To minimize encroachment on tidal wetlands the Board usually requires on inkind/inplace replacement of existing structures. In such a case, such as yours, a grandfattler permit zs all the that would be needed. If small changes in the structure are-desired, such as a set of stairs to access the water or a small increase in the height, it can be addressed by amending your permit.
