Box 29 Greenport, NY 11944 Dear Mr. Hichborn: Thank you for contacting me to inquire about a proposed dock extension at Cleaves Point, in East Marion. I certainly understand and appreciate the interest of the Cleaves Point Condominium Associations in this matter. My staff has contacted the Regulatory Branch of the U.S. Army Corps of Engineers to request an update on this proposal. According to the Army Corps, no action will be taken on the permit application by the federal government until the Town of Southold has completed its action on the local permits associated with this project. If the proposal is disapproved by the town, now or at any time in the future, the permit application will automatically be rejected by the federal government. The Army Corps indicated that there is ample testimonial material from local residents concerning this project in the public record. In addition to contacting the Army Corps and the Town of Southold, you may wish to contact New York Secretary of State Gail Shaffer (162 Washington Avenue, Albany, NY 122~1) to register your opinion. The Department of State is required by law to consider the impact of such a proposal on management of the coastal zone and issue a report on its findings before the proposal may go forward. I appreciate your bringing this matter to my attention. Please be assured that I will contact you if I receive word of any impending action on this proposal by the federal government. Enclosed for your consideration are the following: a. Photocopy of SUffolk County Tax Map showing the area in question b. ,~l,,~r~,e,~e,~ of Su~o~ County Tax Map c. Map of property at Crescent Beach Condominium prepared by Joseph A. Ingegno, Land Surveyor, dated January 22, 1992 d. A series of photographs showing the existing beach front area and existing docks of Mr. Fakiris and Crescent Beach Condominium e. A survey of Crescent Beach property prepared by Van Tuyl & Son, Land Surveyors, dated October 25, 1973. The subject site lies along what is known as Crescent Beach which runs from Youngs Point on the west to Cleaves Point on the east. It is aptly named for the entire shoreline is curved. The subject parcel is located near the easternmost end of this curved shoreline. The exercise of one's riparian rights must be reasonable and viewed in light of the riparian rights of adjoining and surrounding waterfront owners. Mr. Fakiris is the owner of property with 100 feet of shoreline. Crescent Beach Condominium property has almost 200 feet of shoreline. The shoreline is curved. Consequently, the proposed extension of the existing Fakiris dock places it directly in front of the adjoining property owned and used by the Crescent Beach Condominium Association. The proposed extension to the existing dock extends across more than one half of the Crescent Beach Condominium shoreline frontage. The enclosed Ingegno survey illustrates this point. This is by no means a reasonable exercise of Mr. Fakiris' riparian rights. The proposed dock of 370 feet in length severely impacts the reasonable use and enjo).~nent of the riparian rights to which the Crescent Beach Condominium Assodafion is entitled. It is requested that you deny the request for the proposed extension for the Fakiris dock. If you have any questions, please do not hesitate to contact me. Ve~ truly yours, WDM/mr Encls. Consistency Re: U.S. Army Corps of Engineers Public Notice #14524-91-925-L~ Dear Sir: The Board of Managers and owners o~ Crescent Beach Condominium, (Town of Southold), Greenport, New York~ request that you object to the permit application on the above-mentioned activity because the project is not consistent with the coastal zone management program of New York State. Crescent Beach Condominium ±B located directly adiacent on the west side of applicant's property. Please be advised that we never received due public notice of the proposed project in order to respond within the allotted time frame. Therefore, we require an extension of time to properly formulate our objection and to include aerial views and true surveys to substantiate our position. The public interest will not be served with a decision by your o~fice to issue a permit on this application because such a decision wil~ effect a gross negative impact on the protection and utilization of important natural resources in this particular area of Gardiner's Bay and its environs. A careful review of an accurate survey from a licensed surveyor together with aerial views of the shoreline and crescent-shaped bay area as well as expert environmental impact testimony will attest to the enormous detrimental effects of the proposed activity in comparison to any reasonable benefits. Other relevant factors to be considered are as follows: (1) No proper notification of proposed activity was given or sent to either adjacent property owners, easterly or westerly. (On 1/8/92, One owner stumbled on the public notice at Town Hall and subseq6ently notified Cleaves Pt. Condominium Association). (2) licensed surveyor. Eg.: "Existing pier" on easterly adjacent Applicant's drawings are not correct nor are they drawn by a property is listed ak 300 feet when, in fact, it is only 180 feet. _ (3) Drawings submitted by appllcan~ do not include pier which does exist on westerly adjacent property and which would be most directly affected by the tocat~on of the proposed structure. (4) Drawings submitted, in effect, are incomplete, inadequate and distort the true shoreline and water use in this area. The crescent-shaped shoreline inclSdes many private beach areas, a Town of Southold Publi~ Beach facility and a boating passage- way to Gull Pond. New York Department of State Page 2. (5) It is the well-known intention of the applicant to use this pier as a marina for 40 homes he is developing on 41 acres he owns at this site. The proposed activity is, at the very least, over-development for one owner use; and, in fact, very much in keeping with plans for a future marina. (6) Construction of this addition to the already largest existing structure in this waterway would: a. be an impediment to navigation in a recreational area; b. aesthetically abuse the use of 100' of shoreline by one owner; c. adversely affect the safety of swimmers and boaters; d. destroy efforts for conservation of Gardiner's Bay and its environs. effectively eliminate the clam seedbeds in the immediate area. The question of whether an action may be significant is not always easy to answer. Frequent- ly, there are aspects of a project that are sublective or unmeasureable, tt is also understood that those who determine significance may have little or no formal knowledge of the environment or may be technicali~ qxpert in environmental analysis. In addition, man',' who have knowledge in one particular area may not be aware of the broader concerns affecting the question of significance. The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action. JR ~iAGNiTUDF. ~ ,r Responsibility of lead Agency ~ ' ~ ~ General Information (Read Carefully) · In completing the form the reviewer should be guided by the question: Have my responses and determinations been reasonable? The reviewer is not expected to be an expert environmental analyst. · Identifying that an impact will be potentially large (column 2) does not mean that it is also necessarily significant. Any large impact must be evaluated in PART 3 to determine significance. Identifying an impact in co!urnn 2 simply asks that it be looked at further. · The Examples provided are to assist the reviewer by showing types of impacts and wherever, p?sible the threshold of magnitude that would trigger a response in column 2. The examples are generally applicable throughout the State and for most situations. But, for any specific project or site other examples and/or lower thresholds may be appropriate for a Potential Large Impact response, thus requiring evaluation in Part 3. · The impacts of each project, on each site, in each locality, will vary. Therefore, the examples are illustrative and have been offered as guidance. They do not constitute an exhaustive list of impacts and thresholds to answer each question. - The number of examples per question does not indicate the importance of each question.· · In identifying impacts, consider long term, short term and cumlative effects. - ~ Instructions (Read carefully) a. Answer eac~ of the 19 questions in PART 2. Answer Yes if there'-will be any impact. b. Maybe answers should be considered as Yes answers. c. If answering Yes to a question then check the appropriate box (column I or 2) to indicate the potential size of the impact. If impact threshold equals or exceeds any example provided, check column 2. If impact will occur but threshold is lower than example, check column 1. d. If reviewer has doubt about size of the impact then consider the impact as potentially large and proceed to PART 3. e. If a potentially large impact c'hecked in column 2 can be mitigated by change(s) in the project to a small to moderate indicates that such a reduction is not possible. This impact, also check the Yes box in column 3. A No response must be explained in Part 3. IMPACT ON LAND 1. Dragonetti c/o Gusmar Realty Corp. on behalf of Peter Fakiris to construct 200' x 4' of dock with a 50' x 6' "T" to be secured by 36 pilings and to construct 17 lin. ft. of bulkhead and to fill with 800 cu. yds. of fill. Property is located on Shipyard Lane, East Marion. Trustee Smith: That is the official publication of the hearing notice. Ar m there any comments for or against this application? (No comments from the audience) Do any of the Trustees have any comments? Trustee Krupski: This is amended to include the '~T" (50' x 6') dock on the end. Didn't we discuss the deletion of the 800 cu. yds. of fill and the bulkhead? Trustee Smith: Yes. I have the comments from the Conservation Advisory Council as follows: "Recommend approval of the dock but disapprove of the bulkheading.. The C.A.C. suggests the applicant extends the ramp from the base of the dock up further and that would eliminate the need for the bulkheading. The C.A.C. does not approve of the bulkhead because there are no other bulkheads in the area ~nd the bulkhead would create erosion problems. Trustee Bredemeyer: Also on inspection we felt they could create the natural contour of the existing vegetated berm, but to leave in tact the beach grass and dune that was presently there. Trustee Smith: I have contacted Mr. Dragonetti, he is here tonight, and he said he is willing to drop the bulkhead portion from the application. Ar e there any other comments? No comments. Being no further discussion on this application, I close this public hearing.
