No. 4607 — JON SCHRIBER AND JANE ROSS PARCEL ID #: 1000-117-3-10 STREET & LOCALITY: 1295 Old Harbor Road, New Suffolk DATE OF PUBLIC HEARING: September 24, 1998 FINDINGS OF FACT PROPERTY FACTS/ DESCRIPTION: The subject property is located on the northerly side of Old Harbor Road, Suffolk. The August 19, 1997 survey shows a lot size of 19,476 sq. ft. (including land underwater) and the following buildings: 2-1/2 story frame single- family dwelling and accessory storage shed. Also shown is the subject raised brick patio with timber border. BASIS OF APPEAL: Building Inspector's July 15, 1998 Notice of Disapproval with respect to section 100-244B and a setback of less than the required 35 feet. AREA VARIANCE RELIEF REOUESTED BY APPLICANT: The request made by applicant is for approval of the "as built" raised, unroofed patio (addition) at 14.5+- feet from the southerly front property line, along Old Harbor Road, as more particularly shown on the August 19, 1997 survey prepared by Stanley J. Isaksen, Jr. REASONS FOR BOARD ACTION, DESCRIBED BELOW: (1) The granting of the area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties because the "as built" patio is not more than seven (7) inches above grade at any point. (2) The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance. The patio is raised to insure water drainage is away from the house and for aesthetic reasons. (3) The requested area variance is not substantial. (4) The variance will not have an adverse effect or impact on the physical or Page 2 — September 30, 1998 Appl. Your office has the approval. November 4, 1998. There is a misunderstanding. Your first turn down was for building a structure (brick patio) too close to the town road because it was about 71-2" above the earth and grass grade (see photos). Of course the patio could have been at grade level but it was raised to keep muddy water and ice off the surface. No one knew the code restriction applying to waterfront locations. In your first turn down there was no mention of the East side retaining wall or railing because they were already approved in the Home C of O. Before the house was purchased, the engineer and architects noted water in the ground floor and therefore the owners put in the retaining walls and dry wells and a concrete lip on the foundation to prevent the soil and water from getting into the home. (See photo) The code railing is set in concrete for safety and the bricks were cut around the treated posts to fit. I also question why your inspector in the attached inspection did not mention the railing or the obvious objective of controlling surface water and erosion down a former steep hill?. The 2 to 4 foot height requires a railing. Please review this and give the patient owners a C of O for their patio. The Zoning Board asked if any additional structures were planned on the terrace. No. I respectfully suggest you might see the finished home with a new evergreen hedge hiding the patio and home from the road. I would be pleased to show it to you. (734 4182) These new owners have improved the environment with sea side plants and grass, landscaping, provided jobs for local professionals, renovated an older house grandfathered before your code which is now up to current code, and it cost them $1,250 for special surveys, blue prints, engineering inspections and then the appeal ordered by your department for things the builder and architects had anticipated and planned. Our problem: the brick terrace is not flush with the lawn, that is, a lawn mower couldn't move from grass to brick. It is raised one step, about 7" +/- and therefore is called a structure and violates Article XXIV 100- 2446. The architect, the builder, the landscaper and the owners did not know of this rather obscure rule applying to waterfront homes with limited land. The terrace was raised to insure water drainage (no winter ice or muddy water) and for esthetics, one step reasons for landscaping. There was no other location suitable for a first floor terrace (please see the survey). We ask you to approve it because: 1. An evergreen hedge is planted completely hiding the bricks from the road. 2. The terrace enhances the quality of life and value, of the home and thereby improves the neighborhood, 3. The terrace in no way affects the views from the Yacht Club across the street, the water to the East, the empty plot to the West or the shared driveway to 3 homes because the owners planted a tall evergreen hedge completely hiding the terrace from the road. 4. It in no way affects the area near the water where the owners have invested money for sea side grasses and plants to stabilize the fragile waterfront environment, costly improvements that benefit the town. If you wish to see the terrace, you won't from the street. It is located at the North East corner of Old Harbor directly across from the Yacht Club.
