Consulting Inc.,on behalf of CHARLES CAPPELLINO, applied to the Southold Town Trusteesfor a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated August 18, 1995, and, WHEI~EAS~ said application was Conservation Advisory Council recommendations, and referred to the Southold Town for their findings and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on October 26, 1995, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 37-18 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approves the application of CHARLES CAPPELLINO to construct approx. 100' of timber bulkhead, and backfill with 200+/- c.y. of clean sand to be trucked in from upland source, bulkhead will be constructed in-line with similar structure on adjoining properties, and re-vegetate as per Allan Connell's planting plan. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. Permit to construct project will expire two years from the date it is signed if not started. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Should some emergency or need to locate the owner of a certain s~ructure or mooring (if structure brakes loose), the permit number clearly visible will enable the Bay Constable or others to locate the area. B. Each visible permit number displayed shows that you have followed the procedure necessary for the particular structure or mooring. Those who do not have a number will warrant investigation and possibly a fine. Numbers should be at least 3" high and printed in contrasting black and white. The numbers should be placed on bulkheads, on the fixed portion of the dock as well as the floating portion of the dock. Floats tend to get loose in storms and this way the owners can be found.. The simplest way is to use a piece of Board painted black with the required 3" white letters painted on it. This then could be nailed to the seaward side of the structure so it can be seen from the land or the water. The floating docks can have the numbers carved in them. This way it won't fall off. Moorings and stakes can have the numbers painted on as well as the sticker that is handed out every year. Your cooperation is greatly appreciated. 6/95 Albert J. Kmpski. Any debris or excess material from construction of this project shall be completely removed from the adjacent area (upland) and removed to an approved upland area for disposal. debris is permitted in tidal wetlands and or protected buffer areas. 2. The storage of construction equipment and materials shall be confined to within the project work site and or upland areas greater than 50 linear feet from the tidal wetland boundary. 3. Ail fill shall consist of "clean" gravel and soil (not asphalt, slag, flyash, broken concrete or demolition debris). 4. No excavation of the beach is authorized for the purpose of obtaining fill or stone materials. 5. Ail peripheral berms, cofferdams, rock revetments, seawalls, gabions, bulkheads etc. shall be completed prior to placement of any fill material behind such structures. 6. Equipment operation below apparent high water is strictly prohibited. 7. Prior to any construction or removal of bulkheads'and other shoreline stabilization structures all backfill shall be excavated landward of the bulkhead and retained so as not to ente~r thee waterway, tidal wetland or protected buffer area. The per,it sign enclosed with the permit shall be protected from the weather and posted in a conspicuous location at the work site until all authorized work has been completed. The permittee shall require that any contractor, project engineer, or other person responsible for the overall supervision of this project reads, understands, and complies with this pez-mit and all its general, special, and supplementary special conditions. Any failuare to comply precisely with all of the terms and conditions of this permit, unless authorized in writing, shall be treated as a violation of the Environmental Conservation Law. If any of the permit conditions are lunclear, the permittee shall contact the Division of Reglllatory Affairs at the address on page one or telephone (516) 444-0365. If project design modifications become necessary after permit issuance, the permittee shall submit the appropriate plan changes for approval by the Regional Permit Administrator prior to undertaking any such modifications. The permittee is advised that substantial modification may require submission of a new application for permit. At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion of the permitted work, the bottom portion of that form shall also be signed and returned, along with photogr_aphs of the completed work and, if required, a survey. Pot projects involving activities to be undertaken in phases over a period of more than one year, the permittee shall notify the Regional Pel-mit Administrator in writing at least 48 hours prior to recommencing work in subsequent years.
