Box 1179 Southold, New York 11971 ZBA Fax (516) 765-9064 Telephone (516) 765-1809 PROPERTY FACTS/ DESCRIPTION: The subject property is 67.34 feet wide (along South Lane) and 178.94 feet deep, for a total area of approximately consists of 12,050 sq. ft. The July 28, 1995 survey prepared by Peconic Surveyors, P.C. shows that the subject premises is improved with a two-story, single-family dwelling and garage. Also shown on the survey along the easterly property line are: (a) a 10' wide right-of-way to the beach, and (b) beyond the southerly property line of the applicant's property are wood bulkheads extending to the high water mark of Gardiners Bay. BASIS OF APPEAL: Building Inspector's July 16, 1998 Notice of Disapproval under Section 100-244B and Section 100-239.48 with respect to the proposed setbacks of the deck addition to dwelling. AREA VARIANCE RELIEF REQUESTED BY APPLICANT: Applicant is requesting a variance to locate a proposed 12' by 22' wide unroofed deck addition with a setback at approximately 28 feet from the rear property line, instead of the code required 35 feet, and at approximately 40 feet from the bulkhead, instead of the code required 75 feet. (Note: The bulkhead is shown to be beyond the rear property line towards Gardiners Bay). REASONS/ FINDINGS FOR ACTION DESCRIBED BELOW: 1. Grant of the two area variances will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties because the deck addition is modest in size and similar in location in proximity to the rear yard property lines, bulkhead and beach as other decks in the neighborhood. 2. The benefit sought by the applicant cannot be achieved by som a methold, feasible for applicant to pursue, other than an area variance. The lot is narrow and if the deck were located in a side yard, it would be nonconforming with respect to setback Page 2 — Appl. The rear yard variance is not substantial and represents a decrease of seven feet from the code required 35 ft. setback. The variance from the bulkhead is substantial. However, the applicant's residence is currently setback 52 feet from the bulkhead, and the variance would decrease the setback by 12 feet, leaving a distance of 40 feet to the bulkhead and approximately 90 feet to the mean high water mark. 4. The proposed variances will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because the deck is located at a sufficient distance from the rear yard property line and bulkhead to protect the integrity of the bay and adjacent beach area. In considering this application, the Board finds that the relief requested is the minimum necessary and adequate and at the same time will preserve and protect the character of the neighborhood and the health, safety and welfare of the community. An undesirable change will NOT be produced in the character of the , - neighborhood or a detriment to nearby properties, if granted BECAUSE: ► The deck will be low and unobtrusive, and will require no railing. It will not catch the eye of anyone looking along the back yards. ► It is not be visible from the patio of the neighbors to the east, due to plantings on their property. ► The house to the west extends beyond the farthest extent of the deck. ► At its closest point, the deck will be located approximately 28 feet from the rear property line. This causes no detriment to nearby property because the rear of the property backs onto a bank sloping approximately 10 feet down to the bulkhead behind the Old Orchard Homeowners' Association beach. The back yard of my house is not visible from the beach, which at least 10 feet lower than level of my back yard. ► Other houses and decks in the area, for example, 680 South Lane, are located closer to the bulkhead and rear property line than the deck I plan to build. The house at 180 South Lane has a deck which extends out over the beach from back yard. Several houses have deck seating areas located at the top of stairs leading down the bank to the beach. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance BECAUSE: The deck is intended simply to provide a level surface upon which to locate a table and chairs in the back yard, with a view of the bay. The lot is quite narrow. - Locating the deck to the side of the house would put it very close to neighboring properties and to the neighborhood right-of-way to the beach. This would make for less privacy for the neighbors as well as for myself. The door is located at the rear of the house. The location of trees on the property would make it impossible to build a simple deck at the side. Page g Ken Zimme an 3. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district BECAUSE: This will be a very a low, wooden deck, built to have as little environmental or physical impact consistent with its intended use. Please send the notices by 9/2 if possible. Owners of vacant property and other properties, surrounding your project, along all sides and abutting the boundaries of the subject ;lot are those as listed on the assessment rolls. AREA VARIANCE RELIEF REQUESTED BY APPLICANT: Applicant is requesting a variance to locate a proposed 12' by 22' wide unroofed deck addition with a setback at approximately 28 feet from the rear property line, instead of the code required 35 feet, and at approximately 40 feet from the bulkhead, instead of the code required 75 feet. (Note: The bulkhead is shown to be beyond the rear property line towards Gardiners Bay). REASONS/ FINDINGS FOR ACTION DESCRIBED BELOW: 1. Grant of the two area variances will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties because the deck addition is modest in size and similar in location in proximity to the rear yard property lines, bulkhead and beach as other decks in the neighborhood. 2. The benefit sought by the applicant cannot be achieved by som a methold, feasible for applicant to pursue, other than an area variance. The lot is narrow and if the deck were located in a side yard, it would be nonconforming with respect to setback Page 2 — Appl. The rear yard variance is not substantial and represents a decrease of seven feet from the code required 35 ft. setback. The variance from the bulkhead is substantial. However, the applicant's residence is currently setback 52 feet from the bulkhead, and the variance would decrease the setback by 12 feet, leaving a distance of 40 feet to the bulkhead and approximately 90 feet to the mean high water mark. 4. The proposed variances will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because the deck is located at a sufficient distance from the rear yard property line and bulkhead to protect the integrity of the bay and adjacent beach area. In considering this application, the Board finds that the relief requested is the minimum necessary and adequate and at the same time will preserve and protect the character of the neighborhood and the health, safety and welfare of the community.
