held pursuant to notice duly given to all the men, bets thereof~

below ~ean low water; the dredged material to ~e disposed of
ward of tD~ Bulkhead in s~ch manner as will prevent escaos of
material into ~he waterway, in ~attituck ~reek, at Matti~uok, in
the Town of $o~thold, Suffolk County, New York. Bulkhead to be
approximately ten feet fro~ mean high water mark; and approximate
seventy feet frc~ main channel l~ne.
Subject, however, to the public right of navigation and sub
ject to the right of the p~blio to pass and repass along that por-
tion of the beach between low and high water mark° On condition,
however, that the party of the second p~rt will hold the said
Trustees and the Town of Southold harmless and free from any and
all d~ages ~nd claims ~rising under or by virtue of said dredging!
IN WITN~ WHERE[F, the said Town of Southold, party of the
first part, has by a vote of a majonity of the Board of Trustees
said Town, caused its corporate seal to be hereunto affixed, and

proposed bul]d~ea8 is to be constructed around a small-boat basin 70 feet
wide and approximately 80 feet long.
The decision as to ~ether or not a permit will be issued must rest
primarily upon ~e effect of ~-e proposed v~ork on navigation. Any criti~
cisms or protests regarding ~e proposed work, from the standpoint of
navigatiQn, should be s~o~itted to this office ~ior to ! Hovember 1951,
