Lot: Being and intended to be the same premises granted to the party

This Deed is an absolute conveyance of title, in effect as
well as form, and is not intended as a mortgage, trust
conveyance or security of any kind. The consideration
therefor is the full release of the party of the first part
from all debts, bonds, notes, obligations, costs and charges
heretofore subsisting on account and by the terms of that
certain mortgage held by the party of the second part in
the original principal amount of $132,000. 00 dated December 3,
1987, recorded December 11 , 1987 , in Liber 13638, mp 295. This
Deed is given in lieu of foreclosure of said mortgage.

TOGETHER with all right, title and interest, if any, of the parry of the first part in and to any streets and
roads abutting the above described premises to the anter lines thereof; TOGETHER with the appurtenances and
all the estate and rights of the parry of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto rhe parry of the second part, the heirs or successors and assigns of the party of the
second part forever.
AND the party of the fust part covenants chat the parry of the first put has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for chis conveyance and will hold the right to receive such consideration as a
trust fund to be applied fust for the purpose of paying the cost of the improvement and will apply the same first to
the payment of the cost of the improvement before using any part of the coral of the same for any other purpose.
The word "party" shall be construed as if it read "parties' whenever the sense of this indenture so requires.

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
ly ➢fi7ing and being U at Pine Neck, near Southold, in the Town of Southold. County of
Suffolk and State of New York, shown and designated as Lot No. 33 on a certain map
entitled, "Map of SQuthw ood", and filed in the Office of the Clerk of the County of
Suffolk on Novem ber'24, 1953 as Map No. 2141, which said lot is bounded and described
according to said map as follows:
BEGINNING at a point on the southerly side of Pine Neck Road, where the same is
intersected by the easterly end of a curve having a radius of 25.00 feet and a length
of 34.54 feet which curve connects the southerly side ofPine Neck Road with the
easterly side of Park Way;
RUNNING THENCE North 85 degrees 55 minutes 20 seconds East along the southerly side
of Pine Neck Road 81.52 feet;
THENCE South 4 degrees 04 minutes 40 seconds East 140.00 feet;
THENCE South 85 degrees 55 minutes 20 seconds West 129.01 feet to the easterly
side of Park Way;
THENCE North 6 degrees 45 minutes 50 seconds East along the easterly side of Park
Way 121.87 feet to the southerly side of a curve having a radius of 25 feet first above
mentioned;
THENCE in a general easterly direction along the arc of said curve a distance of 34.54
feet to the southerly side of Pine Neck Road, at the point or place of BEGINNING.
