improved with a one-story

residence as shown on the October
17, 1973 survey submitted
under
this application.
BASIS OF APPEAL: Building Inspector's Action of Disapproval dated

of Disapproval by the Building Inspector,
whereby
applicant
applied
for a permit to construct a fence 6 ft. in
height in
the front
yard,
and the application was disapproved on the
following
grounds:
"...
When located in front yard of residential
zones, a
fence shall not
exceed four feet in height. Article XXIII,
100-231...."
AREA VARIANCE RELIEF REQUESTED BY APPLICANT: To locate a
six ft. high fence along or within the southerly front yard portion
of the subject property. This property line does not extend along a
Town Street, however, there is a private "right-of-way" 15 feet in
width on the survey map. The length of the applicant -owner's fence
is proposed at approximately 93 feet extending directly to the rear
(easterly) property line.

BOARD REASONS FOR ACTION, DESCRIBED BELOW:
A 15 -foot right-of-way to a community beach abuts the
applicant's property to the South. For privacy, applicant wishes to
erect a 6 -foot fence along the Easterly two-thirds of the Southerly
lot line. Because the right-of-way constitutes a street, the
proposed fence is subject to the 4 -foot height limit on front -yard
fences.
The Board accepts applicant's contention that adequate privacy
on the south and east sides of the house requires a fence of more

than the allowable four feet; thus, an area variance is necessary if
the applicant is to achieve the desired privacy. Because the fence
will be erected along what is in fact the side of the property, it
will have no significant visual impact on the neighborhood's
appearance nor on the character of the neighborhood, and there is
no evidence of any detriment to nearby properties. There is no
evidence that the proposed fence will have any adverse effect on
physical or environmental conditions in the area.
The Board concludes that a variance allowing erection of the
fence essentially as proposed by applicant is the minimum relief
necessary and adequate to achieve the benefit sought while at the
same time preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.
RESOLUTION/ACTION: On motion by Member Collins,
seconded by Chairman Goehringer, it was
RESOLVED, to GRANT the relief as applied for, with the following
CONDITION: The first eight feet of the fence closest to Osprey
Nest Road shall be no more than four feet high.

We have a great community here. largely due to the voluntary
cooperation of all the residents to a set of guidelines the Board of
Directors has adopted over the years. Compliance has been outstanding,
and a copy of the Rules and Regulations is furnished for your review.
Rules and Regulations of Cleaves Point Property Ovners Association
1. The speed limit over our roads is 20 MPH! However, please be aware
of many young families now in the community, with many school-age
children. Please adhere to the 20 MPH as a maximum, not a mi.nimum-
speed. By observing this speed limit, we hope to avoid the imposition
of speed bumps.
2. Osprey Nest Road is ONE WAY, due to its narrowness and sharp curves.
Beach users should park on the right side.
3. The beach area is for the use of CPPOA members in•good standing and
their guests. Swimming is at one's own risk.
04 -Cars are not allowed in the beach area except for the following
reasons:
a) Loading/unloading boat equipment
b) emergency use
If extended parking is necessary, Osprey Nest Road should be used.
5. Please remove any waste from the beach.
6. For the safety of swimmers, use of water craft (board sailers, jet
skis, etc.) must be confined to the western end of the beach near the
inlet. Southold Town regulations require that full speed operation of
water craft be 500 feet or more off the beach.
. 7 ,) Removal or pruning of bushes or grasses in the beach area may only
Abe done with the written permission of the Board of Directors. The
natural appearance of the area should be preserved.
0Dogs should be leashed or under control of their owners at all
times. Disposal of dog waste is the responsibility of the owner. Dog
waste is NOT to be left on the roadside. The town pound will be asked
to pick up stray dogs, so please keep control of all dogs.
Your cooperation in adhering to these rules will maintain the special
environment that attracted you here. Thank you!

Under the requirements of Chapter 58 of Town Law, we are

Please include a copy of a map or sketch describing the setbacks and
building(s) with your mailings and your telephone number. These mailings
must be postmarked by 3/11 if possible, and be forwarded to all owners, as
listed on the Town Assessment records, of vacant or improved lands across
streets and along all sides abutting the boundaries of the subject lot.
Please also post the enclosed Poster in the location described by
Ch. 58 of the Code (that is, within ten (10) feet of the front property line
facing the street, for a period of not less than seven (7) days) . The sign
may not be posted later than 3/15. If the sign is torn or removed due to
adverse weather conditions, let us know and we will provide another.

§58-1. Providing notice of public hearings.
(HISTORY: Adopted by the Town Board of the Town of
Southold 12-27-1995 as L.L. No. 25-1995. Amendments
noted where applicable.]
§ 58-1. Providing notice of public hearings.
Whenever the Code calls for a public hearing, this section
shall apply. Upon determining that an application is complete,
the board or commission reviewing the same shall fix a time
and place for a public hearing thereon. The board or commission
reviewing an application shall provide for the giving of notice:
A. By causing a notice giving the, time, date, place and
nature of the hearing to be. published in the official
newspaper within the period prescribed by law.
B.- By requiring the applicant to ' erect the sign provided by
the town, which shall be prominently displayed on the
premises facing each public or private street which the
property involved in the application abuts, giving notice
of the application, the nature of the approval sought
thereby and the time and place of the public hearing
thereon. The sign shall be set back not more than ten
(10) ,'feet from. the property line. The sign shall be
displayed for a period of not less than seven (7) days
immediately preceding the date of the public hearing.
The applicant or his/her agent shall file an affidavit that
s/he has complied with this provision.
