Box 1179 Southotd, New York 11971 October 4, 1993 En-Consultants, Inc. 1329 North Sea Road Southampton, NY 11968 Re: Eugene Burger SCTM ~1000-104-3-4 Dear Mr. Haje: The following action was taken by the Board of Town Trustees during its regular meeting held on Thursday, September 30, 1993 regarding the above matter: WHEREAS, En-Consultants on behalf of Eugene Burger applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated July 6, 1993 and, WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a public hearing was held by the Town Trustees with respect to said application on Thursday, August 26, 1993 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE BE IT RESOLVED that the Board of Trustees approves the application of En-Consultants on behalf of Eugene Burger to construct a timber dock consisting of a 4' X 40' fixed elevated (min. 4' above grade of marsh) pier (plus steps), a 3' X 16' hinged ramp, a 6' X 16' float secured by (2) pilings. Place approx. 10 c.y. of sand and grade into a berm approx. 3' wide at the base and 1.5' high to extend the width of the parcel (68+/-), above AHW and wetlands. Following grading berm will be planted with Ammophilia Brevilig~lata on 18" centers. All in accordance with revised map dated September 26, 1993. Permit will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Two inspections are required and the Trustees are to be notified upon completion of said project. Enid Rot~leder, Pine Tree Road, Cutchogue, which has just come by chance to my atten- tion, I believe that this letter may have been sent in error~ and was intended for me. Please note: Although no street number is given for N~rs. Rothleder, her address is in fact 2110 Pine Tree Road, and her property is not "located adjacent" to the Burger property at 2515 Pine Tree Road, but across the street at a short distance. No "sketch or plan" was enclosed with the letter. Finally, although the notice itself is undated, the envelope gives the certification date as April 5. Had I kno-~a of this letter at the time, or better still, received one properly address- ed to myself, I would have asked the Board and the Burgers to locate the two large floats north in an L-shape from the end of the dock, rather than in the present T-shape~ which places 20~ o~ the T close to my property llne (that is, to my vision and hearing). The Burger property seems to be at least twice the width of my 65~, and therefore the L portion would not intrude upon the neighbor on the other (north) side of the Burgers. I understand that it is still possible (failure to notify) at least to that extent, some:relief at this time. to rectify this error and shall appreciate Thank you.
