Herbert Scannell III and Sarah Reetz PARCEL 1000-49-1-16 AND 17 (merged as a single lot and lot area) STREET & LOCALITY: 955 Cove Circle, Greenport, NY DATE OF PUBLIC HEARING: February 26, 1998 FINDINGS OF FACT PROPERTY FACTS/ DESCRIPTION: The above -identified property is located on the easterly side of a private north -south right-of-way, which extends off an east -west right-of-way referred to as "Clark Street" from Sixth Avenue, Greenport. This property contains a total area of combined lots 16 and 17 for a total of 39,579+- sq. ft. and is located in the R-40 Low -Density Residential Zone District. The survey map updated February 5, 1998 submitted under this application shows the new concrete foundation location, right-of-way lines, and applicant's property lines. The March 1, 1997 survey prepared by Peconic Surveyors, P.C. confirms the prior dwelling location at 14.2 feet at its closest point to the westerly front property line and an accessory frame shed. BASIS OF APPEAL: February 2, 1998 Building Inspector Notice of Disapproval and Stop Work Order regarding pending Building Permit No. 24471Z, issued with regard to the reconstruction and replacement of single-family dwelling with nonconforming setbacks, Article XXIV, Section 100-242 (ref. setbacks under Section 100-244B) of the Zoning Code. AREA VARIANCE RELIEF REQUESTED BY APPLICANT: The request made by applicant is for approval of the "as built" location of a concrete foundation, for a new one -family dwelling, all as shown on the February 5, 1998 survey prepared by Peconic Surveyors, P.C. with setbacks at: a) 12 feet from the front 2.6 ft. by 9 ft. front step area to the westerly front property line; b) a minimum of 14 feet between the most northwest corner of the foundation and the front property line; c) a minimum of 48.4 ft. between the foundation and the rear property line; Page 2 - March 3, 1998 Appl. #4546 (Scannell) 1000-49-1-16 & 17 Southold Town Board of Appeals CODE PROVISION: Article XXII, Sections 100-242A and B read as follows: 100-242. Nonconforming building(s) with conforming uses. A. Nothing in this Article shall be deemed to prevent the remodeling, reconstruction or enlargement of a nonconforming building containing a conforming use, provided that such action does not create any new nonconformance or increase the degree of nonconformance with regard to the regulations pertaining to such buildings. B. Reconstruction of a damaged building. (1) A nonconforming building containing a conforming use which has been damaged by fire or other causes to the extent of more than fifty percent (50%) of its fair value shall not be repaired or rebuilt unless such building is made substantially to conform to the height and yard requirements of the Bulk Schedule. (2) Application for a permit to build or restore the damaged portion of any building damaged or destroyed as set forth in Subsection B(1) above shall be filed within one (1) year of the date of such damage and shall be accompanied by plans for recon- struction which, as to such portion, shall comply with the requirements set forth above. If such permit is issued, it shall lapse one (1) year thereafter unless reconstruction in accordance with the approved plans has been initiated. REASONS FOR BOARD ACTION. DESCRIBED BELOW: (1) The granting of the area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties because a nonconforming dwelling had existed and this is reconstruction. (2) The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance because of the shape and narrowness of the lot. (3) The requested area variance is not substantial. (4) The proposed variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because the building was existing for more than 50 years and this is reconstruction of same. In considering this application, the Board deems this action to be the minimum necessary and adequate, and at the same time preserves and protects the character of the neighborhood, and the health, safety, welfare of the community. Before issuance of any future building permit(s) and before issuance of any Certificates of Occupancy for parcels, including the applicant's parcel, having access along this right-of-way must comply with the requirements of New York Town Law, Section 280a for appropriate fire access as further required below. 2. The specifications for improvement along this right-of-way shall be improved as follows as a minimum for appropriate fire access at this time: a) the full length of the right-of-way extending from Sixth Street shall be graded and cleared to a full width; b) the full length of the right-of-way extending from Sixth Street shall be improved with 2" stone blend to a width of 10 ft. to 12 ft. c) the right-of-way shall be maintained in good condition at all times for emergency and fire vehicles. 3. Before issuance of any Certificate of Occupancy for parcels, written acceptance must be received by the ZBA Chairman after an inspection by the Chairman with the Building Inspector or another ZBA member. Dear Chairman Goehringer and Board Members, I have been retained by Mrs. Jean Burden regarding the application of Mr. Scannell and Ms. Reetz. Mrs. Burden was notified of the application as she owns land directly to the west of the subject parcel. Mrs. Burden's land is located at County Tax Map # 1000 - 49.00 - 01.00 - 02.00. The purpose ofthis letter is twofold: First to express Mrs. Burden's support for the Application; Second to provide the Board with a point of clarification regarding the Application. As a point of clarification: In Paragraph 2 of the application Mr. Brown states that: `T ivate Road is of no real value at (sic) it extends between two lots and does not lead anywhere". In Paragraph 4 of the supplemental application for "Area Variances Only", Mr. Brown again asserts that "... the private road as it extends between the two lots does not lead anywhere". This is not correct. The road does indeed lead somewhere - it leads to Mrs. Burden's lot. In fact it provides the only access to Mrs. Burden's lot. Attached is a copy of the Tax Map for your benefit. It is quite apparent that the only access to Lot "C" is over the private road. Mrs. Burden is concerned with preserving her rights in the private road The road is of great value to her and she wants to be on the record in stating that her support for granting the variance in no way should be viewed or construed as relinquishing, abandoning or abrogating her rights in the road. In addition, please note that Mrs. Burden's lot is a separate piece of property from #1000 - 49.00 - 01.00 - 03.00 which Mrs Burden owns jointly with her husband. This fact is not reflected on the survey which was submitted with the application and probably led to Mr. Brown's confusion regarding the usefulness of the road..
