Dear Ms. Cross:
The~following action was taken by the Board of Town Trustees
during their regular meeting held on March 23, 1989 regarding the
above matter:
WHEREAS, Conni Cross IN BEHALF OF Nassau Point Property Owners
Association applied to the Southotd Town Trustees for a permit under
the provisions of the Wetland Ordinance of the Town of Southold,
application dated November 22, 1988, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on March 23, t989 at ~nich time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are familiar
with the premises in 'question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED that Conni Cross ON BEHALF OF Nassau Point Property Owners
Association BE AND HEREBY IS GRANTED PERMISSION UNDER THE WETLAND
ORDINANCE TO: Install two 10' by 30' bermed areas, not more than 3'
high, at entrance to Nassau Point, Cutchogue, N.Y.
This permit will expire two years from the date it is signed if
work has not commenced by said date. Fees must be paid and permit
issued within six months of the date of this notification. Two
inspections are required and the Trustees are to be notified upon
completion of said project.
Please take notice that this declaration should not be
considered a determination made for any other department or agency
which may also have an application pending for the same or similar
project.

Re: Wetland Application Recommendations
The following recommendations were made by the Southold Town
Conservation Advisory Council at a meeting of the Council
held Tuesday, January 24, 1989:
RESOLVED to recommend to the Southold Town Trustee approval
with stipulations Wetland Application No. 11-88-104-13-5 of
En-Consultants, Inc. for Kenneth and Christine Rathgeber to remove
and replace (in same locations and configuration) 211± 1.f. of
retaining wall which is to connect to existing walls to north
and south. The figure includes sections around existing concrete
block "bath house" which is being undermined. Approximately
1,490 c.y. of clean sand and loam to be trucked in from an upland
source to be used for backfill and rehabilitation of~existing
eroded slope. Following grading, slope to be planted with such
species as Rosa rugosa, bayberry, beachgrass, etc. to stabilize.
The Council approves with the stipulation that applicant put
in retaining wall in line with neighbors', install drywells to
contain roof runoff, and suggest, if necessary, terrace the sloping
ground.
RESOLVED to recommend to the Southold Town TrusTees approval
with stipulations of Wetland Application No. 11-88-104-8-1.1
of Connie Cross for Environmentals Nursery to install zwo 10'x
30' bermed areas, with natural rock outcroppings and appropriate
plantings at entrance to Nassau Point. The Council approves
with the stipulation that applicant limit the height of the berm
to no higner than 2'
RESOLVED to recommend to the Southold Town Trustees approval
of Wetland Application No. 11-88-136-1-41,'42 of James E. Fitzgerald, Jr.
for Ira Wechterman to construct a wood deck attached to house,
extending to line of retaining wall; construct walkway 34' x 3'
and floating dock 12' x 4'; and install two piles to secure floating
dock ....
RESOLVED to recommend to the Southold Town Trustees approval
with stipulations of Wetland Application No. 680 of En-Consultants,
Inc. for Lew Edson to construct a one-family dwelling, sanitary
system, deck, bluestone driveway, and wellr as shown on submitted
plans. (No additional fill to be required.) The Council approves
with the condition that no clearing be done within 50' of the
water except for a pathway for access to water.

CAUSE DAMAGE FROM EROSION, TURBIDITY OR SILTATION.
CAUSE SALTWATER INTRUSION INTO TOWN FRESHWATER RESOURCES.
ADVERSELY EFFECT FISH, SHELLFISH OR ANY BENEFICIAL MARINE ORGANISMS,
AQUATIC WILDLIFE~ VEGETATION OR THE NATURAL HABITAT THEREOF.
INCREASE THE DANGER OF FLOOD AND STORM TIDE DAMAGE.
ADVERSELY EFFECT NAVIGATION ON TIDAL WATERS, OR THE TIDAL FLOW OF TOWN
TIDAL WATERS.
CHANGE THE COURSE OF ANY CHANNEL OR THE NATURAL MOVEMENT OR FLOW OF ANY
WATERS.
WEAKEN OR UNDERMINE THE LATERAL SUPPORT OF OTHER LANDS IN THE VICINITY.
OTHERWISE ADVERSELY EFFECT THE HEALTH, SAFETY OR GENERAL WELFARE OF THE
PEOPLE OF THE TOWN.
