The following action was taken by the Board of Town Trustees during
its regular meeting held on July 26, 1990:
RESOLVED that the Town Trustees approve the request for a waiver to
demolish existing above ground storage tanks s~bject to no activities
within 75' of water. Property is located on Luther Road, Mattituck.
Please return to the Building Department for a determination on the
need for any other permits which may be required for this project.

The Southold Town Trustees are in receipt of an application for
a wetland permit for operations on the site of the Carey Tank
Farm.
As the application does not indicate any pollution abatement
procedures, the Trustees would request Town Board input with
respect as to how the tank dismantling should proceed.

Weland Application Recommendations
The following recommendations were made by the Southold Town CAC at its meeting
held Thursday, June 14, 1990 at Southold Town Hall:
On a motion by Bruce Loucka~ seconded by Stephen Angell, it was
RESOLVED to recommend to the Southold Town Trustees approval with stipulations
off Wetland APplication No. 3-3-90-99-4-1 submitted by Permit Research and
Acquisition Co for Care¥ Tank Farms to demolish Carey Tank Farms (above ground
petroleum tank storage), demolition of three (3) 250,000 gallon tanks and three
(3) 100,000 gallon tanks, and two (2) 20,000 gallon tanks. The CAC approves
provided that during the course of removal, nothing is allowed to enter the
creek or groundwater and that any connecting lines or plumbing be removed also.

Motion carried.
On a motion by John Holzapfel, seconded by Stephen Angell, it was
RESOLVED to recommend to the Southold Town Trustees approval with stipulations
of Wetland Application No. 5-I-90-115-17-6.2 submitted by Bookmiller Realty
on behalf of Brent Bookmiller to construct a single family dwelling, well and
associated sanitary system. The CAC approves provided ail runoff be contained
on property (hay bales, filter cloth, etc.), gutters, downspouts, and drywells
be installed and a 45' native vegetation buffer be maintained. The;:'suggests
applicant site the house as closer to the road, as much as zoning will allow.

On a motion by Bruce Loucka, seconded by Margaret Feeney, it was
RESOLVED to recommend to the Southold Town Trustees disapproval of Wetland
Application No. 5-3-90-117-5-31 submitted by John H. Geideman on behalf of
Joseph Fudiinski to excavate to create a small boat basin (pleasure craft), and
place spoil on owner's land close to site. The CAC recommends disapproval
because no need is shown for this project. The project would result in the
removing of wetlands, dredging would destroy the whole waterfront area by his
property and damage would occur to the wetlands. The Council suggests the
applicant instead submit plans for a dock and catwalk.

adjacent area for upland disposal. No debris is permitted in' tidal.wetlands or

5°. If seeding or soil stabilization is impracticable due to the time of year~ a temporary

opportunity when weather conditions favor germination and growth, but not more than
six months after project completion.
Prior to the ultimate expiration of this permi~ the permittee will cause all fill and
exposed faces to be vegetated to prevent eroszon.
7° Ail areas of soil disturbance resulting from this project shall be seeded with an
appropriate perennial grass seed and mulched with hay or straw within one week of
final grading° Mulch shall be maintained until a suitable vegetative cover is
established°
8. To protect the values of the tidal wetland, there shall be no disturbance to the
existing natural vegetatio~-o~ topography outside of the existing chain link fence.

SUPPLEMENTARY SPECIAL CONDITIONS
following conditions apply to all permits:
If any Lf the permit conditions are unclear,the permittee shall con-
tact the Division of Regulatory Affairs at the address and telephone
noted below.
A copy of this permit with supplementary conditions and approved
plans shall be available at the project site whenever a~thorized
work is in progress.
The permit sign enclosed with the permit or a copy of letter of
approval shall be prote6ted from the weather and posted in a con-
spicuous location at the work site-until completion of authorized work.
At least 48 hours prior to commencement of the project, the permittee
shall complete and return the top portion of the enclosed receipt fo~m
certifying that he 'is fully aware of and understands all provisions and
conditions of this permit. Within one week of completion of the
permitted work, the bottom portion of that form shall also be com-
pleted and returned.
For projects involving activities to be accomplished over a period of
more than one year, the permittee shall notify the Regional Permit
Administrator in writing at least 48 hours prior to the commencement
of resumption of work each year.
F. If projecn design modifications take place after permit issuance, the
permittee shall submit the appropriate plan changes for approval by
the Regional Permit Administrator prior to undertaking any such modi-
fications. The permittee is advised that substantial modification
may require submission of a new application for permit.
G. Ail necessary precautions shall be taken to preclude contamination of
any wetlands or waterway by suspended solids, sediment, fuels,-
solvents, lubricants, epoxy coatings, paints, concrete, leachate or
any other environmentally deleterious materials associated with the
project work.
.H. Any failure to comply precis~%y with all of the terms and conditions
of this permit, unless authorized in writing, shall be treated as a
violation of the Environmental Conservation Law.
The permittee is advised to obtain any permits ~r approvals that may
be requ'ired from the U.S. Department of Army Corps of Engine6rs, NY
District, 26 Federal Plaza, New York, NY 10278, (Attention: Regulatory
Functions Branch), prior to commencemen~ of work authorized herein.
The granting of this permit does not relieve the permittee of the
responsibility of obtaining a grant, easement, or other necessary
approval from the Division of Land Utilization, Office of General
Services, Tower Building, Empzre State Plaza, Albany, NY 12242, which
may be required for any encroachment upon State-owned lands underwater.

On March 9, 1990, I submitted a building application for the
demolition of the above named site to your office. At that time,
you accepted the applicatioh under the term that I would supply
your office with information on where the tanks would be disposed
of, at a later date.
The tanks will be removed from the site and dis0osed of in a
legal manner at Gershow Recycling located ]n Medford, N.Y.
Please insert this information in the file with all other
documentation regarding this site.

Your letter relative to the wetland permit for operations on the site
of the Carey Tank Farm is being submitted to the Town Board for their
discussion at the March 27th Work Session.
In the meantime, the Town Board engaged the services of H2M to
prepare an Environmental Assessment Report on this property, and I am
attaching pages 15-17, Conclusions and Recommendations, from that report
which reads in part, "Removal of the eight storage vessels would have
to be conducted in the presence of an inspector from the NYSDEC or
SCDHS."
If you would like a complete copy of the abovementioned report,
please advise and we will make you a copy.

Based upon our visual observations, PID screening and
laboratory analysis, there is evidence of serious soil and
groundwater contamination at Carey Tank Farms.
Petroleum hydrocarbon contamination of soils extends
throughout the southwest quadrant of the site. Laboratory
results from this study show e~evated concentrations of
petroleum hydrocarbons in the petroleum loading area and
adjacent to storage vessels nos. 1 and 2. The
concentrations of petroleum hydrocarbons in this area would
~warrant remediation according to NYSDEC informal cleanup
guidelines.

equipment from the site. Additional study should be
conducted to delineate the vertical and horizontal extent of
contamination. We also recommend that soil samples be
collected from beneath
