No. 4591 — ALFONZO ROMANO PARCEL 1000-58-2-2 STREET & LOCALITY: 1380 Leeton Drive, Southold, NY DATE OF PUBLIC HEARING: August 13, 1998 PROPERTY FACTS/ DESCRIPTION: The above -referenced property is situated along the northerly side of Leeton Drive, Southold. The March 24, 1998 survey map shows that the subject premises contains a total area of 8,662.03 sq. ft. and is improved with a one-story, one -family frame house on piles with porch (deck with roof), small shed. The existing dwelling is shown to be 72 feet from the front property line along Leeton Drive from the existing deck addition. The total lot size of given at 8,662 for the total deeded lot, and 6,262 sq. ft. of the land above the V-8 Zone line. The lot coverage is proposed at 2,203 total for all buildings, or 25.43% of the total lot, including approximately 2400 sq. ft. of land in the V-8 Flood Zone area. BASIS OF APPEAL: Building Inspector's June 15, 1998 Action of Disapproval which reads as follows: "...Under Article IIIA, Section 100-30A.3 of the Bulk and Parking Schedule in the R-40 Zone, the lot size of 8,662 sq. ft. has an allowable lot coverage of 20%, or 1,735 sq. ft. Proposed construction will have 1,980 sq. ft. of lot coverage, of 22.9+ - percent...." AREA VARIANCE RELIEF REQUESTED BY APPLICANT: The request made by applicant is to construct an additional building area of 746 sq. ft. The new construction will exceed the 20% code limitation for lot coverage, amounting to a total of 2,203 sq. ft. for all construction, for 25.43%. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Page 2 - August 24, 1998 Appl. No. 4591 - A. Romano 1000-58-2-2 Southold Town Board of Appeals (1) The grant of alternative relief will not produce an undesirable change in character of neighborhood or a detriment to nearby properties because there are houses of similar size within the immediate vicinity. (2) The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance because to achieve additional floor area, the applicant would have to disturb the area under the existing building which is closer to the V-8 Flood Zone. (3) The requested area variance is substantial exceeding 5.43 percent of the maximum 20% allowable lot coverage. (4) The grant of alternative relief will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because the construction will be built in an area that is landward of the existing structure. (5) The situation has been self-created because the applicant has an existing house and could add a second floor without the need of a variance. In considering this application, the Board deems this action to be the minimum necessary and adequate, and at the same time preserves and protects the character of the neighborhood, and the health, safety, welfare of the community. RESOLUTION/ACTION: On motion by Member Dinizio, seconded by Member Collins, it was RESOLVED, to DENY the 25.4% requested, and to GRANT ALTERNATIVE RELIEF for a total lot coverage of 23.5% (or 2,094 sq. ft. whichever is greater).
