PROPERTY FACTS/ DESCRIPTION:
The subject property is located on the westerly side of Village Lane,
Orient, and contains a total lot area of 8,346 sq. ft. The survey map
submitted under this application shows that the subject premises is
improved with a one-story frame dwelling and 8' x 8' accessory shed
located in the rear yard not closer than 3' from the rear property line
and 7' from the southerly side property line. The existing lot coverage
for the dwelling is confirmed to be 1,847 sq. ft. for the house and 64
sq. ft. for the shed, for a total of 1,911 sq. ft. (23%).
BASIS OF APPEAL: Building Inspector's April 14, 1998 Notice of
Disapproval, disapproving a building permit application to remove
existing shed and replace with accessory garage, which will exceed
allowable lot coverage of 20%.
AREA VARIANCE RELIEF REQUESTED BY APPLICANT: The applicant's
request is to replace the existing 8' x 8' accessory shed with a new 16'
x 20' garage at not closer than 3 ft. from the rear property line and not
closer than 7' from the side property line, as presently exists for the
shed. The new lot coverage as requested is an overall increase of 256
sq. ft. for a total lot coverage of 2,167 sq. ft (26+- %). The height of
the garage is proposed to conform with the Code at less than 18 feet.
REASONS FOR BOARD ACTION, DESCRIBED BELOW:
On the basis of testimony presented and personal inspection, the Board
makes the following findings:
(1)
Applicant
has extensively remodeled an existing house located on a
lot
whose small
size is typical of
the neighborhood. The remodeling did
not
change the
size of the house,
which covers 22.1% of the lot.
(2) The
house has
little usable basement space. There is an 8 -by -8
foot shed
at the rear
of the property but
no garage. In order to obtain
adequate
protection
for an automobile,
tools and boat equipment,
applicant
wishes to demolish the shed and
build a one -car garage in the
same rear -yard area.

(3) The house alone covers 22.1% of the lot, and with the shed total
coverage is 22.9%. thus, the only way that applicant can obtain the
benefit of a garage is by a variance allowing lot coverage in excess of
20%. The proposed garage is modest in size but nevertheless increases
the coverage (after removal of the shed) to 26.0%.
(4) Lot coverage of 25% is significantly greater than the 20% allowed by
the Code. However, the lot coverage is already at nearly 23%, and the
neighborhood is densely built on small lots, with numerous accessory
buildings. Thus, granting of the requested variance will not produce an
undesirable change in the character of the neighborhood or detriment to
neighboring properties.
(5) The requested variance will not have an adverse effect or impact on
physical or environmental conditions in the neighborhood.
The Board concludes that the following action is the minimum necessary
and adequate to enable applicant to obtain the benefit of a garage while
also preserving and protecting the character , and at the same time
preserves and protects the character of the neighborhood, and the
health, safety, welfare of the community.

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town
Law and the Code of the Town of Southold, the following application, will
be held for public hearingby the SOUTHOLD TOWN BOARD OF
APPEALS, at the Southold Town Hall, 53095 Main Road, Southold, New
York 11971, on THURSDAY, JUNE 11, 1998 at the time noted below (or
as soon thereafter as possible):
6:45 p.m. Appl. No. 4571 - WALTER MILLIS. This is a
variance request under Zoning Code Article IIIA, Section '100-30A.3,
based upon the Building Inspector's April 14, 1998 Notice of
Disapproval, disapproving a building permit application to remove
existing shed and replace with accessory garage, which will exceed
allowable lot coverage of 20% at 1800 (a/k/a 1875) Village Lane, Orient,
NY; 1000-24-2-22.
The Board of Appeals will at said time and place hear any and all
persons or representatives desiring to be heard in the above applications
or desiring to submit written statements before the end of each hearing.
The hearing will not start earlier than designated. The file is
available for review during regular Town Hall business hours (8-4

REASON FOR APPEAL Continued
I. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or Unneces-
sary I'IARD51ilP because
L The dwellingat1800 Village Lane is now being used as a -full-time principal residence (previously it was a
secondary residence only). It currently has no storage facilities of the type a principal residence needs and which
would be provided by the proposed garage, for such things as storm windows and screens (in season), garden
tools, lawnmowers, wheel barrows, boating equipment etc. not to mention a car. Nor does it have any place for a
workbench. (The existing dwelling has no usable cellar and only a very small attic.)
2. The hardship created is UNIQUE and isnot shared by all properties alike in the immediate
vicidity of this property and in this use district because
2. Two of the three adjoining properties have garages of the general type being sought here. While the
property.immediately to the north on Village Lane belonging to Maureen Terry does not have a garage, the six
properties going north to Skipper's Lane DO. In short, garages of the type being sought are quite common in
the neighborhood, 1800 Village Lane is one of the few that does not have a garage of some sort.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because
I The proposed garage is architecturally in keeping both with the residence it will serve and with the
neighborhood. As noted above, most of the houses nearby have garages including the two immediately
adjacent. Those garages resemble the proposed one both as to their size and their architecture. It further looks
as though at least some of the neighborhood garages mentioned above cause more Than 24 percent of their lots to
be covered with buildings.

§ 58-1. Providing notice of public hearings.
Whenever the Code calls for a public hearing, this 'section', on',
shall apply. Upon determining that an application is complete, '
the board or commission reviewing the same shall fix a time
and, place for a, public hearing thereon. The board or commission
reviewing an application shall provide for the giving of notice:
'A. By causing a notice giving the time, date, place and
nature of -the hearing to be published in the official
newspaper within the period prescribed by law.
B. By requiring the applicant to erect the sign provided by
the town, which shall be prominently displayed on the
premises'facing each public or private street which the
property 'involved in the application abuts, giving notice
of the application, the nature -of the approval sought
thereby, and the time and place of the public hearing
thereon' The sign shall be set back not more than ten

Town Code Chapter 58, requires that the applicant send "NOTICE

from the Assessors' Office.
2. Place the enclosed Poster in the location described by Ch. 58 of

time period of not less than seven days. The sign must be posted not later
than June 3rd.
3. Return a completed Affidavit of Posting by the hearing date.
