Box 29 Greenport NY 11944 Re: Army Corps Appi. %91-0925-L2 Dear Mssrs Boening & Greenstein: With respect to your letter of March 31, 1992 with attached letter from ·Congressman HOchbrueckner, this letter will confirm my previous letter of January 16, 1992.and as such there are no other actions available to the Southold Town TruStees concerning this matter at this time. Any future proposed alterations to the doc~ in question which are landward of the seaward most position as it is presently configured would require a wetland permit from this Board as an accessory use by Mr. Fakiris' house. The permanent use of this dock by more than two boats other than those of the owner and his immediate family would be a violation of the Town Zoning Ordinance.· Although i honestly do not believe there are any other branches of Southold Government other than the Trustees and Planning Board which would be involved with this structure on an approval/denial basis at this time, you may wish to contact the legal department and the chairmen of the Zoning and Planning Boards ~-~h~J~ for their own response in this matter. The folIowing recommendations were made at that meeting: No. 527 - Mr. and Mrs. John Lang - Recommend approval with the stipula- tion that applicant does not distub the natural vegetation (spartina wetland). Consequently, the proposed extension of the existing Fakiris dock places it directly in front of the. adjoining property owned and used by the Crescent Beach Condominium Association. The Proposed extension to the existing dock extendS across more than one half of the' CresCent Beach Condominium shoreline frontage. The enclosed Ingegno survey illustrates this point.. This is by' no means a reasonable exercise of Mr. Fakiris' riparian rights. Other relevant factors to be considered are as follows: (1) No proper notification of proposed activity was given or sent to either adjacent property owners, easterly or westerly. (On 1/8/92, One owner stumbled on the public notice at Town Hall and subsequently notified Cleaves·Pt. Condominium Association). (2) Applicant's drawings are not cgrrect nor are they drawn by a licensed surveyor. Eg.: "Existing pier" on easterly ·adjacent · proPerty is listed at 300 feet/when, in fact, it is only 180 feet. (3) Drawings submitted by applicanT do not include pier which does exist on westerly adjacent property and which would be most directt~ affected by the location of the proposed structure. (4) Drawings submitted, in eff~ct,~are incomplete,, inadequate and distort the true shoreline and~water use in this area. The crescent'Shaped shoreline includes many Private beach areas, a Town of Southold Pub'li~ Beach facility and a boating passage- way to Gull Pond. New York Department of State Page 2. (5) It is the well-known intention of the applicant to use this pier as a marina for 40 homes he is developing on 41 acres he owns at this site. The proposed activity is, at the very least, over-development for one owner use; and, in fact, very much in keeping with plans for a future marina.
