Dear Mr. Haje,
The following action was taken by the Boardof Town Trustees
during its regular meeting held on May 26, 1994 regarding the
above matter:
WHEREAS, RICHARD BURDEN applied to the Southold Town Trustees
for a permit under the provisions of the Wetland Ordinance of
the Town of Southold, application dated Mar. 21, 1994,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on April 26, 1994 at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are.
familiar with the premises in guestion and the surrounding area,
and,
WHEREAS, the Board has censidered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
RICHARD BURDEN to replace (within 18") ~07 1.f. of existing
timber bulkhead and add 15' return on west side and a 20' return
on east side. New bulkhead will be 18" higher than existing.
Approx. 50 c.y. of spoil will be placed behind bulkhead as
backfill. Construct a 20'.X 40' swimming pool and decks
landward of bulkhead as shown on site plan of Van Tuyl.
Additional 75+/- c.y. of sand will be trucked in from upland
source.
Board did not approve the dredging part of this application as
they feel a more lengthy review is necessary. Therefore if you
wish to move ahead with dredging please fill out % separate
application and fee.
Permit will expire two years from the date it is signed. Fees
must be paid, if applicable~ and permit issued within six
months of the date of this notification. Two inspections are
required and the Trustees are to be notified upon completion of
said project.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH PROVISIONS of the Wetland Application of CHRIST STRATAKI$ 33-~--5
to reconstruct an existing stairway and platform arr~angement from top of bluff
to beach, A 6' x 6' shed will be built adjacent to the stairs for storage of
an outboard motor, oars, life vests, etc.
The CAC recommends approval provided the disturbed soil and fill behind
seawall is revegetated and steps be u,~ above slope.

New bulkhead will be 18" higher than existing. Dredge up to 10' in front to
maximum depth of 3t below MLW. Approximately 50 c.y. of spoil will be placed

bulkheading and backfill with approximately 50 yards of sand. Place
approximately 100 c.y. of sand on beach seaward of bulkhead as beach
nourishment. Reconstruct a new 6' x 150' timber
The CAE; recommends approval with the condition that all exposed areas be
revegatated. The Council also suggests the Trustees check into the town
installing a bulkhead at the end of the 'road.

The applicant, Richard Burden, has requested Department of the Army authorization to replace an
existing bulkhead and dredge mamrial from lames Creek, Great Pecoulc Bay at Matfituck, Town of
Southold, Suffolk County, New York wi~h subsequent upland disposal.
The work would involve replacement of 107 linear feet of bulkbead within 18 inches of the existing one
and ~onst~-fion of.15 foot refum on ~.e. west side and 20 foot return on east side. The new bulkhead
~ould be -18 inches higher than the existing one.' The applicant also proposes to d~edge 10 feet seaward
of the repl~ 10~kh.e~d. ~ to a depth of 3 feet below ~ Iow water, removing approximately 50
cubi~ ~d! of n~tedal~which W~uld be used as backfill behind the replacement bulkhead.
The slated purpose of the proposed work is to protect the applicant's proper~ ~from the effects of
erosion, and to prOvide adequate mooring depths.

bulkhead, and construct a 15 foot return on the.west, side and a 20 foot return on the
east side. The new bulkhead will be 18 inches higher than the existing one. Dredge
10 feet seaward of the replacement bulkhead to a depth of 3 feet below mean low water,
removing approximately 50 cubic yards of material to be used as backfil] behind the
replacement bulkhead. All work will be performed in accordance with the attached
drawings.

General Conditions:
1. The time limit for completing the work authorized ends on February 27, 1998 . If you find that you need
more time to complete the authorized activity, submit your request for a t/me extension to this office for consideration at least
one month before the above date is reached.
2. You must maintain the activity authorized by this permit in good condition and in conformance with the terms and condi-
tions of this permit. You are not relieved of this requirement if you abandon the permitted activity, although you may make
a good faith transfer to a third party in compliance with General Condition 4 below. Should you wish to cease to maintain
the authorized activity or should you desire to abandon it without a good faith transfer, you must obtain a modification of
this permit from this office, which may require restoration of the area.
3. If you discover any previously unknown historic or archeological remains while accomplishing the activity authorized by
this permit, you must immediately notify this office of what you have found_ We w/Il initiate the Federal and stase coordina-
tion required to determine if the rew~i-~ warrant a recovery effort or if the site is eligible for listing in the National Register
of Historic Places_
