Box 1179 Southold, New York 11971 ZBA Fax (516) 765-9064 Telephone (516) 765-1809 PROPERTY FACTS/DESCRIPTION: The above -identified property is situated along the easterly side of Bayshore Road at Peconic Bay Estates, Greenport. This parcel contains a total area of approximately 9,300 sq. ft. (to the 6/7/1997 high water line). Existing at the premises is a one- story frame house, as shown on the April 8, 1998 survey prepared by Anthony W. Lewandowski, L.S. BASIS OF APPEAL: Building Inspector's May 5, 1998 Notice of Disapproval which disapproved an application for a permit to construct addition to dwelling for the reason that it encroaches on the combined side yard setbacks, Article XXIV, Section 100-244. AREA VARIANCE RELIEF REQUESTED BY APPLICANT: The request made by applicant is for permission to locate a proposed 12' x 20' addition over the area shown as 'foundation' on the 1998 survey. The total side yards will be 18.8 feet, with 15 ft. at the northerly side yard and at 3.8 feet at its closest point from the southerly side yard. REASONS FOR BOARD ACTION, DESCRIBED BELOW: (1) The granting of the area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties because applicant's request will in effect be a "squaring off' of the dwelling over an existing patio foundation, meeting all other setbacks required under Bulk Schedule AA for nonconforming lots having less than 20,000 sq. ft. of land area. (2) The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance because of the nonconforming size of the property and limited buildable land area for a corner lot and waterfront area. .Page 2 - August 24, 1998 APR1. Dwyer 1000-53-4-21 Southold Town Board of Appeals (3) The requested area variance is not substantial representing no increase in the present nonconforming setback of the dwelling as exists. (4) The proposed variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because a majority of the homes in this waterfront community have existed with similar lot sizes and similar setbacks. (5) The situation has been self-created because the original dwelling was constructed more than 35 years ago and the only addition to the dwelling was about ~.g76, more than 22 years ago. In considering this application, the Board deems this action to be the minimum necessary and adequate, and at the same time preserves and protects the character of the neighborhood, and the health, safety, welfare of the community.
