prejudice, as the Board feels there is sufficient water depth.

Dear Mr. Haje::
The following action was taken by the Board of Town Trustees
during its regular meeting held on November 30, 1995 regarding
the above matter:
WHEREAS, En-Consultants on behalf of RITA BAUER c/o CHRISTIAN
BURKE applied to the Southold Town Trustees for a permit under
the provisions of the Wetland Ordinance of the Town of SouthoId,
application dated November i, 1995, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on November 30, 1995, at which time
all interested persons were given an opport%ulity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation s~bmitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees grants a Wetland Permit to
Eh-COnsultants on behalf of RITA BAUER c/o CHRISTIAN BURKE to
remove and replace (IK/IP) 46 t.f. timber bulkhead. Construct a
5' extension to east side of bulkhead. Backfill with 15 e~y. of
clean material to be trucked in'from upland SoUn~ce. Const~ct a
3' X 20' catwalk landward of bulkhead an~ a I8' X 10' platform
landward of bulkheadf construct 3' X 23' catwalk; 5' X I2' ramp
and 6' X 25' float. Southwest corner of float shall be no
further out than 2S'. A 20' buffer area landward of bulkhead
will be established where no fertilization will occur as per the
Natural Resources Conservation Service.

BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct project will expire two years from the date
it is signed if not started. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

At the meeting of the Southold Town Conservation Advisory Council held
Thursday. November 28. 1995, the following action was taken:

Moved by Bruce Loucka, seconded by Allan Connell, it was
RESOLVED to recommend to the $outhold Town Board of Trustees APPROVAL
WITH STIPULATIONS of the Wetland Application of CHRISTIAN BURKE
71-1-~1 to remove and replace (in kind/in place) 46 I.f. timber bulkhead.
Construct a 5' extension tc east side of bulkhead. Backfill with 15 c.y. of
clean material to be trucked in from upland source. Construct a dock
consisting of: 3' x 28' catwalk; 3' x 12' ramp; 6~ x 25' float. Also a 3' x
20' fixed walk extending landward of proposed bulkhead and 10' xl0' timber
platform located east of said walkway.
A 20' buffer area landward of bulkhead will be established where no
fertilization will occur as per the Natural Resources Conservation Services.
The CAC recommends approval with the stipulation that the catwalk be
moved 15' from the western property line and shortened to be in line with the
neighbor to the west.

Dear Trustees:
Your permit ~4543 authorized a dock which included a 3'
X 23' fixed catwalk. If you recall, this is a 5'
reduction over that which was originally requested. Your
decision was based upon estimated water depths taken by
my client.
Upon receiving the permit, Mr. Burke informed me that the
soundings were not taken at the lowest low tide and
further, that water depths are decreasing due to sand
accumulation along the west side of the property.
Therefore, it is imperative that we regain the 5' of
fixed '~alk. -
Would you kindly reschedule this matter so that an
amendment can be granted.

7:23 P.M. In the matter of EN-CONSULTANTS on behalf of PAOLO
LAVAGETT~D requests a Wetland Permit to modify the floating portion of
an existing dock. The 2 existing 6' X 20' floats in a "T" shape will
be relocated and a 4' X 23' float added to form a "U" shape. Floats
will be secured by a total of (8) pilings. Proposed float arrangement
will afford more protection to boat and will allow easier access.

TRUSTEE KRUPSKI: Is there anyone here who wishes to speak on behalf
of this application.
DIANE: From Eh-Consultants. Two months ago we went to apply for an
amendment and there was an objection raised to the amount of bottom
coverage. Since then I had an occasion to speak with Ms. Lavagetto.
She insists that she needs the "U" shape because there is wave and
wind action coming from the southeast causing boat to slam up against
the float. She insist that she needs this protection, sh~ agreed to
cut down the size of the two 6' X 20' floats to 4' X 20' ~keepin~ the
"U". I calculated the amount of bottom coverage, it results in an
increase of 12 sq.ft. She has 6' X 20' floats. She wanted to us them,
but she will get new ones.
TRUSTEE KRUPSKI: Any othe~ comment?
TEUST~ WENCZEL: Wllat can I say. It is rather large.

TRUSTEE KRUPSKI: Is there anyone here who wishes to speak on behalf
of this application?
ROY HAJE: The property as you can see from the survey of the sketch
that was prepared from the survey is ve~ irregular. Only a ~all
portion of shoreline is bulkheaded. It is from that bulkheaded.

section that we wish to construct our dock. We have placed it as fa~
to the west as possible. That is where the water is deeper. As you
bead to the east because of the configuration of the shoreline it
shallows out. We have it five feet from the propert~ line and have
gotten a letter from the adjacent owner, which I believe is in yoT~r
file, agreeing to that. We have also cantered the float off at that
angle in order to catch a 36" depth contour. The owner did order
depth soundings along the base of that bulkhead. The floating dock
location as is showr~ just about splits that 36" water depth. If you
go in any distance at all you don't have to go very fa~ before the
water shallows up quite drastically. If for example this was placed
at the same distance as the floating dock of the neighbor, which is
approximately 27' beyond the bulkhead, it would be in water of only
about 20". I don't really believe it would impact navigation, because
it is fairly wide there. The way both shorelines curve around, this
is actually parallel to the shorelines.
TRUSTEE HOLZAPFEL: Roy, the length of the dock on the adjacent
property you said was 28'?
MR. HAJE: The floating dock is located 27' out from the bulkhead.
Here is the soundings. We took it at 5' intervals. These numbers here
are the distances off the bulkhead that you have to get to that
contour.
TRUSTEE WENCZEL: What is with this 3' standard. You have to have 3'
at low water, is that the consciences?
MR. HAJE: I don't think that is to deep. Usually what the DEC will
allow, I am not saying it should be granted where it is going to
cause navigation problem, they will usually grant 4'
TRUSTEE KRUPSKI: When we went out there we took a look at it
structure wise compared to the neighbor. We try to de rule of thumb.
We went out there about mid tide and there was quite a bit of water
on the neighbors side. Because it is so close to the neighbors dock
you can see clearly. You can see what this applicant would have.
MR. HAJE: So are you saying to cut it back so that the ramp comes to
that?
TRUSTEE KRUPSKi: The floats will start there and then it would go out.
MR. HAJE: How far are you suggesting it go back?
TRUSTEE Kt{UPSKI: To the neighbor.
MR. HAJE: The outer corner would come out here?
TRUSTEE KRUPSKI: Yes.
MR. HAJE: That will be to shallow.
TRUSTEE KRUPSKI: Well if it is they can come in for an amendment.
TRUSTEE WENCZEL: From the bulkhead to the outside of this corner be

TRUSTEE HOLZAPFEL: We are just trying to stay consistent with the
other docks.
TRUSTEE GARRELL: Can you sketch that in.
MR. HAJE: I will sketch that in now. Instead of putting it out here,
we will put this corner on this depth contour. Out as far as this.
TRUSTEE KRUPSKI: That corner of the float will be at 28'?
MR. HAJE: Correct. This would be out, this is out. This puts him
right about at it over here. We have to shorten th~s up.
TRUSTEE KRUPSKI: O.K. You can give Jill a diagram tomorrow. We will
say that the inside of the float will be at the face of the
neighbors. Any other comment? Do I have a motion to close the
hearing?

based on the amendment diagram from the applicant showing the
southwest corner of the float to be 28' from the bulkhead.

7:25 P.M. In the matter of YOUNG & YOUNG SURVEYORS on behalf of
ROBERT COADY to construct a single family dwelling and related
improvements including driveway, sanitary system, Well, deck, shed,
3' X 110' elevated timber walkway, 3' X 25' hinged dock and a 8' X
25' floating dock. Located Southwest corner of Wilson Ave., & Beebe
Drive.,Ext., Cutchogue. SCTM ~103-9-1.
TRUSTEE KRUPSKI: ts there anyone here on behalf of this application?
MR. COADY: I am here if you have any questions.
TRUSTEE KRUPSKt: CAC recommends approval with the stipulation that
the applicant move walkway 15' from the property line and tLLrn the
floating dock straight and place haybales at the 7' contour.
MR. ANGEL: If he moves the catwalk and ramp over he would have to
move the float over so it doesn't infringe on the marsh.
MR. COADY: I don't care as long as I have enough water for a small
boat. I have know problem with that.
A motion was made by TRUSTEE WENCZEL and seconded by TRUSTEE GARRELL
to close the hearing. ALL AYES.
A motion was made by TRUSTEE KRUPSKI and seconded by TRUSTEE
HOLZAPFEL to approve application subject to new drawing showing dock
moved 15' off property line as per CAC Comments and haybales placed
as per DEC permit. ALL AYES.
V. ASSESSMENTS:
1. DANIEL MOONEY request a Wetland Permit to move existing house at
480 Rabbit Lane to across the street on new foundation. Pilings and
septic system will stay in place for future house. Located 480 ~hhit

PROJECT DESCRIPTION
Remove and replace (IK/IP) 46 1.f. timber bulkhead.
Construct a 5' extension to east side of bulkhead.
Backfill with 15 c.y. of clean material to be trucked in
from an upland source. Construct a dock consisting
of; 3' X 20' fixed walk; 3' X 28' catwalk; 3' X 12' ramp
and 6' X 25' float. Construct a 10' X 10' wood platform
eastward of proposed 3' X 20' fixed walk.
A 20' buffer area landward of bulkhead will be
established where no fertilization will occur as per the
Natural Resources Conservation Service.
Owner of adjacent property has agreed to the placement of
float 5' from property line, as it will not interfere
with usage of his dock. Location sl~own was selected as
water depth decreases to east at same distance from
bulkhead. Proposed location will keep dock as close to
shore as possible, while allowing 3' water depth at
float.

SITUATION: The landowner has requested planting recommendations
for a buffer zone above a new bulkhead that will replace an
existing damaged bulkhead. Thc Sou=hold Town Conservation
Adv~.sory Councel recommended he contact us,
A site inspectien was performed on November 8, I995 ~nd
i met Mr, Burke at the site. At present thC bulkhead is in
disrepair and failing. Soil is being lost through the bulkhead.
Repairs to the existing bu!kh~ad or replacement is warranted.
Land slopes towards the bulkhead and is presently planted to turf
type grasses. Mr. Burke has %old me a cat walk leading to a
floating dock will be a~d~d whe~ the new bulkhead is installed.
This will be Dlaced to th~ west sid~ of the bulkhead.
SUGGESTED SOLUTIONS: After completion of the bulkhead with the cat
walk~ plant the buffer zone to a salt tolerant and drought
tolerant ground cover. Choices for ground covers that are
suitable include: "Cape*~ American Beachgrass~ Rugosa Rose, and
"Emerald Sea" Shore Juniper. See the enclosed Plant Materials
sheets for specific plantin~ m~thods and times. Also enclosed you
will find a list of suppliers.

Thank you for submitting your Federal Consistency Assessment Form and Supporting information to
the Department of State (DOS)on November 6, 1995. DOS has determined that the submitted
documentation is adequate to commence our review of your proposed project. However, pursuant
to 15 CFR 930.58, the following data and information is necessary to enable the Department of State
to adequately assess the coastal zone effects of this proposed project.
· As noted on NYSDEC Tidal Wetland Map g716-546, the area of the applicant's parcel appears to
be surrounded by Intertidal Marsh (EM). Enclosed, please find a copy of ap #716-546. With a
marker, please identify the exact location of the applicant's parcel on this copy and return it with your
written response to this letter. This information would assist DOS in a determination of impacts of
the project on the IM and consistency of the proposed project with policies #19 and #44.
Please provide the information requested above to the Department of State within thirty days from
the date of this letter. Pursuant to 15 CFR 930.64(d), if this necessary data and information is not
prov/ded, the Department of State may object to your consistency certification on the grounds of
insufficient information.
Any additional flnformation which you believe will facilitate our consistency review of this project
Would be appreciated.
You and the Corps of En~neers will be notified of our decision when we have completed our review
of this project for its consistency with the New York State Coastal Management Programi The Corps
of Engineers cannot issue a permit for this project unless the Department of State concurs with your
consistency certification.
