FINDINGS OF FACT
PROPERTY FACTS/ DESCRIPTION:
The subject property is located along the westerly side of Wunneweta
Road, at Nassau Point Club Properties, Cutchogue. The parcel
consists of a total lot area of 19,274 sq. ft. to tie lines along
high water. The September 29, 1989 survey submitted by applicant
shows an existing single-family dwelling located at 15 feet from the
front property line and 15+- feet from the southerly side property
line, at the closest points. To the west is the highwater area,
bulkheaded in part. Timber walls and blacktop areas exist at the
premises in an approximate northwest location.
RELIEF REQUESTED:
Applicant is requesting a variance from the bulkhead setback
provisions for a proposed 20' x 37' inground pool with an extended
deck area at the rear of the dwelling. The Landscape Design Plan
and survey sketch shows the setback proposed at 33 feet at its
closest point from the bulkhead and at 48 feet from the most
southerly point (bighwater mark) along Wunneweta Pond.

REASONS FOR BOARD ACTION:
In considering this application, the Board finds that a variance to
allow construction of the proposed pool and deck with a minimum
setback from the bulkhead of 38 feet is the minimum necessary and
adequate and at the same time will preserve and protect the

character of the neighborhood, and the health, safety and welfare of
the community.
1. Grant of an area variance will not produce an undesirable change
in the character of the neighborhood or a detriment to nearby
properties. The applicant has provided a landscape plan to address
neighbor's concerns that should provide suitable buffering. No
other impacts are anticipated.
2. The benefit sought by the applicant cannot be achieved by some
method, feasible for the applicant to pursue, other than an area
variance because the property is triangular-shaped and no other
sites are available that are conforming.
3. The variance granted is substantial and represents a
reduction in the code required 75 ft. minimum setback.
4. The difficulty has been self-created and relates to the
applicant's desire to build a pool and deck.
5. The proposed variance will not have an adverse effect or impact
on the physical or environmental conditions in the neighborhood or
district because the neighborhood properties are wooded and the
applicant has agreed to condition approval upon a landscaping plan
that will help buffer the pool from adjacent properties.
RESOLUTION/ACTION:
On motion by Member Collins, seconded by Member Dinizio, it was
RESOLVED, to DENY the 33 -ft. setback as requested, and TO
GRANT THE FOLLOWING ALTERNATIVE SETBACK RELIEF:
1. Pool at its closest point to be a minimum of 38 feet from the
bulkhead and a minimum of 48 feet to the highwater line.
2. The deck shall be cut back to be in line with the existing deck
and approximately 45 feet from highwater line.
3. Applicant shall provide landscaping pursuant to a landscaping
plan, similar to the plan submitted June 17, 1998.

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town
Law and the Code of the Town of Southold, the following application will
be held for public hearing by the SOUTHOLD TOWN BOARD OF
APPEALS, at the Southold Town Hall, 53095 Main Road, Southold, New
York 11971, on THURSDAY, JUNE 11, 1998 at the time noted below (or
as soon thereafter as possible):
6:05 p.m. Appl. No. 4568 - DOMINICK SEGRETE. This is a
variance request under the Zoning Code, Article XXII, Section
100-239.4B, based upon the Building Inspector's April 9, 1998 Notice of
Disapproval, disapproving a building permit application for an inground
pool and deck addition due to its proposed location within 75 feet from
the bulkhead, concrete wall, rip rap or similar structure, at 4000
Wunneweta Road, Nassau Point Club Properties, Cutchogue, NY;
1000-111-14-22.1.
The Board of Appeals will at said time and place hear any and all
persons or representatives desiring to be heard in the above applications
or desiring to submit written statements before the end of each hearing.
The hearing will not start earlier than designated. - The file is
available for review during regular Town Hall business hours (8-4

Dear Ladies and Gentlemen of The Board of Appeals:
This letter is being submitted in anticipation of the hearing, on Thursday, June 11
Of Appeal No. 4568 — Dominick Segrete. I spoke with Mrs. Segrete on Monday, June 8,
on the phone; at which time I told her of my concerns associated with the swimming pool
being planned on the Segrete property. I am acting on behalf of my Father, Alvin
Goldhush, the owner of 1800 Little Peconic Bay Road, Nassau Point, Cutchogue, which
immediately adjoins and overlooks the Segrete property; our house is very close to the
area for which the pool and deck are proposed.
Unfortunately my Father lies near death in a hospital bed in our living room, under
Hospice and round-the-clock care, and he cannot speak for himself. This brings me to
my -first concems regarding the proposed construction — that of noise from heavy earth-
moving equipment, bulldozers, concrete mixers, and the annoyance of saws and
hammering that would obviously be involved. I am doing everything I can to make my
Father's final days as comfortable as possible; such obnoxious noises within a few
hundred feet from his bed would be unacceptable at this time, and would be severely
stressful for him. I ask that the Board request such construction be delayed a reasonable
amount of time, until Alvin Goldhush has passed away or no longer resides
here. I have been informed by his physician, Dr. Micah Kaplan, that this could be days or
at most weeks.
A second issue is that of parties and late night noise which have occasionally been a
problem over the years, since the sounds of voices and cars carries easily up the hill the
short distance to our house. I asked Mrs. Segrete if it was possible to put a reasonable
constraint on nightime noise; while she declined to make any promises, she did point out
that her children are no longer small and that there would not be any screaming, etc. I
am more concerned with adult parties, music, cars coming and going, etc. lasting into
the early morning hours. This is a very quiet area, and the possibility of such outdoor
noise worries me.
I do not want to deny the Segrete family the enjoyment of their property, nor do I wish
to be a disagreeable neighbor, but rather make my concems known to them and believe
that they and their family will behave accordingly in future.
I appreciate this opportunity to voice my concerns to the Board, and, particularly with
regard to my Father's situation, I trust that the Board in its wisdom will take these
comments into serious consideration when coming to a decision on the application.

§58-1. Providing notice of public hearings.
[HISTORY: Adopted by the Town Board of the Town of.
Southold 12-27-1995 as L.L. No. 25-1995. Amendments
noted where applicable.].
§ 58-1. Providing notice of public hearings.
Whenever the Code calls for a public' hearing, this section
shall apply. Upon determining that an application is complete,
the board or commission reviewing the same shall fix a time
and place for a public`hearing thereon. The board or commission
reviewing an application shall provide for the giving of notice:
A. By causing .a notice giving the time, date, place and
nature of the hearing to be published in the official
newspaper within the period prescribed by law.
B. By requiring the applicant to erect the sign provided by
the town, which shall be prominently displayed on the
premises facing each public or private street which the
property involved in the application abuts, giving notice
of the application, the nature of the approval sought
thereby and the time and place of the public hearing
thereon. The sign shall be set back not more than ten
(10) feet from the property line. The sign shall be
displayed for a period of net less than seven (') days,
immediately preceding the date of the public hearing.
The applicant or his/her agent shall file an affidavit that
s/he has complied with this provision.

of record of every property which abuts and every

Dear Sir or Madam:
For your records, please find enclosed a copy of the Legal Notice
describing the time, date and place of the public hearing regarding your
application. (Our department will arrange for publication in the official
newspaper: L.I. Traveler, Southold.)
Town Code Chapter 58, requires that the applicant send "NOTICE
GIVING THE TIME, DATE, PLACE AND NATURE OF THE HEARING." Please
send a copy of a map showing the proposed project area, together with a
cover letter with your name and address to the "OWNERS shown on the
local assessment roll for every property which abuts and is across from any
public or private street from the applicant's property." These mailings
must be by CERTIFIED MAIL, RETURN RECEIPT REQUESTED, within five
(5) days of receiving this letter. This will allow for the green signature
cards to be returned to you, and then submitted to us for the official.
(If the green signature cards are not received by the hearing date, a delay
is possible before receiving action by the Board.)
Please be sure to:
1. -Return the ' Affidavit of Mailing to us when the certified mail
receipts are postmarked on the day of mailing, attaching a written list
signed by the person verifying the same from the Assessors' Assessment
Roll, which lists all the lot numbers and owners' names, current addresses
from on the local assessment rolls, and the date the listing was obtained
from the Assessors' Office.
2. Place the enclosed Poster in the location described by Ch. 58 of
the Code, within 10 feet of the front property line facing the street, for a
time period of not less than seven days. The sign must be posted not later
than June 3rd.
3. Return a completed Affidavit of Posting by the hearing date.
4. Return the green signature cards at or before the hearing.
