Dear Ms. Scopaz: Despite earl{er understandings, it came to our attention last week that the Planning Board now feels that they wlll require an approved Site Plan for subject work. Please be advised t~at this project entails the positioning of six (6) floats adjacent to an existing bulkhead for six (6) boats to permit transient docking for boaters to use the restaurant facilities. There are no upland services such as parking, elgctrical, water, sanitary, and so forth required. As defined in Section 100-250 of the Southold Town Code, there is no work proposed that will effect the characteristics of the site in terms of parking, loading, access, drainage, open space, our utilities that would seem to necessitate site plan approval. If it is the Planning Board's decision that a Site Plan is required, we will comply witI~ same, even though it is both our opinion and from a legal one that the Code does not require same. Also we are concerned because of the recent stated backolog of work in the Planning Department, that the review and approval of a site plan would cause extraordinary and unnecessary hardship to the Owner, and would in effect probably negate the applicant being able to have these facilities for use for this tourist season. Ms. Vararie Scopaz May 25, 1989 Page 2 A second reason for concern is that the other agencies are well along in their permit process. The Planning Board's position is that a si~e-pla~ should have been submitted for the conversion of the fishing station into a restaurant. Dear Ms. Scopaz: Despite earlier understandings, it came to our aStention last week that the Planning Board now feels that they will require an approved Site Plan for subjec$ work. Please be advised that this project entails the positioning of six {6) floats adjacent to a~ existing bulkhead for six {6) boats to permit transient docking for boaters to use the restaurant facilitieso There are no upland services such as parking, electrical, wa~er, sanitary, and so forth required. As defined in Section 100-250 Of the Southold Town Code, ~nere zs no work proposed that will effect the characteristics of the site in terms of parking, loading, access, oraznage, open space, our utilities that woulO seem ~o necessitate site plan approval. If it is the Planning Board's oecision that a Site Plan i5 required, we will comply with same, even though it is both our opinion and from a legal one that the Code does not requzre same. Also we are concerned because of the recent staked back-log of work in the Planning Department, that the revzew and approval of a site plan would cause extraordinary and unnecessary hardship to the Owner, and would in effect probably negate the applicant being able to have these facilities for use for this tourist season. Ms. Vararie Scopaz May 25, 1989 Page 2 A second reason for concern is tha% the other agencies are well along in their permit process. The question of whether an action may be significant is not always easy to answer. Frequent- Iy, there are aspects of a proiect that are subjective or unmeasureab]e. It is also understood that those who determine significance may have little or no formal knowledge of the environment or may be technically expert in environmental analysis. In addition, many who have knowledge m one particular area may not be aware of the broader concerns affecting the question of significance. The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature, ~et flexible to allow introduction of information to fit a project or action Full EAF Components: The furl EAF is comprised of three parts: Part 1: Provides objective data and information about a given project and its site [3v identifying basic project data, it assists a revmwer in the analysis that takes place in Parts 2 and 3. Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action It provides guidance as to whether an impact is likel~ to be considered small to moderate or whether it is a potentially- large impact The form also identifies whether an impact can be mibgated or reduced Part 3: if any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the impact is actually important.
