Dear Mr. Haje,
The following action was taken by the Board of Town Trustees
during its regular meeting held on March 24, 1994 regarding the
above matter:
WHEREAS, THOMAS BYRNE applied to the Southold Town Trustees
for a permit under the provisions of the Wetland Ordinance of
the Town of Southold, application dated, November 26, 1993, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on March 24, 1994 at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the Surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
THOMAS BYRNE to replace (within 18") an existing cement blockI
retaining wall 85' in length (plus 5' return on north side and
10' return on south side) with new timber wall approx.

Dear Mr. Haje:
The Southold Town Board of Trustees inspected the above
referenced project site on January 20, 1994. To minimize
encroachment on tidal wetlands the Board usually requires on
inkind/inplace replacement of existing structures. In such
a case, such as yours, a grandfattler permit zs all the that
would be needed.
If small changes in the structure are-desired, such as a set of
stairs to access the water or a small increase in the height, it
can be addressed by amending your permit.
No wetland permit would be required if this route, as outlined,
were followed.
This, of course, is a suggestion and you have a right to apply
for any activity.

RECOMMENDATION OF WETLAND APPLICATIONS
Moved by Bruce Loucka, seconded by John Hagerty, it was
RESOLVED to recommend to the Southold Town Board of Trustees
APPROVAL~ of the Wetland Application of THOMAS BYRNE 52-5-1
to replace (within 18") an existing cement block retaining wall 85'
in length (plus 5' return on north side and 10' return on south side)
· with a new timber wall approximately 1' higher. Approximately 45
c.y. of clean backfill to be trucked in from upland source. An
existing indented block stairway to be backfilled and replaced with a
4' x 8' wood stairway.

Moved by Robert Keith, seconded by Patricia Isaksen, it was
RESOLVED to recommend to the Southold Town Board of Trustees
APPROVAL of the Wetland Application of STEVEN SPARACINO
115-17-17.14 to construct an elevated timber walkway and fixed dock
structure. The walkway will be 4' wide by 70' long and a minimum of
4' above grade. The dock ,to be 5' wide and 20' tong and to be
situated on the seaward edge of the existing wetlands providing
access to the dredged creek.

The Southold Town CAC did not inspect the area of the Wetland
Application of W.L. LYONS BROWN. III 9-9-27.2 Fishers Island
project of a proposed dock and request for letter of jurisdiction for
proposed house, garage, deck. retaining wall. drive, patio, and
pool. The CAC may make comments at a later date.

property and important coastal natural resource features such as

Dear Trustees:
I have presented your recommendation to remove and re-
place the existing wall to the contractor.
Due to the elevation of the bulkhead, removal and re-
placement would entail excavation of a large amount of
fill material landward of it. In addition, the veqe-
tation immediately seaward of the wall is also likely to
be more greatly damaged and disturbed by removal rather
than by our proposal to replace within 18".
Accordingly, I request that you proceed with processing
of our application as submitted.
