Box 728 Southold, New York 11971 Tue, Jul14,1987 RE: Request for wetlands permit waiver for Lot 15-8-24 in Orient Dear Sir/Madam: We have been notified that a violation of the Code of the Town of Southold (Chapter 97, Article II, Section 97-20) occurred as a result of work done on property owned by us. Given the nature of the work done, we are formally requesting a waiver of the requirement for obtaining a wetlands permit. A determination was made by the Planning Board that "....tz~e su~ey indicate th~ fl~d plMn " and that "... a~prov~ ~ review hy ~ ~p~tment of~v~onment~ Con.traCon" be obtained prior to Article 6 approval. The environmental Hrm of LAND USE (Wading River, ~) was ~niacted and ~ inspection of the property was done. They reporte~ ~o ~ that the property lines were not well demarcated ~d a determination or where the we~ds beg~s or ends is d~ficult, They asked us to clear some brush along the survey l~es and install markers at each su~ey pGmt. The surveying firm of VAN TYLE (Greenpo~t, NW) w~s ~structed to go back to ~e property and install the requested markers. Van Tyle's records of lhe property indicated that most of the markers were installed and simply clearing the brush would reve~ them, New markers however, would have to be installed where the proposed set-off line was. Gary Tabor, a l~al professional landscaper (who in the past ma~tained clear passage along p~t of the right-of=way and ~ in.riot road) was ~structed to a~mpany the surveyor and clear the ne~ssary brush along the old survey lines and ~e new one. This work was ~mpleted in late Janu~y 1987. The noti~ of violation was received ~ February. Though we realize lhat ignoran~ oi the law is no excuse, we were rather disappGmted that three land use professionals failed to i~orm us that this work may require a permit. JUSTIFIC&TIOI~ OF REQUEST Eventhough the work has been completed and no additional new clearing near the wetlands is anticipated, we were informed by Officer Dzenkowski that a request for a waiver must still be submitted. The affected area was along the installation of marker F where a small pond appears (see enclosed map). To get to this point, Mr. Tabor cleared (but did not uproot) an approximately 30 by 6 foot strip of dried cattails. The marker lies directly at the base of the pond. The remaining survey line work involved re-clearing the existing Cedar Birch Road. For at least two seasons this road was left unattended. Mr. Tabor cleared this private road and was told to deposited the debris in piles on our land. (The actual road belongs to Mr. Cantwell, but our deed allows us a right-of-way.) Upon conducting this work, Van Tyle found all the remaining markers and placed new posts with flags. We realize this area is of special concern to the Town of Southold. Past history has indicated a strong desire to preserve the pond and surrounding environs. Our initial reasons for doing this work center around environmental preserv~tion. If LAND USE INC. determines that the southern area of this lot is likely to be defined as a wetlands, then our application to subdivide will in all probability be withdrawn. However, the precise po'mt at which a wetland starts and stops is extremely difficult to determine. To allow this determination to be made, we l~.ad to demarcate the property precisely. Unfortunately one of the survey markers came directly up against the pond. This is the work for which we are requesting a waiver.
