A detailed description and plans of the applicant's activity are
enclosed to assist in your review.
The decision whether to issue a permit will be based on an evaluation
of the probabl~ impact, including c.umulative impacts, of the activity
on the public~ interest%- That-decision will reflect the national
concern for both protection and utilization of important resources.
The b~nefits which reasonably.may be expected to accrue from the
activity must be balanced against its reasonably foreseeable
detriments.. All factors which mgy be relevant to the activity will be
considered including the cumulative effects thereof; among those are
conservation, economics, aesthetics, qeneral environmental concer~ns,
wet~an~S, cultural values, land use, navigation, shoreline erosion and
accretion, recreation~ watersupply and conservation, water quality,
energy needs, safety,~food production and, in general, the needs and
welfare of the people.
The CorDs of Engineers is solicitin~ comments from the public; Federal,
state, and local agencies and officials; Indian Tribes; and other
interes~ted parties %n order to consider and evaluate the impa~cts of
this proposed activity. Any comments received w. ill be considered by
the corps of Engineers to determine whether to ~ssue, modify, condition
or deny a permit for this proposal. To make this decisio, n, comments
are used to assess impacts on endangered species, historic properties,
water quality, general environmental effects and the other public
interest factors listed above. Comments a. re used in the preparation of
an Environmental Assessment and/or an Environmental Impact Statement
pursuant to the National Environmental Policy Act (NEPA). Comments are
also used to determine the need for a public hea. r%ng and to determine
the overall public interest of the proposed activity.

It should be noted that information submitted by mail is considered
just as carefully in the permit decision process and bears the same
weight as that furnished at a public hearing.
Pursuant te Section 7 of the Endangered Species Act (16 U.S.C: 1531)
and based upon a review of the latest published version of the
threatened and endangered species listing, a preliminary determination
is that the activity under consideration will not affect those species
listed or their critical habitat.
Based upon a review Of the latest published version-of the National
Register of Historic Places, there are no known sites eligible for~ or
included in, the Register within the permit area. Presently unkno%~n
archaeological, scientific, prehistorical or historical data may be
lost by work accomplished under the required permit.
Reviews of activities pursuant to Section 404 of the Clean Water Act
will include application of the guidelines promulgated by the
Administrator, U.S. Environmental Protection Agency, under authority of
Section 404(b) of the Clean Water Act and the applicant will obtain a
water quality certificat~ or waiver f~om the appropriate state agency
in accordance with Section 401 of the Clean Water Act prior to a permit
decision.
Pursuant to Section 307(c) of the Coastgl ZoNe Management Act of 1972
as amended [16 U.S.C. 1456(c)], for activities under consideration that
are located within the coastal zone of a state which has a federally
9pproved coastal zone management program, the applicant has certified
in the permit application that the activity complies with, and will be
conducted in a manner that is consistent with, the approved state
coastal zone management program. By this public notice~ we are
requesting the state's concurrence ~ith, objection to, or waiver of the
applicant's certification. No permit dec~sion will be made until one
of these actions occur. For activities within the coastal zone of New
York State, the applicant's certification and accompanying information
is available from the Consistency Coordinator, New York State
Department of State~ Division of Coastal Resources and Waterfront
Revitalization, Coastal Zone Management Program, 162 Washington Avenue~

WORK DEBCRIPTIO~
The applicant, Eustace Eriksen, has requested after-the-fact Department
of the Army authorization to maintain as completed a bulkhead and a
pier assembly in Mattituck Creek, at Southold, Suffolk County, New
York.
The completed work involved the construction of 139 linear feet of
timber bulkhead including two 27 feet returns on soil-surfaced ramp and
7 feet return on south side and construction of 5 foot by 65 foot fixed
pier~ 2.5 foot by 12 foot ramp, 7 foot by 20 foot and 5 foot by 20 foot
"L" shaped float arrangement secured by 3 pilings°
The purpose fo~ the completed work is to protect the an~licant~s
property from erosion and provide recreational facilit~s.
The above completed work was performed without prior Department of the
Army authorization. The ~ew York Distr%ct Corps of Engineers, having
reviewed the matter, has aeclined at this time to initiate legal
proceedings for the undertaking of the unauthorized work. The decision
whether or not to grant approval res=s with an evaluation of the
probable impact on the public interest of either allowing the work to
remain as constructed, or requiring its modification or removal.
