No. 4595 — WILLIAM and MILLICENT TUFANO 1000-122-9-9.6 STREET & LOCALITY: 2482 Camp Mineola Road, Mattituck DATE OF PUBLIC HEARING: August 13, 1998 PROPERTY FACTS/ DESCRIPTION: The above -referenced property was approved January 30, 1970 by the Southold Town Planning Board on the Subdivision Map of Peter Kreh and is situated at the westerly end of a private right-of-way, which extends from Camp Mineola Road, Mattituck. The May 15, 1998 survey map prepared by Young & Young shows that the subject premises contains a total area of 41,455 sq. ft. The property is improved with a single-family, two-story dwelling structure constructed years ago with a nonconforming setback of 18.9 feet at its closest point to the southerly wood bulkhead and 11.5 feet from the easterly side yard. Applicant proposes to remove the existing house and an accessory "frame shed" and to erect a new house and an accessory garage. The distance from the new dwelling location to the closest edge of the right-of-way is noted to be at 57+- feet, and an accessory garage at 11+- feet from the westerly property line. BASIS OF APPEAL: Building Inspector's July 15, 1998 Notice of Disapproval for "a new single-family dwelling" disapproved on the following grounds: "All buildings located on lots upon which a bulkhead exists and which are adjacent to tidal water bodies, other than sounds, shall be set back not less than seventy-five (751 from the bulkhead, pursuant to Article )0III, Section 100-239.4B." AREA VARIANCE RELIEF REQUESTED BY APPLICANTS: The request made by applicants is to locate a new two-story dwelling northerly of Page 2 - August 24, 1998 Appl. No. 4595 - W. Tufano 1000-122-9-9.6 Southold Town Board of Appeals the former dwelling location and 50 feet from the bulkhead. The side yard setbacks will conform with the current Code at a minimum of 15 feet and minimum combined side yards at 35 feet. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Applicants wish to locate their new house far enough back from the bulkhead to be out of the flood zone, but near enough to the bulkhead to be able to continue to enjoy the kind of views enjoyed from the existing house. Zoning Code Section 239.4(B)(1) provides an exception to the 75 -foot setback requirement for buildings which are to be built landward of existing buildings. Although the existing house will be demolished, the new house will be erected landward of its rear foundation wall and the Board takes note of this exception in determining that granting of the requested variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The setback from the bulkhead will be increased from 19 feet to 50 feet, which will increase the openness of the area and improve neighbors' views. In view of the authorization previously granted by the Town Trustees, granting of the variance is not expected to have an adverse effect or impact on the physical or environmental conditions in the aeighborhood or district. The Board finds the grant of the requested variance is the minimum necessary and adequate to enable applicants to enjoy the benefit of a new dwelling that preserves the quality of their views, while protecting the character of the neighborhood, and the health, safety, welfare of the community. CHAIRMAN GOEHRINGER: I have a copy of the survey indicating the proposed placement of the new dwelling dated the most recent date is May 15, 1998 and I have a copy of the Suffolk County Tax Map indicating this and surrounding properties in the area. Mr. Tufano what would you like to tell us? I've known this existing house for years. I'm from Mattituck. This is the house that Mr. Allan owned, wasn't it? MR. TUFANO: Correct. CHAIRMAN GOEHRINGER: What would you like to tell us? I noticed that you have pushed the house back from 18.9 feet to approximately 50 feet from the bulkhead and I have noticed that on the survey it says, that you're ( ) construction at 15 feet on the easterly property line and 35 feet on the other line, on the westerly property line and what would you say the average setback of the houses in the area are from the bulkhead? MR. TUFANO: They vary. CHAIRMAN GOEHRINGER: They vary. MR. TUFANO: Some of them are 10 feet, some of them are 50 feet and some of them say 75 feet. But, the majority of them are around 10 to 20 feet from the bulkhead. CHAIRMAN GOEHRINGER: Alright. I guess we'll start with Mr. Dinizio. Any questions of Mr. Tufano? MEMBER DINIZIO: No. CHAIRMAN GOEHRINGER: Ms. Collins? MEMBER COLLINS: Well, as to the setback, " you've selected the spot where you want to put your house, and it's 50 feet back from the bulkhead. TUFANO: Well this is a waterfront parcel. I don't know if you took the a - MEMBER COLLINS: I, I - MR. TUFANO: Did you visit the site? MEMBER COLLINS: I went to your property but I did not go through the gate and walk down because I could see pretty well what I needed to see. MR. TUFANO: Well, fair enough. I wish you had taken a walk to the bulkhead. The existing house that's been there, we've been in, we're enjoying the view and if you buy a piece of property and you have a view you would like to protect it. Now, the reason why we'd like to stay as close to the existing structure as possible, but, it would be to our advantage to go back 50 feet because that takes us out of the V Zone and if I have a choice I would like to stay 50 feet out of the V Zone and still enjoy the view. MEMBER COLLINS: OK, thank you. CHAIRMAN GOEHRINGER: Mrs. Tortora? MEMBER TORTORA: That was my question. CHAIRMAN GOEHRINGER: Alright, and Mr. Horning? MEMBER HORNING: I'm all set for the time being.
