Bredemeyer, III .~, President, Board of Trustees~C~ Covenants and Restrictions for Alan Cardinale, James Creek SCTM 91000-122-3-14 I reviewed your memo of August 28, 1991 with the Trustees at our October 3, 1991 meeting and offer the following: The Board of Trustees agree with the Planning Board that paragraph 3F Should be removed. I stand corrected and in the minority as the only member on the Board which has no problem with this section. The Board is not prepared to make a general statement as to an owners right "required protective structures". They believe in a case by case review of these matters. Since the site in question is considered "stable", they foresee no practical need for this language. I am not sure if Mr. Cardinale's fears will be assuaged by the fact that the bog and wetlands at the lead of creek such as this will likely be stable over geological times, but this is nevertheless, the expectation of the Board. With respect to paragraph number 13, the Board has not recently discussed this at length, but has long agreed that language on fertilizers is very difficult if not entirely unenforceable. Possibly the owners would wish to consider language clarifying plants species not requiring large amounts of fertilizer such as "lawns of rescue or similar grasses" and landscaping plants of indigenous species such as bayberry, rhododendrons etc." I believe the Board is comfortable with any reasonable language which will discourage the "chem lawn" approach to landscaping. Alan Cardinale subdivision After the Trustees inspected the above-referenced site on 9/6/90, I informed Mr. Alan Cardinale, Jr. (,project manager) that the Board would not entertain a waiver or permit for those activities which have taken place on site within 75' of the wetlands. As a result, he has agreed~to remove all fill within 75' of the wetland line as depicted on his pending subdivision map. Since the activities on site clearly intercept and violate the intent and spirit of the pending C & R's before the Planning Board, this office requests continued suspension of any Planning Board action until the matter is cleared. In light of this violation and the intensity of land use already' commencing on site, the Trustee Office requests the Planning Board to consider an additional C & R prohibiting all managed turf and fertilizer requiring plantings on the entirety of Lots 1, 2, 3, and on the R-80 zoned portion of Lot 4. If the applicant can not abide by this request, I will ask the Trustees and the CAC to formally request the Planning Board to rescind its negative declaration pursuant to $.EQ.R.A. Box 1179 Southold, New York 11971 SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL To' From: Dated: Re: Southold Town Trustees Southold Town Conservation Advisory Council April 4, 1991 Recommendation of Wetland Applications On a motion by Bruce Loucka, seconded by John McCormick, it was RESOVLED to recommend to the Southold Town Trustees disapproval of Wetland Application No. 78-5-16 of James Grathwohl to construct a single family dwelling, sanitary system, well, bluestone driveway and construct a dock consisting of: 4' x 10' fixed elevated (4' above grade) walk; 3' x 16' hinged ramp; two 6' x 16' floats secured by three 8" diameter pilings. The CAC recommends disapproval because the house and septic system would be within the 100' wetland buffer area and the leakage from the cesspool could be excessive with the buffer area. The CAC recommends disapproval of the ramp and dock because it extends 29' out into the channel, going half way across the channel and would result in hazardous navigation of the channel. On a motion by John Hoizapfel, seconded by Cynthia Sturner, it was RESOLVED to recommend to the $outhold Town Trustees disapproval of Wetland Application No. 116-4-16.4 of Neil McGoldrick to maintenance dredge a channel within Halls Creek and approach channel from Freat Peconic Bay. The Council recommends disapproval 13ecause it feels that this application cannot be considered a maintenance dredging project and suggests the applicant reapply not as a maintenance project but as an original dredging project. ~ Private road off New Suffolk Avenue, Mattituck Vote of Council: Ayes: All Motion carried. On a motion by Bruce Loucka, seconded by John Holzapfel, it was RE$OVLED to recommend to the Southold Town Trustees approval with stipulations of Wetland Application No. 70-6-9 of Renato Starcic to constuct a 4' x 95' fixed elevated (4' above grade) pier (including inclined ramp on inner end). Install three mooring pilings. The Council recommends approval if the proiect length is cut down so it soesn't interfere with anyone already moored. The Council feels the proiect, as submitted, is too long and will present navigational problems since moorings are already present. Oaklawn Avenue, Southold Vote of Council: Ayes: All Motion carried. Page 2 On a motion by Betty Wells, seconded by John McCormick, it was RESOVLED to recommend to the Southold Town Trustees approval of Wetland Application No. 103-10-28.1 of Henry A. Boczek to install a 6' x 20' floating dock and 12' x 4' ramp and two mooring piles at end of existing dock. 1370 Strohson Road, Cutchogue Vote of Council: Ayes: All Motion carried. On a motion by Stephen Angell, seconded by Cynthia Sturner, it was RESOVLED to recommend to the $outhold Town Trustees conditiona approval of Wetland Application No. 70-13-20.3 and 20.4 of Joseph Cornacchia to construct 308 I.f. of bulkhead within 18" of existing functional bulkhead, including 20 l.f. to close opening to naturally filled channel; drede lagoon to average 4' below MLW yielding estimated 3900 c.u. of spoil; use spoil to backfill behind new bulkhead, to backfill non-functional channel and to nourish beach. The Council approves the bulkheading as submitted. The Council approves the dredging with the condition that the project "link up" with the Koke dredging project after it receives DEC approval. The dredging should not be done if there wil be no link up because it would create a "pothole" and prevent proper flushing. The dredging should not commence until the Koke project is complete. Of course, recommendation of conditional approval is to be considered only after the ownership of questionable areas is established. Kimberly Lane, $outhold Vote of Council: Ayes: All Motion carried. On a motion by John HOlzapfel, seconded by Bruce Loucka, it was RESOVLED to recommend to the $outhold Town Trustees disapproval of Wetland Application No. 110-7-12 of Pequash Club to construct a timber bulkhead 100' long with a 10' return. The Council recommends disapproval because the bulkhead may destroy the beach in front of it. The beach should be stabilized by planting natural vegetation (beach grass, etc.) and keeping people off the beach. Concrete only exacerbates the situation. Fleets Neck Road, Cutchogue Vote of Council: Ayes: All Motion carried. On a motion by Stephen Angell, seconded by Bruce Loucka, it was RESOVLED to recommend to the Southold Town Trustees approval of Wetland Application No. p/o 122-3-14 (lot 3) of Alarn Cardinale to construct a catwalk, platform ramp and float to piles. The Council suggests the applicant extend the catwalk and send the ramp from the catwalk to float and eliminate the stairs. Vote of Council: Ayes: All Motion carried. Box 1179 Southold, New York 11971 SOUTttOLD TOWN CONSERVATION ADVISORY COUNCIL To: From: Dated: Re: Southold Town Trustees Southold Town Conservation Advisory Council February 13, 1991 Recommendation of Wetland Applications The following recommendations were made by the Council at its meeting held Thrusday, February 7, 1991: On a motion by Stephen Angell, seconded by Margaret Feeney, it was RESOLVED to recommend to the Southold Town Trustees approval with limitations on Wetland Application No. 1'11 - I of Thomas Samuels to maintenance dredge a channel 30+' x 1440_+' to maximum depth 6' below MLW with spoil to be used as beach nourishment on southwest side of Fisherman's Beach. The CAC approves if the dredgin9 depth is limited to 4'. The Council feels that 6' is too big, 4' is adequate for most pleasure crafts in the area and the Council is concerned that the 5' depth would create potholes and problems to the surrounding water and shellfish. Vote of Council: Ayes: All Motion carried. Application No. 12-2-90-78-5-16 of James Grathwohl was tabled pending receipt of the landscape plan, buffer zone and placement of a retaining wall as requested by the Board of Trustees. On a motion by Stephen Angell, seconded by Bruce Loucka, it was RESOVLED to recommend to the Southold Town Trustees approval with su99estions of Wetland Application No. 12-4-90-123-10-1 of Panagiotis Gazouleas to construct a single family dwelling, attached decking and associated sanitary system. Construct a 4' x 30' fixed dock, 3' x 10' ramp and 6' x 20' float. The Council approves the house as submitted with the stipulation that the applicant follow the checklist the CAC submitted to the Trustees in a letter dated February 9, 1990 which requires roof gutters and drainpipes, no runoff by grading, straw bales during construction, no planting requiring fertilization and heavy watering within 75' of wetlands, etc. The Council approves the dock with the suggestion that the two floats be turned 90° to plan so it would be in line with the last adjacent dock. Vote of Council: Ayes: Ail Motion carried. On a motion by John Holzapfel, seconded by Cynthia Sturner, it was RESOLVED to recommend to the Southold Town Trustees approval with stipulations of Wetland Application No. 24-2-11 to remove existing dilapidated docking facility and replace in-kind, in-place, a 4' x 28' fixed timber dock, 3' x 16' aluminum ramp, 6' x 20' float dock and two 2-pile float support dolphins. The Council approves provided the proiect does not interfere with the adjacent Page 2 ~--. neighbors navigation and dock. Vote of Council: Ayes: All On a motion by Bruce Loucka, seconded by Cynthia Sturner, it was RESOLVED to recommend to the Southold Town Trustess disapproval of Wetland Application No. 50-3-6 of James Bitses to construct a small flood control gate; small semi-circular berm penetrated by a four inch pipe with gate valve , six feet in diameter and two feet high. The Council recommends disapproval until an engineers report is submitted to determine Lhe results of 2", 3" etc. of rain (will it flood the road?). Vote of Council: Ayes: All Motion carried. On a motion by Stephen Ang,eIl, seconded by Margaret Feeney, it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 111-1-16 by Frank Curran to replace (within 18" 101 l.f. of existing timber bulkhead, install one 10" mooring pile and dredge a 21' x 25' boat basin to 4' below MLW.
