Campbell 257 D~nbar Road Palm Beach, Florida 33480 Re: SCTM ~.4-4-16 Dear Mrs. Campbell, An inspection of the remains of your guest cottage on Fishers island at SCTM ~4-4-16 made on December 17, 1993 by the Southold Town .Trustees revealed that you have demolished the original structure. Consequently~your project is viewed as a substantial restoration which is fully subject to the requirements of both the Town Coastal Erosion Hazard Area Ordinance (Chapter 37) and the Town. Wetland Ordinance (Chapter 97). The previous waiver granted for the minor additions, is not operative and the fact that you are replacing more than 50% of the value and surface area of the original structure mandates that minimum bluff setbacks of 50' be established for this site. Any proposal for a structure closer to the bluff than this will require a variance application under the Coastal Erosion Ordinance (Chapter 37). Please complete the attached application form and submit a licensed land survey of'what you propose. Your proposed setback will affect the jurisdictions involved and the application fees which will be set by the clerk. FOr bluff .setbacks in excess, of' 50' the Board of Trustees may only require a. Town Wetland Permit or Waiver. These requirements are separate from and in addition to other permissions which may be req/lired by.other agencies. Thank you for your cooperation. Yours truly, ~hn M. Campbell on Fishers Island. We had received a waiver from you dated 4 May 1993 allowing the construction of the addition to the guest cottage. (Copy attached) As construction began last month, it immediately became apparent that the .Wood structure of the existing cottage was seriously rotted and that using it as the basis for an addition.was inappropriate. The wood structure was removed. The block foundation walls still remain. However, as it was discovered that these block walls lack footings, we now see that they, too, are inadequate for reuse. This reconstruction will entail no change t.o the uses that have existed on the property for many years. Even if the cottage.were not rebuilt on its old site, the site would still be in a disturbed condition, withlan existing old foundation wall in place and lawns surrounding it. Box 421, Mystic, CT 06355 (860) 572-8939 Fax: (860) 572-7569, e-mail: docko@snet.net January 18, 2005 Dear Mr. Krupski: Re: Rolla Campbell Property Boat Lift Variance Last summer the Board of Trustees approved the removal of a floating dock and ramp and extension of the fixed pier including an "L' shaped end pier for Rolla and Klm Campbell's property in East Harbor on Fishers Island. Part of their original application was the installation of a boat lift as well. We would like to know if the Board of Trustees would be agreeable to reconsidering the boat li~ since it was not approved as part of the dock modification application. We understand that the dock ordinance prohibits the installation of boat lifts. I feel however that there are mitigating circumstances in East Harbor that are beyond the considerations emphasized when the ordinance was adopted. The water in East Harbor is usually wavy and can be rough when there is a west or especially northwesterly, wind. The waves build with significant fetch in Fishers Island Sound and as the water depths become shallow in East Harbor, especially at low tide, the waves build toward the breaking point in the vicinity of the Campbell's dock. This is a tough environment to put a boat in the 20' to 35' range and during such conditions the vessel will stress and wear the fie-offlines significantly and even damage the cleats or guides on the vessel. This was the justification behind the boat lift installed at the Balcom's property next door in the 90's. We feel that this is an urgent consideration for the Campbell's for boating to be realistic and for the safety of the Campbell's and the equipment to be maximized. Conditions in the Sound can change quickly; smooth water at departure does not guarantee smooth water upon returning. It would be greatly appreciated if you would reconsider this; we would be agreeable to making a presentation or visiting with you at the site at your convenience to observe these particular conditions. Again, we feel that the prohibition against boat lifts is a viable consideration in small creeks and protected areas, but this is not one of those areas. If you could let me know the consensus of the Board, we will pursue this further as appropriate. CC: Dr. & Mrs. Rolla Campbell File: 03-03-1409 CAMPBELL ~tfully submitted, (.0, INC.. B. Neilson, P.E.
