SPECIAL CONDITIONS
During construction, concrete or leachate shall not escape
or be discharged, nor shall washings from transit mix
trucks, mixers, or other devices enter tidal wetlands and or
protected buffer areas.
Any debris or excess material from construction of this
project shall be completely removed from the adjacent area
(upland) and removed to an approved upland area for
disposal. No debris is permitted in tidal wetlands and or
protected buffer areas.
The storage of construction equipment and materials shall be
confined to within the project work site and or upland areas
greater than 50 linear feet from the tidal wetland boundary.
Ail fill shall consist of "clean" gravel and soil (not
asphalt, slag, flyash, broken concrete or demolition
debris).
No excavation of the beach is authorized for the purpose of
obtaining fill or stone materials.
Ail peripheral berms, cofferdams, rock revetments, seawalls,
gabions, bulkheads etc. shall be completed prior to
placement of any fill material behind such structures.

Equipment operation below apparent high water is strictly
prohibited.
There shall be no discharge of runoff or other effluent over
or through any bulkhead or shoreline stabilization structure
or into any tidal wetland or adjacent area.
The permittee shall cause all exposed faces or disturbed
areas to be vegetated to prevent soil erosion prior to the
project Completion or expiration date of this permit,
whichever comes first.

~The following co~.itions apply to all Tida~et!ands; Freshwater
Wetlands; Coastal Erosion Management; and Wild, Scenic, and
Recreational Rivers Permits:
A copy of this permit, including all conditions and
approved plans, shall be available at the project site
whenever authorized work is in progress. The permit
sign enclosed with the pea-mit shall be protected from
the weather and posted in a conspicuous location at t-he
work site until all authorized work has been completed.

The permittee shall re_cfuire that any contractor,
project engineer, or other person responsible for the
overall supervision of this project reads, understands,
and complies wi~ this per/nit and all its general,
special, and supplementary special conditions. Any
fei!oars to comply precisely with all of the ter~ and
conditions of this pel-mit, unless authorized in
%rriting, shall be treated as a violation of the
Environmental Conservation Law. If any of the permit
conditions are unclear, the ps, mitres shall contact the
Division of Regulatory Affairs at the address on page
one or telephone (516) 444-0365.
If project design modifications become necessary after
per-mit issuance, the permittee shall submit the
appropriate plan changes for approval by the Regional
Pea-mit Administrator prior to undertaking any such
modifications. The permittee is advised that
substantial modification may require submission of a
new application for permit.
At least 48 hours prior to co~encement of the project,
the per~intee and contractor shall sign and re=urn the
top portion of the enclosed notification form
certifying that they are fully aware of and understand
all tea-ms and conditions of this per-mit. Within 30
days of completion of the pel-mitted work, the bottom
portion of that form shall also be signed and returned,
along with photographs of the completed work and, if
recruited, a survey.
For projects involving activities to be undertaken zn
phases over a period of more than one year, the
permittee shall notify the Regional Permit
Ad~inlstrator in writing at leash 48 hours prior to
recommenclng work in subsecfuen~ years.
The grannlng of this permit does not relieve the permittee
of the responsibility of obtaining a grant, easement, or
other necessary approval from the Division of Land
Utilizanion. Office of General Services, Tower Building,
Empire State Plaza, Albany, NY 12242 (516) 474-2195, which

GENERAL CONDITIONS
¢¢,~¢nspections
~ 1. The permitted site or facility, including relevant records, is subject to inspection at reasonable hours
and intervals by an authorized representative of the Department of Environmental Conservation {the
Department) to determine whether t~e nermittee is complying with this permit and the ECL. Such
representative may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). A copy of
this permit, iflcluding alt referenced maps, drawings end special conditions, must be available for
inspection by the Department at ail times at the project site. Failure to produce a copy of the permit
upon request by a Department representative is a violation of this permit.
Permit Changes and Renewalls
2. The Department reserves the right to modify, suspend or revoke this permit when:
a) the scope of the permitted activity is'exceeded or a violation of any condition of the permit
or provisions of the ECL abd pertinent regulations is found;
b) the permit was =brained by misrepresentation or failure to disclose relevant facts;
c) new material information is discovered; cJr
d) environt~entaJ;cor~ditions,.reievant technology, or applicable law or regulation have materially
change{J Sin. ce the permit was issued.
3. The permittee must submit a separate written application to the Department for renewal, modifica-
tion or transfer of this permit. Such application mus[ include any forms, fees or supplemental infor-
mation the Department requires. Any renewal, modification or transfer granted by the Department
must be iq writing.
4. The p.ermittee must submit a renewal application at least:
a) 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPDES),
Haz~ous Waste Management Facilities HWMF), major Air Pollution Control (APC) and Solid
Waste Management Facilities (SWMF); and
b) 30 days before expiration of all other permit types.
5. Unless expressly provided for by the Department, issuance of this permit does not modify, supersede
or rescind any order or determination previously issued by the Department or any of the terms, con-
ditions or requirements contained in such order or determination.
Other Legal Obligations of Permittee
6. The permittee hasaccepted expressly, by the execution of the application, the full legal responsibili-
ty for all damages, direct or indirect, of whatever nature and by whomever suffered, arising out of
the project described in this permit end has agreed to indemnify and save harmless the State from
suits, actionS, damages and costs of every name and description resulting from this project.
7. This permit does not convey to the permittee any right to trespass upon the lands or interfere with
the riparian rights'of others in order to perform the oermitted work nor does it authorize the impair-
ment of any rights, title, or interest in real or personal property held or vested in a Derson not a party
to the permit.
8. The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-
of-way that may be required for this project.

design modifications after permit issuance, the
permittee must submit the appropriate plan changes for
approval by the Regional Permit Administrator prior to
undertaking any such modifications. The permi~tee is
advised that substantial-modification may require
submission of a new application for permit.

Ail repairs to existing structures are confined to
replacement of existing structural elements with no
change in design, dimension or materials unless
specifically authorized herein.
ConStructio~ of bulkhead and return walls must be
completed prior to placement of any fill material
behind such structures.
7. Use of timbers (wood) treated with pentachlorophenol is
strictly prohibited.
All'fill must be from an approved source and consist of
olean gravel and soil. Use of asphalt, slag, flyash,
broken c~ncrete or demolition debris is prohibited.
Ail fill must be graded to match the elevation of the
land immediately adjacent to the bulkhead.
10.
Contamination of tidal wetlands and the waters of New
York State by suspended solids, sediments, fuels,
solvents, lubricants, epoxy coatings, paints, concrete,
leachate or any other environmentally deleterious
materials associated with the project is prohibited.
11.
Any debris or excess material from construction of this
project must be immediately and completely removed from
the adjacent area and disposed of at an approved upland
site. Disposal of debris in tidal wetlands is
prohibited.
12.
Any bulkhead constructed directly adjacent to vegetated
tidal wetlands is to be jetted in with minimal
disturbance to the tidal wetland. Trenching is
strictly prohibited.
13.
Unless specifically authorized, there shall be no
dredging or excavation in the area seaward of the
bulkhead to regain lost fill.
14.
Prior to the ultimate expiration of this permit, the
permittee will cause all fill and exposed faces to be
vegetated to prevent erosion.
15.
The permittee may install a stone "scour pad" to
protect the bulkhead backfill in case of overwash.. The
scour pad shall consist of a minimum 1 foot layer of
'cobble size stone set on filter fabric.
