The permitted site or facility, including relevant records, is subject, to inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation [the Department) to determine whether the permittee is complying w~th this permit and the ECl_ Such representative may order the Work suspende~ pursuant to ECL 71-0301 and SAPA 401(3). A copy of this permit, including all referenced maps. drawings and special conditions, must be available for inspection bythe Dep~rtment at all times at the p~'oject Site. Failure to produce a copy of the permit upon request by a. Department representative is a violation of this permit. Permit Changes and ReneWals 2. The Department reserves the right to modify, suspend or revoke' this permit when: al the scope ob the permitted activity is exceeded or a ~iolation of any condition of the permit Or Provisions of the ECL and pertinent egulations is found; b) the permit mas obtained by misrepre~:3tation or failure to disclose relevant facts; c) new material information is discovered: or dl enVfronmen~tal conditions, relevant tech~;ology, or applicable law or regulation have materially Changed sinC~ the permit was issued. 3. The permittee must~submit a'se~arate Writtgr application to the Department for renewal modifica- t ion or transfei' of th ~ permit. Suoh application must include any forms, fees or supplemental infor- mation the De~artrne'n't requires. Any renewal, modification or transfer granted by the Department must be in writing. 4. The permit~ee must submit a renewal application at least: a) 180 days before explrefion of permits for State Pollutant Discharge Elimination System ~SPDES3. Hazardous Waste Management Facilities (HWMF), major Air Pollution Control ~APCI and Solid Waste Management Facilities (SWMF); and b) 30 days before expiration of all other permit types. 5. Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind any order or determination previously issued by the Department or any of the terms, con- ditions or requirements contained in such order or determination. A~y debris or excess material from constr~ction of this project must be ~mmediately and cdmpletely removed from the adjacent area and disposed of at an approved upland Site. Disposal of debris in tidal wetlands is prohibited. 12. Any bulkhead constructed directly adjacent to vegetated tidal wetlands is to be jetted in with minimal disturbance to the tidal wetland.
