The lead agency has determined that the proposed action described below may have a significant effect on the environment and has requested a Draft Environmental Impact Statement to be p~epared. Proposed channel will be 40!' x 20±' to maximum depth of 5' below k~LW. Approximately .... 400 cu. yds. of spoil will be removed by hydraulic dredge during the dredging of Mud Creek by the SCDPW. Spoil will go to approved area on Fisherman Beach, Nassau Point. To add a second 6' x 16' float to existing dock; add (3) 8" diameter mooring pilings 15' north of dock. LOCATION: 470 Haywaters Drive, Cutchogu~, New York; Suffolk County tax map No. 1000-104-5-21 and 1.3 REASONS SUPPORTING THIS DETERMINATION: 1. Proposal has been requested for more than 100 cu. yds. (Type 1 action). 2. D.E.C. commented with objection to the spoil site, recommended extending the dock into deeper waters, and that dredging be limited to the area Page 2. - Paul Ferdenzi by Eh-Consultants, Inc. at the end of the extended dock. Southold Town Conservation Advisory Council recommended disapproval as dredging ~ill destroy the shellfish producing bed and do irreversible damage to the bottom. We suggest that you extend the proposed dock further to deeper water and that dredging be limited to the area at the end of the extended dock. Please provide us with revised plans (three copies) showing where-the dredge~ spoil will be placed. The plan should include a sectional view also. As an alternative measure the CAC suggests applicant either apply for a mooring elsewhere in the creek or seek docking at Boatman's Harbor. No. 477- Larry and Sandy Stahl - Approve with stipulations. Use haybales to avoid runoff; put in more plantings as used elsewhere on property; have the Bay Constable do frequent inspections., during construction. No. 478 - Elizabeth Yaro - Recommend approval with stipulations. Strict adherance to the DEC regulations; use down spouts; drywells, etc. Have the Bay Constable check ofter during Construction to be sure guidelines are adhered to.
