The validity of this merm~t is or may be subject to the approval of other ~overnmenta[ or municipal

The applicant does by the acceotance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of iniuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indernni-
fy and save harmless the Town, and its officers, agents and employees from an~ and all claims arising
from operations under this permit and an,/ and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises uuon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give consent to the T~wn. and
its ~)fficers and employees to enter upon the premises where such operations are ue~ng conouo~ea ~o
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted n conformity with this permit.
This. operation will not substantially: A, Adversely affect the wetlands of the town,
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish. shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lends in the vicinity.
Io Otherwise adversely affect the health, safety a.nd general welfare of the people of the town.

Dear M~. Eginton:
The following action was taken by the Board of Town Trustees during
their regular meeting held on June 23, 1988 as follows:
WHEREAS, Clifford Eginton applied to the Southold Town Trustees for a permit
under the prowsions of the Wetland Ordinance of the Town of
Southold, application dated April 6, 1988, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findin, gs and
recommendations, and
WHEREAS, a public hearing was held by the Town Trustees with
respect to said application on June 23, 1988 at which time all interested
persons were gxven an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and tlie surrounding area, and
WHEREAS, the Board has considered ail the testimony and documentation submitted
concerning this application, and
WHEREAS, the Board has determined that the project as proposed will not
affect the lieaitli, safety and general welfare of the people of the town,
NOW, THEREFORE, BE IT
RESOLVED that Clifford Eginton BE AND HEREBY IS GRANTED PERMISSION UNDER THE
PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD
TO: Construct a 50' retaining wail 13' from the monument on the property with a
return on the north side(12'), return on the south side (8') to grade with approximately
30 cu. yds. of backfill to be trucked in to the site. Property is located at 780
Deep Hole Drive, Mattituck.

This permit will expire two years from the date it is signed if work has
not commenced by said date. There are two inspections required and the
Trustees are ~o be notified upon the completion of the work.
Prior ~o the issuance of said permit by the Clerk, tl~e applicant
shall file with ~he Clerk a certificate that he has public liability ir~surance
policies insuring against any liability which may arise
in the performance of the operations pursuant to such permit in such amount
as shall be fixed by the Trustees, which said policies shall name the Town
as a name insured. Please take further notice that
this declaration should not be considered a determination made for any
other department or agency which may also have an application pending
for the same or similar project.
The following fees are now due and payable:

Upon remittance your permit will be forwarded by mail.

Town Trustees as the lead agency for the action described below has determined
that the project will not have a s~gnificant' effect on the environment.

REASONS SUPPORTING THIS DETERMINATION:
1. An environmental assessment form has been submitted which
indicated that there would be no adverse effect to the
environment should the project be implemented as planned.
2. Because there has been no response in the allotted time from the Southold
Town Building Dept. and the New York State D.E.G. it is assumed that there
are no objections nor comments from those agencies.

Re: Wetland Application Recommendations
The following recommendations were made by the CAC at its regular
meetinq held Thursday, June 22, 1988:
No. 625 - Clifford Eginton - Recommend disapproval. No major
need is shown, CAC suggests applicant revege~a~e the
slight problem area.
No. 628 - Anthony Panzarino - CAC divided the application into
parts A and B. It recommends approval of Part A which
is to repair existing deck; constuct a timber dock
with a fixed elevated walk; hinged ramp; float; and
construct an additon ot w/s of beach house.
The CAC recommends disapproval of Part B which consists
of a retaining wall with returns; backfilling; additions
to existing wood decks; construct concrete pads on
n/s of beach house. The CAC feels that the applicant
has shown no need for the retaining wall and additional
deck would be too close, and as a result wetlands would
filled. The land is stable, further work would destroy
wetlands.
No. 629 Linda Wilton- Recommend±disapproval. Property is wetlands.
Check for possible violation.
No. Andrew and Bernice Lettieri Recommend disapproval.
Not enough space for prosposed project, presents a
navigational hazard.

The following conditions apply %o ~l.L permits:
A. If any of the permit conditions are unclear,the permittee shall con-
tact the Division of Regulator~ Affairs at the address and telephone
noted below.
B. A copy of this permit or approval and supplementary conditions shall
be available at the ~ro]ecn site whenever authorized work is in
progress.
C. The permit sign enclose~ with the permit or a copy of letter of
approval shall be protected~ from the weather and ~osted in a con-
spicuous location at the work site until completion of authorized work.
D. At least 48 hours prior [o commencement of the project, the permittee
shall complete and return the top portion o~ the enclosed receipt form
certifying that he is fully aware of and understands all provisions and
conditions of this permit. Within one week o~ completion of the
permitted work, the bottom portion of that form shall also be com-
pleted and returned.
E. For projecns involving activities to be accomplished over a period of
more than one year, the permittee shall notify the Regional Permit
Adminisnranor ~n writing at least 48 hours prior no the commencement
of resumption of work each year.
F. If project design modifications take place after permit issuance, the
permittee shall submit the appropriate plan chauges for approval by
the Regional Permit Administrator prior to undertaking any such modi-
fications. The permittee is advised that substantial modification
may require submission of a new application for permit.
G. All necessary precautions shall be taken to preclude contamination of
any wetlands or waterway by suspended solids, sediment, fuels,
solvents, lubricants, epoxy coanzngs, paints, concrete, leachate or
any other environmentally deleterious materials associated with the
project work.
H. Any failure ro comply precisely with all of the terms and conditions
of this permit, unless authorized in writing, sh~ll be treated as a
violation of the Environmental Conservation [,aw.

Trustee Kujawski: Is there anyone here to speak on behalf of
this application? Mr. Eginton do you wish to speak?
Clifford Eginton: I just want to see this approved.
Trustee Kujawski: Are there any comments, C.A.C.?
John Holzapfel, C.A.C.: We were Torn about this, we did not see
a real need for this. The consensus was that we did not see
~areal need for this. Revegetation either at the foot of this or
on it itself would accomplish the same purpose.
Trustee Kujawski: We had talked about that at the site. It gets
a rapid flow through there. The whole basin empties out of that
20 ft. area on an outgoing tide and incoming tide. We felt that
it would be tough to revegetate it there because the basin
narrows down. Mr. Eginton did move this back quite a bit on his
own property. Some of our worries were mitigated, I guess that
is the proper word. Do any of the Trustees have anything to add?
No ,comment. I think this will also be low profile to be kept in
line with the lawn.
Mr. Eginton: Right.
Trustee Kujawski: Hearing no other comments, I will close this
hearing.
