FINDINGS OF FACT
PROPERTY FACTS/ DESCRIPTION: This five -acre parcel is known as Lot #10 on
the Map of Settlers at Oysterponds, Orient, and fronts along two streets: Orchard
Street and Platt Road (a/k/a Halyoake Road). The July 17, 1997 survey map shows
the existing two-story frame house with roofed porches and second -story deck, the
existing accessory garage, and the existing accessory tennis court structure.
BASIS OF APPEAL: Building Inspector's June 15, 1998 Notice of Disapproval which
reads as follows: "Under Article XXIII, Section 100-231B, fences located in side or
rear yards shall not exceed 6-1/2 ft. in height...."
AREA VARIANCE RELIEF REQUESTED BY APPLICANT• Applicant requests a
variance to construct an 8 ft. high black chain link fence to enclose both 60 ft. ends of
an existing 120 ft. by 60 ft. asphalt tennis court structure and to extend the 8 ft. fence
a distance of 30 feet from the end corners leaving the remaining 60 ft. open between
both ends. (Note: Building Permit No. 24817 for the existing tennis court and posts
was issued 4/7/98.) Applicant confirmed the setback at 50 ft. from the southeast
property line. No lighting is proposed.
REASONS FOR BOARD ACTION:
1. Grant of an area variance will not produce an undesirable change in the character
of the neighborhood or a detriment to nearby properties because the existing
tennis court is located in the rear yard of applicants five -acre property. The
potential visual impacts of the requested 18 -inch high variance will be obscured by
the use of black chain-link fencing.

2. The benefit sought by the applicant cannot be achieved by some method, feasible
for applicant to pursue, other than an area variance because the town code's 6 ft.
6 in. height limit is not sufficient to prevent tennis balls from straying outside the
court. The fence height requested is commonly used for tennis courts to facilitate
play, and is neither unusual or excessive.
3. The requested area variance is not substantial. The applicant is requesting an 8
ft. h igh fence, an increase of 18 inches over the code -permitted 6 ft. 6 in, limit.
4. The proposed variance will not have an adverse effect or impact on the physical or
environmental conditions in the neighborhood or district because the tennis court
is located on a large five -acre parcel, and the use of the black chain-link fencing
will help screen it from view.
5. The difficulty has been self-created.
In considering this application, the Board deems the relief requested is the minimum
necessary and adequate, and at the same time preserves and protects the character
of the neighborhood, and the health, safety, welfare of the community.
RESOLUTION/ACTION: On motion by Member Tortora, seconded by Member
Horning, it was
RESOLVED, to GRANT the variance, as applied for, and SUBJECT TO THE FOLLOWING
CONDITION: The tennis court shall contain no lighting nor be lighted from an
external source.

6 in. height limit is not sufficient to prevent tennis balls from straying outside the
court. The fence height requested is commonly used for tennis courts to facilitate
play, and is neither unusual or excessive.
3. The requested area variance is not substantial. The applicant is requesting an 8
ft. h igh fence, an increase of 18 inches over the code -permitted 6 ft. 6 in. limit.
4. The proposed variance will not have an adverse effect or impact on the physical or
environmental conditions in the neighborhood or district because the tennis court
is located on a large five -acre parcel, and the use of the black chain-link fencing
will help screen it from view.
5. The difficulty has been self-created.
In considering this application, the Board deems the relief requested is the minimum
necessary and adequate, and at the same time preserves and protects the character
of the neighborhood, and the health, safety, welfare of the community.
RESOLUTION/ACTION: On motion by Member Tortora, seconded by Member
Horning, it was
RESOLVED, to GRANT the variance, as applied for, and SUBJECT TO THE FOLLOWING
CONDITION: The tennis court shall contain no lighting nor be lighted from an
external source.

We are Writing to respond to the notice for a variance hearing o a 8/13, relative to the height of
a tennis court fence, `Both of us live on Orchard Street in Orien; in M view of the residence
and property.
The purpose of the zoning of 5+ acres in our area is to maintain the "green" character of the
location. When someone moves into an area, this is an importmt consideration factor. We do
not understand why the need for this type of a fence was not pei ceived when a permit was
issued, limiting the fence to 6 Meet- Now that the court and f;sce posts appear to be in, it
seems like an awkward time to address this issue.
Our goal is to maintain the green character of the environment. We do not want to look out
onto cleared property or 10 foot fences.. The only way we wou:A not be opposed to a 10 foot
fence is if there was definite, commitment to plant equal -sized evergreens around all 4 sides of
the fence to obscure it Otherwise, it would not maintain the chi iracter of the area.
The worst offence would be to have more of the wild natural landscape cleared. Anything
agreed to should be aimed at maintaining this natural plan. -Please work to this
environmentally -friendly goal.

For your review and transmittals, please find enclosed a copy
of the Legal Notice regarding your application. Our department will
publish the Notice in next week's issue of the L.I. Traveler
newspaper.
Pursuant to the provisions of Chapter 58 of the Southold Town
Code, notice of your application and hearing must now be sent, by
certified mail, return receipt requested, to the all surrounding
property owners together with a copy of a map or sketch describing the
location and/or use of the property or new construction. Please send
the notices by 8/1 (earlier.preferred). Owners of vacant property and
other properties, surrounding your project, along all sides and
abutting the boundaries of the subject lot are those as listed on the
assessment rolls. A copy of Chapter 58 is enclosed for your
reference.
Please also post the sign on your property at ten (10)
feet, or closer, to the front property line, facing the street by 8/5.
The sign must remain for a period of. not less than seven (7) days) .
Once the sign is placed, please. complete and return the Affidavit of
Posting to us. If another sign is needed, please let us know.
When the Certified Mailings have been sent, please furnish your
Affidavit of Mailing to us as soon as possible, together with white
certified mail receipts postmarked by the post office. Once the
green/signature cards are returned to you by the post office, please
file them with us. These will all be made a part of your permanent
file as proof of service under Chapter 58. In the event there is any
signature card that was not returned to you, please confirm the same
at the public hearing for an update and record purposes. Thank you.
