Box 28 Southold, New York 11971 March 4, 1983 Mr. Roy Haje Fn-Consultants, Inc, 64 Forth Main Street Southampton, New fork 11968 Rea Bulkhead Fee Tear Mr. Haje, One of the problems we have in Southold Town is public access along the shores of our creeks and bays, In the past people who own water front property put bulkheads in town =maters and therefore inhibit the public access along the creek- front. To prevent this abuse of public land, a fee was attached to any bulkhead touching or in town waters in hopes that in the future bulkheads would be put above high water mark so that people could travel in frost of them, With reference to the Fairlie bulkhead, the Trustees visited the Fairlee site on January 27, 19831 and found the creek waters up to the bulkhead,. The Fairlie deed reads as follows= "Funning thence in a southwesterly direction along the high water mark of Jockey Creek." With the above in mind you might suggest to Piz. Fairlie that he have a current survey made of his southwesterly bound- ary along the creek to determine whether the bulkhead is or is not in town waters. Stoutenburghe 1~1r. Robert R. Fairlie, jr. has relayed to us your re- quest for a letter of determination 4 regard to his bulk- head and its relation to Town waters. The distance from Wells Avenue to jockey Creek along the line between Lots 3 and 4 on the filed map of "George H. Wells" (Suffolk Counts NO. 859) was 205 feet; the line between lots 2 and 3 was 223 feet. Our first survey of the Eairlie parcel was done in 1968 and was then Owned by W. Corey and Elizabeth T. Albert- son (see two prints enclosed). The distance along the line between lots 3 and 4 to ordinary high water at the bulkhead was 201 feet, four feet back from. the filed map distance. The distance to the bl- khead along the Lne between Lots 2 and 3 was approzimately 193 feet, 30 feet back from the filed map distance. The following are unknown to me: (1) The location of the existing ordinary high water mark at the time the bulk- head was constructed; (2) The ownership of the land under water between (1) and ordinaryhigh water mark per- filed map, (3) The date the bulkhead was built. 1 hope the above and the enclosed prints will help in your determination of Mr. °airlie's application. In addition, you request a $24a. application fee. It is my understanding that application fees are assessable.only when private work is being done on Town property. The.proposed. bulk- head will be.constructed entirely upon Mr. and Mrs...Fairlie.`s privately-owned property. In support of this contention, I enclose.a copy of the. deed for the subject property and a photocopy of the 'survey. Please review these documents whichshould convince you that no fee is due. I would also like to take this opportunity to request that the Board review its fee schedule. At ~3., per foot, the. Southold Trustees fee is by far the highest on Long Island. In comparison, the Southampton Trustees charge $.10 per foot with minimum feeof $10.
