LAVEGLIA PARCEL 1000-94-2-3 STREET & LOCALITY: 3000 Sound View Road, Mattituck DATE OF PUBLIC HEARING: April 16, 1998 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: ii The above -identified property is located on the southerly side of Sound View Avenue, Mattituck, and contains a total area of approximately one acre. The July 6, 1992 survey submitted under this application shows that the subject premises is improved with a 1-1/2 story, single-family residence, in -ground pool, and the subject accessory garage building under construction (B.P. #22657). BASIS OF APPEAL: Building Inspector's February 24, 1998 and March 6, 1998 Notices of of Disapproval which state that the accessory building will exceed maximum allowable height of 18 feet under Article III, Section 100-33A, and that under section 100-3311.3 accessory building on lots containing between 39,999 and 79,999 sq. ft. require such building be set back no less than 10 feet from any lot line, and the staircase of 3 ft. +- will now be a minimum of 9 ft. from the rear lot line. AREA VARIANCE RELIEF REQUESTED BY APPLICANT: Applicant is requesting a variance, based upon his amended application for a building permit, to add unroofed decks around the top of the accessory building, and placement of railing, which requires a height variance of 30 inches at the top. The setbacks of the existing two -car garage, with the 3 -ft. wide stairway, are proposed at nine (9) feet from the southerly rear property line and at 14 feet from the westerly side property line. Applicant offered as a condition of this variance planting and maintenance of six (6) Arborvitae or Cedar trees, four -foot apart, at a minimum height of six feet along the southerly rear property line. Page 2 of 3 - May' 19, 1998 Appl. #4554: 1000-94-2-3 (Laveglia) Southold Town Board of Appeals REASONS FOR BOARD ACTION, DESCRIBED BELOW: Applicant has recently added a second floor to his existing garage and designed the addition with a flat roof intended for use as a deck. However, the roof is 18 feet above the ground, the maximum allowed under the Zoning Code, and applicant has therefore applied for a variance to permit addition of a 3 -ft. high open railing around the deck. Applicant has also requested a property line setback variance to allow the stairs to the second floor, only 9 feet from the southerly property line. On the basis of testimony presented and personal inspection, the Board makes the following findings: 1) The proposed building height of 21 feet, including the railing, will not have a visual effect that is detrimental to the neighborhood provided that the rooftop deck is adequately screened from view. 2) Taken as a whole, the requested height and setback variances are substantial. 3) Because the flat -roofed second floor has already been constructed, there is no feasible way for applicant to obtain the benefit of a rooftop deck other than through construction of the proposed 3 -foot railing. 4) The propopsed work will not have an adverse effect or impact on physical or environmental conditions. The Board concludes that the following actions are the minimum necessary and adequate to enable applicant to have a roof deck while also preserving and protecting the character of the neighborhood, and the health, safety, welfare of the community. RESOLUTION/ACTION: On motion by Member Collins, seconded by Chairman Goehringer, it was RESOLVED, to GRANT the requested variances allowing a one ft. reduction in the rear yard setback (to a 9 ft. minimum setback) and allowing construction of an open railing 3 feet high on the garage roof, subject to the following CONDITIONS: 1) The building shall at all times be used only for purposes accessory and incidental to the use of applicant's dwelling. The building shall under no circumstances be used for habitation. 2) Applicant shall plant a screening line of trees along the southerly property line, beginning no more than four (4) feet from the westerly property line and extending at least 60 feet eastward. Laveglia Dear Mr. Goehringer: The undersigned are owners of property at 3200 Sound View Avenue (SCTM 1000-94-2-5). Enclosed is a copy of a map of our property. Portions of the northerly side of our property border land of D. Laveglia who is seeking to complete an observation platform on top of his two car garage. We are unable to personally appear at the hearing on April 16, 1998 due to the fact both of us have prior commitments which require us being away from Southold Town on this date. We strongly object to the application and the bizarre relief for which Mr. Laveglia seeks. If the application i.s..'granted, it will virtually destroy the privacy -in our backyard:D'ue to the topography of the land, the deck in the rear yard of our house is approximately 25 feet lower than the land on the applicant's property. When you add the height of this garage building with the observation deck, it would place a person on the observation deck approximately 45 feet higher than our deck. In effect this deck becomes part of our rear yard. If the application is granted, there is no way our property could be landscaped to afford any privacy to the rear yard area. In other words, the relief requested in the application will create an undesirable change which will directly affect and be a detriment to our property. There can be no real purpose in this application other than to create an outdoor observation deck because the house on the applicant's property has an inside observation area with panoramic views of Long Island Sound. The Board of Appeals should be -aware that this entire situation was self created by the applicant. 'Prior to the" Building Department granting permission for -a second -story addition to the existing one-story garage, there existed a flat roof on this one-story garage which was used by the owners of the property, especially on weekends during the cocktail hour, as an observation deck. When the weather was nice, there wouldbe five -2 - or six people on this deck at various times. Needless to say, our privacy was affected, and when the wind was calm as it is in the evening or from the northwest, any conversations on this deck were literally on our deck. However, due to the height of the deciduous trees, some privacy was afforded in the summer time. Several months ago, there was built a second -story on this garage and to our surprise with a flat roof which meant the applicant intended to have a higher observation deck. This fact was verified since the application seeks permission for a set of external stairs to reach this observation deck. We own 5 acres of property which would normally be a large track of land, but when you consider the topography and the proximity of D. Laveglia's garage to our property line and due to the height of the observation deck, the -people -on it will be literally in -our back yard. Having a building so close to the property line is aggravated by allowing it to have a second -story plus an observation deck. As we understand it, the zoning ordinance was created for the protection of all people in the town, and in particular, one of its purposes is to provide for privacy. Recreation, relaxation and privacy are the raison d'etre of a rear yard. The granting of this application will in effect nullify all privacy from the observation deck. Due to the conditions as we've stated above, we implore the Board to deny granting the relief requested as it will deprive us of our privacy and be a detriment to our property, whether it be us or someone else living there. We are asking the Board to put itself in our position by viewing this observation deck from our deck. After this is done, then asking the question, how you would feel with people being able to stare at you from the vantage point of this proposed observation deck. From a common sense point of view our property will be negatively impacted by the creation of this two-story observation deck. On the other hand, the..applicant still will be abld to enjoy the view of -Long Island Sound from his house. Again, we apologize for not being able to be personally at the hearing, but would appreciate it if the Board would send us a copy of the decision when it is rendered.
