Moved by Trustee Bredemeyer seconded by Trustee Larsen ..: WHEREAS, on 6-23-86 Trustee Bredemeyer visited the site of proposed pond excavation of Mr. Cantwell and noted set stakes 40' from pond in the same location as Bay Constable and myself had noted last mont~ and in same location as pointed out be Mr. Cantwell at meeting of his request on 6/12/86 in presence of Cedar Birch Lane resident, Mr. Earl Wilson, and WHEREAS, this location is inconsistent with the current application of Mr. Cantwell which locates the proposed pond edge 50' from the existing basin, and WHEREAS, the scaled cross-section submitted by Mr. Cantwell is not drawn to scale and through the pond as requested and is minus the width dimension, NOW, THEREFORE, BE IT RESOLVED that the application submitted by Herny E. Raynor, Jr. on behalf of Richard Cantwell be and hereby is TABLED and it is further directed that all materials be returned to Mr. Cantwell until such time as he can properly prepare and submit a plan certain, with a copy of a conforming New York State D.E.C. As I have advised yo~, if you are concerned with the dredging to close to the bank to a depth of three feet, the Trustees can put a provision on the permit that the dredging is to be done on a one to three ft. slope. Moved by Trustee Bredemeyer seconded by Trustee Larsen it was RESOLVED to TABLE the Wetland Application submitted by Henry Raynor on behalf of Richard Cantwell for a wetland permit on certain property located on the Main Road, Orient, until a licensed survey and topographical map, showing contours at one-foot intervals and indicating monuments is submitted along with specific information regarding the amount of cubic yards of dredging and where the spoil will be placed. RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Richard Cantwell for a Wetland Permit on certain property located on Main Road, Orient, New York. The Trustees want you to submit a licensed survey and topographical map, showing contours at one-foot intervals and indicating monuments. The Board would like to have exact plans for the project also, such as where the spoil is to be placed? Area that is to be dredged? Cantweli to dredge approximately 18,600 cu. yds. to enlarge and connect two existing irrigation ponds, Main Road Orient. The Trustees reconmend disapproval of this application because of the irreversible damage to the spartina ring around the pond. They felt that a project of such size would puncture and possibly irreversibly damage the water supply. The project directly faces a number of residential homes along Cedar Birch Drive and could directly affect the water supply. Mr. Cantwell has,been requested by the Council to make two test wells and submit the results of them to the Council. Also, The Council has tabled the application submitted by Thomas Samuels. Mt.Samuels was requested to submit a commitment to restore the alternaflora that would probably be destroyed in the process of completing the work as outlined in application # 212. RESOLVED to recommend to the Southoid Town Board approval of the wetland application # 218, submiited by Willow Point Property Owner Association, to maintenance dredge. Application approved providing dedging depth will be no 'more than 1 on 2 slope or 8 ft away from existing spartina grass before final depth is reached. The Council recommends that in all cases~ spartina be preserved with 8 foot buffer and excavation creates on,y 2 to 1 clope into channels. His application states 18,600 yards are to be excavated. Many years ago when Edwin H. King ~armed this land, he used the northernmost irrigation ditch to irrigate his land. He had to abandon this irrigation ditch because he pulled salt water. Persons presently living on Cedar Birch Road are witness to the fact that during extremely high tides, the water overflows the banks of this irrigation ditch. The southern "irrigation ditch" is actually a pond dug by ~r. King for his own pleasure. It was never used for irrigation. The water in it is brackish. The fresh water in this area is very fragile, and there is considerable concern that further cutting into the fresh water lens to form such a large pond or lake could very possibly cause salt water intrusion that would affect the drinking water of all the people living on. The northerly pond was originally made by Ed King as an irrigation pond for his farming operation but was abandoned due to saltwater i~tru- sion. I have been informed that the water in both ponds will fluctuate with the tides. In the area of the ponds there is spartina growth. In view of the above, a wetlands permit would be required under Wetlands Ordinance Chapter 97, ~rt. II, Sec. 97-20, since conditions exist as defined under Art. Because of the scope of this project, it is probable that neighboring wells would be intruded with salt water. Our water table is at best described as fragile and unless concrete proof is provided to those of us who would be affected, (i.e. assure us that the ground water level would not be affected) the project application should be denied. Will you order an EIS ? We are counting on you to pro~ect our water supply. Since I moved here in 1971 I have had to put down 2 well points, and since we have such a shallow aquifer, this situation is delicate--the next time there may be no place to go.
