FINDINGS OF FACT
PROPERTY FACTS/ DESCRIPTION:
The above -identified property is located on the northerly side of
Long Creek Drive, Southold, and contains a total area of 56,873 sq.
ft., including wetland/pond area. The survey map prepared by
Howard W. Young, L.S. and last updated July 16, 1997 shows that
the subject premises is improved with a two-story frame dwelling
with attached garage situate 50.9 feet off the southerly front
property line and an in -ground pool with surrounding concrete patio.
BASIS OF APPEAL: Building Inspector's July 22, 1997 Notice of
Disapproval for a building permit regarding an "as built"
swimmingpool which is not located in the required rear yard
pursuant to Article IIIA, Section 100-30A.4.
AREA VARIANCE RELIEF REQUESTED BY APPLICANT: Applicant
is requesting approval of the location of a portion of the existing
swimming pool in the side yard. The setback of the swimming pool
is shown to be 16.3 feet from the westerly side property line, 81.5
feet from the edge of the wetlands at its closest point and 31.5 feet
from the edge of the "non -disturbance buffer" around the wetlands.
The southerly end of the pool extends into the side yard for
approximately 11 feet south of the rear line of the house.
REASONS FOR BOARD ACTION, DESCRIBED BELOW: The pool was
constructed without a building permit in the belief that the permit
for the house and the approval of the Town Trustees sufficed. The
pool's location was chosen in part because the applicant believed it
had to be set back at least 75 feet from the wetland.
The applicant's difficulty, which causes him to seek the requested
variance, is self-created. However, because the pool is already
built, the applicant cannot achieve the benefit of a pool by some
other approach without incurring substantial expense to relocate the
pool. Even if he were to relocate it, there would be difficulty in

finding a location in the rear yard that did not encroach on the
non -disturbance buffer zone as shown on the survey prepared by
Young and Young dated 9-4-96.
The variance sought is not substantial. In view of the authorization
previously granted by the Town Trustees, granting of the variance
is not expected to have an adverse effect on the physical or
environmental conditions in the neighborhood.
Granting of the variance will not produce an undesirable change in
the character of the neighborhood or detriment to nearby properties
provided that the pool filter and pump are adequately screened from
the adjacent neighbor.
The Board finds that the grant of the requested variance, with the
conditions set forth below, is the minimum action necessary and
adequate to enable applicant to enjoy the benefit of a pool while
preserving and protecting the character of the neighborhood, and
the health, safety and welfare of the community.
RESOLUTION/ACTION: On motion by Member Collins, seconded by
Member/Chairman Goehringer, it was
RESOLVED, to GRANT the variance as applied for, subject to
the following CONDITIONS:
1. The pool pump and filter equipment shall be moved to a location
at least five (5) feet from the westerly property line, and shall be
fully enclosed in a shed constructed for the purpose. The Board
does not require that applicant's obtain further variance approval
for the setback of the enclosure at less than the 20 ft. code setback
in order to meet this condition.
2. A screen of evergreens at least three (3) feet high, and no more
than four (4) feet apart, shall be planted between such shed and
the westerly property line. Such screen shall extend at least four
(4) feet beyond the northerly and southerly sides of the shed and
shall be continuously maintained.
3. No Certificate of Occupancy shall be issued for the subject
shed -enclosure until the above Conditions have been complied with.

For your information: The entire McElroy family moved from the
house at 2565 Long Creek Drive on Thursday, July 30, and a new
family has been occupying it since Friday, July 31.
Mr. David McElroy was told at the July 23 hearing to enclose
the pumping station for the pool so that my husband and I, his
next-door neighbors to the east, would not have to hear it or
see it. To date it has not been enclosed.

We are Lisa McElroy's next-door neighbors on the west (pool) side of
her house.
We do not object in general to the location of her pool or to the sounds
of people having a good time in and around it. However, we do have two
concerns with regard to this pool:
1. The McElroys played very loud poolside music in the past, but
more recently we have not heard any. We would like the Board
of Appeals to specify that no user of this pool may play music
so loud that it is inescapably audible even inside our house.
2. An unsightly pumping station for the pool (photo enclosed),
elevated 52 feet above ground level by the retaining wall of
the pool, is only about 2 feet east of our common property
line. We would like the Board of Appeals to require that a
roofed wooden soundproof enclosure be built around this
pumping station so that we will not have to hear its persistent
hum in warm weather or see it after the leaves fall.

attached.
David McElroy, her husband, was under the impression that the original Building Permit for the
house included provision for the pool, as did all the other required permits (Trustees and
NYSDEC). He told the landscape contractor, who originally was to have built the pool, that all
permits were in hand. Later the landscape contractor passed this information along to the pool
contractor, who proceeded with the construction thinking that a permit had been issued.

Pursuant to the provisions of Chapter 58 of the Southold Town
Code, notice of your application and hearing must now be sent, by
certified mail, return receipt requested, to the all surrounding
property owners together with a copy of a map or sketch describing the
location and/or'use of the property or new construction. Please send
the notices by 7/3. Owners of vacant property and other properties,
surrounding your project, along all sides and abutting the boundaries
of the subject lot are those as listed. on, the assessment rolls. A
copy of Chapter 58 is enclosed for your reference.
Please also.post the enclosed.sign on your property at ten (10)
feet, or closer, to the front property line, facing the street by
7/15. The sign must remain,...for a .period of not less than seven (7)
days). Once the sign is placed, please complete and return the
Affidavit of Posting to us. If another. m4 n is needed, please let us
know.
When the Certified Mailings have been sent, please furnish your
Affidavit of Mailing to us as soon as possible, together with white
certified mail receipts postmarked by the post office. Once the
green/signature cards are returned to you by the post. office, please

§ 58-1. Providing notice of public hearings.
[HISTORY: Adopted by the Town Board of the Town of
Southold 12-27-1995 as L.L. No. 25-1995. Amendments
noted where applicable.]
§ 58-1. Providing notice of public hearings.
Whenever the Code calls for a public hearing, this section
shall apply. Upon determining that an application is complete,
the board or commission reviewing the same shall fix a time
and place for a public hearing thereon. The board or commission
reviewing an application shall provide for the giving of notice:
A. By causing a notice giving the time, date, place and
nature of the hearing to be published in the official
newspaper within the period prescribed by law.
B. By requiring the applicant to erect the sign provided by
the town, which shall be prominently displayed on the
premises facing each public or private street which the
property involved in the application abuts, giving notice
of the application, the. nature of the approval sought
thereby and the time and place of the public hearing
thereon. The sign shall be set back not more than ten
(10) feet from the property line. The sign shall be
displayed for a period of not less than seven (7) days
immediately preceding the date of the public hearing.
The applicant or his/her agent shall file an affidavit that

REASONS FOR AREA VARIANCE:
1. An undesirable change will NOT be produced in the character of the neighborhood or a det-
riment to nearby properties, if granted BECAUSE:
The swimming pool, which is the only structure requiring a building permit extends only
several feet into the side yard. The impact on the character of the neighborhood of the
structure in its present location as compared to the impact if it were located several feet to
the north, fully in the required rear yard location, is not significantly different. The structure
and the surrounding landscaping have been tastefully done and are most attractive.
2. The benefit sought by the applicant CANNOT be achieved by some method, feasible for
the applicant to pursue, other than an area variance BECAUSE:
The structure is already in place; the method of construction is such that the pool would
have to be destroyed if an area variance is not granted.
3. The amount of relief requested is not substantial BECAUSE:
The pool extends only four feet into the side yard if the rear yard is measured from the
northernmost portion of the enclosed living space of the house. If the rear yard is measured
from the northernmost edge of the porch, the pool extends 11 feet into the side yard.. In ei-
ther case, the area of the pool extending into the side yard is minimal.
4. The variance will NOT have an adverse effect or impact on the physical or environmental
conditions in the neighborhood or district BECAUSE:
The pool in its present location is no closer to the western property line than it would be if it
were entirely in the rear yard, as is permitted by the zoning regulations. One of the reasons
that the pool was inadvertently placed in its present location was the perceived need to keep
it 75 feet from the edge of the wetlands.
5. Has the alleged difficulty been self-created?

6. This is the minimum that is necessary and adequate, and at the same time will preserve and
protect the character of the neighborhood and the health, safety and welfare of the commu-
nity.
