RESOLVED that pursuant to Article 8 of the Environmental Conservation
Law, State Environmental Quality Review and 6NYCRR Part 617,
Section 617.10 and Chapter 44 of the Code of the Town of Southold,
notice is hereby given that the Southold Town Trustees, as Lead
Agency for the action described below, has determined that the
project will not have a significant effect on the environment.
Please take further notice that this declaration should not be
considered a determination made for any other department or agency
which may also have an application pending for the same or similar
project.
TYPE OF ACTION: Type: I
DESCRIPTION OF ACTION: Applicant requests a Wetland Permit to remove
and replace in same location 68 1.f. of existing functional bulkhead
and place 25 c.y. of backfill, construct 52' of new bulkhead
appurtenant to existing structure, all as per NYSDEC approved plan
date 12/30/94. Located 55955 County Road 48, Southold.

REASONS SUPPORTING THIS DETERMINATION:
I. An on site inspection has been conducted by the Board of
Trustees.
2. An environmental assessment, submitted by the applicant and
reviewed and completed by the Board of Trustees, has indicated that
no significant adverse effects to the environment are likely to occur
should the project be implemented as planned.

WITH REQUEST of the Wetland Application of HELEN M. AND
ROBERT W. RUST 111-~4-34 to replace approximately 104' existing
bulkhead in-kind, in-place. Backfill With 20 c.y. clean fill from
approved upland source. The Council recommends approval but
request the applicant maintain a 10' natural vegetative buffer behind
the bulkhead.

RESOLVED to recommend to the Southold Town Trustees APPROVAL
WITH STIPULATIONS of the Wetland Application of RUSSELL McCALL
116-6-7 to remove approximately 2000 c.y. of fill. concrete and
other debris dumped in marsh by previous owner. Present owner
seeks to install disturbed area to former condition as a marsh and to
re-establish tidal flow via presently blocked drains to marsh to
east. He does NOT intend to develop or otherwise build upon this
property. All material removed will be disposed of in Town of
Southold landfill or other suitable location.
The Council approves the project provided the applicant does not
leave a ',hole in the ground". The CAC recommends the applicant
contact the Cornell Cooperative Extension or an environmental
consultant to provide assistance and knowledge to reestablish the
marsh quickly and in an environmentally sound way.

It is my/our understanding that we are to maintain this
structure with materials designed to endure 30 years and or
equivalent to the original approved structure and that for any
maintenance which involves more than 5% in length of this
structure we are to give prior written notice to the
administrator, waiting for their approval in all-but true
emergency situation's which would seriously endanger life,
property and important coastal natural resource features such as
bluffs or wetlands. We further understand that failure to
maintain the structure could result in a requirement to post a
bond and or have the repairs ordered as a lien against the
property upon a finding by the Trustees that said lack of
maintenance would risk life, property or important natural
resources features including protected, rare or threatened
animals and plants.

2. The Departed'ant reserves the right to rrodif¥, suspend or revoke this permit when:
a) the scope of the permitted activity is exceeded or a violation of any
condition of the permit or provisions of the ECL and pertinent regula-
tions's found;
b) the permit v~s obtained by misrepresentation or failure to disclose
rel avant facts;
c) nevvna[erial infomation is discovered; or
d) enviromuntal conditions, relevant tachnology, or applicable law or
regulation have notarial Iy changed s~nce the permit was issued.
The permittee rrust submit a separate written application to the Depar~unt for
rene.~l, rrodification or transfer of this permit. Such application rrust include
any fonTS, fees or supple-rental infou~'ution the DeDarm-ent requires, Ay
renewal, rrodification or transfer granted by the lDeparlzT~ntrrust be in writing.

Legal Cbligations of Permittee
The permittee has accapted expressly, by the execution of the application, the
ful legal responsibility for all daT~ges, direct or indirect, of whatever
nature and by vvhcrr~ver suffered, arising out of the project described in this
permit and has agreed to i ndumify and save harmless the State frQ-n suits,
actions, dotages and costs of every n~ and descrip[ion resulting fr~n this
project.
This permit does not convey to the permittee any righ[ [o trespass upon the
lands or interfere with the riparian rights of others in order to perfon'fl the
permitted ~ork nor does it authorize the irrpairuunt of any rights, title, or
interest in real or personal property held or vested in a person not a party to
the permit.
The permittee is responsible for obtaining any ,other permits, approvals, lands
easements and rights-of-way that nay be required for this project.

SPECIAL CONDITIONS
Tidal Wetland
For Article_ ( I
Ail repairs to existing structures are confined to
replacement of existing structural elements with no
change in design, dimension or materials unless specif2
ically authorized herein.
Any bulk~head constructed directly adjacent to vegetated
tidal wetlands must be jetted in with minimal distur-
bance to tidal wetlands. Trenching is strictly prohib-
ited.
Construction of bulkhead and return walls must be
completed prior to placement of any fill materials
behind such structures.
Ail fill must consist of clean rock, gravel, sand and
soil. Use of asphalt, slag, fly ash, broken concrete
or demolition debris is prohibited.
Ail fill must be graded to match the elevation of the
land immediately adjacent to the bulkhead.
Any debris or excess material from construction of this
project must be immediately and completely removed from
the adjacent area and disposed of at an upland site.
Disposal of debris in tidal wetlands is prohibited.
