Reviews of activities pursuant to Section 404 of the Clean Water Act will include application of the guidelines promulgated by the Administrator, U.S. Environmental Protection Agency, under authority of Section 404(b) of the Clean Water Act and the applicant will obtain a water quality certificat~ or waiver f~om the appropriate state agency in accordance with Section 401 of the Clean Water Act prior to a permit decision. Pursuant to Section 307(c) of the Coastgl ZoNe Management Act of 1972 as amended [16 U.S.C. 1456(c)], for activities under consideration that are located within the coastal zone of a state which has a federally 9pproved coastal zone management program, the applicant has certified in the permit application that the activity complies with, and will be conducted in a manner that is consistent with, the approved state coastal zone management program. The completed work involved the construction of 139 linear feet of timber bulkhead including two 27 feet returns on soil-surfaced ramp and 7 feet return on south side and construction of 5 foot by 65 foot fixed pier~ 2.5 foot by 12 foot ramp, 7 foot by 20 foot and 5 foot by 20 foot "L" shaped float arrangement secured by 3 pilings° The purpose fo~ the completed work is to protect the an~licant~s property from erosion and provide recreational facilit~s. The above completed work was performed without prior Department of the Army authorization. The ~ew York Distr%ct Corps of Engineers, having reviewed the matter, has aeclined at this time to initiate legal proceedings for the undertaking of the unauthorized work.
