora, seconded by Chairman Goehringer, it was
RESOLVED, to GRANT the variance, as applied for, SUBJECT to the CONDITION that an
evergreen border be planted and mantained in good condition on the west side, for 28 feet in
width (the pool and patio area), for a minimum height of three feet.

the Town of Southold, the following application will be held for public hearing by the
SOUTHOLD TOWN'BOARD OF APPEALS, at the Southold Town Hall, 53095 Main Road,

is requested for the reason that applicant seeks to construct a swimming pool. The
lot size is extremely smallgiventhat it is located in the R-40 zone. It
is approximatatly one -hal f'of'the required lot size. The only -necessary.
relief for the pool is for lot coverage of 29% including the proposed
patio. The total lot coverage will only be 5,818 square feet.

REASON FOR APPEAL Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because due to the minimal size of lot, and the 20% total lot
coverage requirement on this parcel the lot is extremely limited in terms
of building ability. Under the existing standard, the total permitted lot
coverage is only 4,000 square feet for all structure including patios,
decks, etc. A conforming lot in this zone would have a permitted lot
coverage of 8,000.00 square feet, double the amount that applicant is
permitted, and 2,182 square feet less than applicant proposes.
2. The hardship created is UNIQUE and is not shared by all properties, olike in the immediate
vicinity of this property and in this use district because
This lot is one-half of the size of a conforming lot in the R-40 district,
Further the prior owner contracted a one story residence, thustheavailable lot coverage is,extremely limited.
3. • The Variance .would .observe the spirit of the Ordinance and WOULD NOT. CHANGE THE
CHARACTER OF THE DISTRICT because
There are many residences in; the subject neighborhood which are improved
with swimming pools and single family residences,, thus the character
of the district will not be changed. Further the proposed pool and patio
is at grade therefore there will be no visual impact to surrounding
property owners.

I represent Mr. Patrick Kelly, the contract vendee of the subject property. As per the
ZBA meeting on April 22, 1999, and the recommendations of this Board, I have revised my
client's proposal to include a pool measuring 38 feet by 18 feet and a brick patio, at grade,
measuring 10 feet by 38 feet, Thus, the structures proposed now comprise only 1,064 square feet
of lot coverage, which is a significant reduction from my client's original proposal, The new
proposal requests a total lot coverage of 24.06% which is a reduction of 5.03% from the original
proposal. Enclosed herewith please find a copy of my clients revised survey depicting the new
sizes of the proposed pool and brick patio, as per your request.
As I informed you at the hearing, this matter is extremely time sensitive for my client,
therefore, I would greatly appreciate a determination at your earliest convenience. Thank you for

PROPERTY FACTS/DESCRIPTION: The subject property is known as Lot 44 on the Map of Harbor
Lights Estates, Section 2, with 100 ft. frontage along the north side of Harbor Lights Drive and a
depth of 200 feet. Existing is a two-story, one -family frame dwelling with a footprint (lot
coverage) area of 3,748 sq. ft. it is situated 36.7 feet from the front property line, 13.5 feet from
the west side line, 12.4 feet from the east side line, and contains a lot area of 20,000 sq. ft. In
the original application, a building permit was requested for a 20 ft. by 40 ft. in -ground swimming
pool structure at 50 feet from the bulkhead and 18.5 feet from the westerly side property line, and
a brick patio at approximately 45 feet from the bulkhead and 13.5 feet from the westerly side line.
The proposed lot coverage was requested at 29.03%, or 5,818 sq. ft.
BASIS OF APPLICATION: Building Inspector Notice of Disapproval dated February 26, 1999 citing
Article IIIA, Section 100-30A.3 for lot coverage, and Article XXIII, Section 100-239.4B for reduced
setback from bulkhead.
AREA VARIANCE RELIEF REQUESTED: Applicants request a Variance for the placement of an
inground swimming pool as follows:
1) Lot Coverage. The proposed lot coverage- with the original request was 29.03%, or
5,818 sq. ft. The lot coverage calculation was reduced by applicant, after discussions at the April
221 1999 hearing, from 29.03% (5818 sf.) to 24.06% (4812 sf.). An amended survey was
submitted April 23, 1999 confirming applicant's revisions.
2) Bulkhead Setback. The proposed setback for the swimming pool was revised for a
distance of 52 feet from the bulkhead at its closest point. A fence will surround the pool as
required by the.NYS Building Code., .
REASONS FOR BOARD ACTION: In considering this application, the Board finds that variances to
allow construction of a 18 ft. by 38 ft. swimming pool with a minimum setback from the bulkhead
of 50 feet, and to allow for construction of a 10 ft. by 38 ft. decking for a total lot coverage of
24.04%, or 4812 sq. ft., is the minimum necessary and adequate and at the same time will
preserve and protect the character of the neighborhood, and the health, safety, welfare of the
community.
1. Grant of the area variances will not be a detriment to nearby properties because the pool will

be located at grade level and conforms to the required side yard setbacks from adjoining
property owners. No evidence was presented to suggest that the minimum relief hereby
granted will produce an undesirable change in the character of the neighborhood. Many
residences in the neighborhood enjoy in -ground swimming pools.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than area variances, because the property is nonconforming in size
and there are no other locations on the property which would not require variances to
construct a swimming pool.
3. The variance granted for lot coverage of 24% is not substantial and represents a 16 percent
increase in the code required 20% maximum. The variance granted for the bulkhead at 52
feet is substantial and represents a 31% reduction in the code -required 75 foot setback.
4. The difficulty has been in part self-created and relates to the applicant's desire to enjoy a
swimming pool, and is in part due to the small size and shape of the lot.
5. The proposed variance will not have an adverse effect or impact on the
physical or environmental conditions in the neighborhood or district.
RESOLUTION/ACTION: On motion by Member Tortora, seconded by Chairman Goehringer, it was
RESOLVED, to GRANT the variance, as applied for, SUBJECT to the CONDITION that an
evergreen border be planted and maintained in good condition on the west side, for 28 feet in
width (the pool and patio area), for a minimum height of three feet.

only to lot coverage (ref: Building Inspector Disapproval dated February 26, 1999.
In the essence of advertising necessary variances at one time, for one hearing, we ask
that you contact the Building Inspector's Office at 765-1802, Attn. Ed Forrester for a review
under Zoning Section 100-239B as to whether or not other relief would be necessary —
possibly triggering another reason for a Notice of Disapproval.
If another variance is needed, please forward a new variance request to us, together
with an additional $200 filing fee ($600 total for variances) and a copy of that Notice of

I am in receipt of a letter from Ms. Kowalski, regarding the above. After discussing this
matter with Mr. Edward Forrester, it has been confirmed that in addition to the variance relief
stated on the Disapproval letter dated February 26, 1999, variance relief is also required pursuant
to section 100-239.4(B) of the Town Code. I therefore hereby request that the previously
submitted variance application be amended to include the relief under section 100-239.4(B), for
the reasons set forth below. Additionally, I have enclosed herewith a check in the amount of
$200.00 representing the additional filing fee for the relief herein requested.
Additional relief requested: Relief Under section 100-239.4(B)
Discussion of Standards: The relief requested herein is to permit the Applicant to construct a
swimming pool and small brick patio around the pool. Under the standards of your Town Code:
(1) There will be no undesirable change to the character to the neighborhood as many residences
in the Harbor Lights area are similarly improved with in ground swimming pools. Other parcels in
the general area are improved with substantial size dwellings pools and other accessory structures_.
The proposed pool and deck will be located at grade, thus there will be no detrimental visual
effect to the area at large; (2) given the existing location of the residence and the size and
configuration of the property and the location of the existing sanitary system, the Applicant can
not lawfully construct a pool at the subject property in any location, without a variance; (3) The
area variance is not substantial (75 feet to 50 feet) given the size of the property and its proximity
to the bulk -headed canal, but for the existing of the canal the application would not require any
setback relief from the side or rear yards; (4) The variance will not have any physical or
environmental conditions in the neighborhood as it will be located at grade behind the existing
residence, thus there will be no visual impact to the neighborhood, further, Applicant will install
drywells, as necessary to insure that there will be no overflow from the pool onto surrounding
properties; (5) The need for a variance is not a self created hardship. The residence was selected
by a prior owner in a conforming location, located as close as practicable to the front yard of the

property, maximizing the size of the rear yard, which is the location of the proposed pool, which
meets with all other dimensional setback requirements.

§ 58-1. providing notice of public hearings.
(HISTORY: Adopted by the Town Board of the Town of
Southold 12-27-1995. as L.L. No. 25-1995. Amendments
noted where applicable.]
§ 58-1. Providing notice of public hearings.
Whenever the Code calls for a public hearing, this .section
shall apply. Upon determining that an application is complete,
the board or commission reviewing the same shall fix a time
and place for a public hearing thereon. The board or commission
reviewing an application shall provide for the giving of notice:
A By causing a notice giving the time, date, place and
nature of the hearing to be published in the official
newspaper within the period prescribed by law.
B. By requiring rin the applicant to erect the sign provided by
the town, which shall be prominently displayed on the
premises facing each public or private street Which the
property involved in the application abuts, giving notice
of the application, the. nature of the approval sought
thereby and the time and place of the public hearing
thereon. The sign shall be set back not more than ten
(10) feet from the property line. The sign shall be
displayed for a period of not less than seven (7) days
immediately preceding the date of the public hearing.
The applicant or his/her agent shall file an affidavit that
s/he has complied with this provision.

Notice will be published in the next issue of the Suffolk Times newspaper, the Town's
official newspaper for 2/1999-2/2000.
Pursuant to Chapter 58 of the Southold Town Code (copy enclosed), formal notice of your
application and hearing must be mailed and shall include a map or sketch showing the new
location with the setbacks and use noted. Send this Notice, as soon as possible, with the
map to all owners of land (vacant or improved) surrounding yours, including land across
any street or right-of-way that borders your property. Use the current addresses shown on
the assessment rolls maintained by the Town Assessors' Office (765-1937) or the County
