No. 4590 — WALTER KRUPSKI PARCEL 1000-114-10-6 STREET & LOCALITY: 315 Pat Lane, Mattituck, NY DATE OF PUBLIC HEARING: August 13, 1998 FINDINGS OF FACT PROPERTY FACTS/ DESCRIPTION: The above -referenced property is known as Lot 14 on the Map of Deerpark and is situated along Pat Lane and Deer Drive, Mattituck. The survey map submitted under this application shows that the subject premises contains a total area of approximately 19,994 sq. ft. and is improved with a one-story frame dwelling with attached garage and decks. The existing dwelling is shown to be 35 feet from the front property line along Pat Lane (from the foundation). BASIS OF APPEAL: Building Inspector's June 26, 1998 Action of Disapproval which reads as follows: "...The proposed addition being located on a non- conforming lot in an R-80 Zone of approximately 24,440 sq. ft. is required to have a minimum front yard setback of 40 ft. or existing, Article XXIV, Section 100-244B." AREA VARIANCE RELIEF REOUESTED BY APPLICANT: The request made by applicant is to construct an addition for a new foyer -entrance at the front of the dwelling, 5 ft. by 11 feet wide, leaving a setback of approximately 30 feet from the front property line along Pat Lane. REASONS FOR BOARD ACTION, DESCRIBED BELOW: (1) The granting of the area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties because applicant is requesting a 5 ft. alteration to existing front porch area which will enhance the overall physical condition, and in no way detract from the surrounding properties C • , Page 2 - August 24, 1998 Appl. (2) The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance because existing house as constructed in 1976 has been unaltered as it exists at a non- conforming setback (front of house only). (3) The requested area variance is not substantial representing a percentage of less than 15% (or 14.2%). (4) The proposed variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because a majority of the homes in the subdivision have existed for more than 20 years and have improvements with similar setbacks. (5) The situation has not been self-created. In considering this application, the Board deems this action to be the minimum necessary and adequate, and at the same time preserves and protects the character of the neighborhood, and the health, safety, welfare of the community. RESOLUTION/ACTION: On motion by Chairman Goehringer, seconded by Member Collinsit was RESOLVED, to GRANT the variance, as applied for. An undesirable change will NOT be produced in the character of the neighborhood or a det- riment to nearby properties, if granted BECAUSE: The requested variance is minimal; the proposed entry addition extends an allowable five feet into the required front yard, but it is 11 feet wide and thus the variance is required. The design of the remodeled house needs the wider entry in order to present an appearance which is esthetically pleasing. 2. The benefit sought by the applicant CANNOT be achieved by some method, feasible for the applicant to pursue, other than an area variance BECAUSE: A narrower entry would not be in keeping with the size of the house and the desires of the architect and the owner. 3. The amount of relief requested is not substantial BECAUSE: The regulations allow a covered entry of this sort six feet wide; the proposed entry is 11 feet wide. The additional area of coverage for which the variance is required amounts to only 30 square feet. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district BECAUSE: The design of the construction for which the variance is required is not apparent or intrusive and does not significantly alter its surroundings in the required front yard. 5.
