upon due notice, to remove or alter this work or project herein stated without ex?emes to the Town
of Southold.

Dear Mr. Haje:
The following action was taken by the Board of Town Trustees
during their regular meeting held on February 28, 1989 regarding the
above matter:
WHEREAS, Eh-Consultants on behalf of above mentioned property owners
applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated September 12. 1988, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on February 28, 1989 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
-submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED that En-Consultants ON BEHALF OF Monica Kenny, Henry
Arbeeny, John Van Vladrichen, Joseph Williams, Canning Eliffee,
Nicholas Pace, Albert Pinkham, Charles McCormack, BE AND HEREBY
IS GRkNTED PERMISSION UNDER THE WETLAND ORDINANCE TO: Remove and
replace bulkhead, dredge and backfill a~ property located in Reydon
Shores, Southold,
N.Y.
This permit will expire two years from the date it is signed if
work has not commenced by said date. Fees must be paid and permit
issued within six months of the date of this notification. Two
-inspections are required and the Trustees are to be notified~pon
completion of said project.
Please take notice that this declaration should not be
considered a determination made for any other department or agency
which may also have an application pending for the same or similar
project.

Four properEy owners wish mo make repairs ~o their
exzsnzng bulkhead zn Reydon Shores, Southold. Lathem
Sand & Gravel is the concracnor.
The conmracnor will re-sheath the existing sheathing
of the bulkhead. The new sheathing will consist of 2"
5ongue & groove material. The landward wall will requmre
excavatmon and backfill upon completion.
The work zs intended 5o be done by all four properEy
owners concurrently.
The following owners have existzng Trustees permits
for the existing bulkhead from 1989 and this request

The decision whether to issue a permit will be based on an evaluation of
the probable impact including cumulative impacts of the activity on the
public interest. That decision will reflect the national concern for both
protection and utilization of important resources. The benefit which
reasonably may be expected to ~crue from the activity mus~ be balanced
against its reasonably foreseeable de:riments. All factors which may be
relevant to the activity will be considered ih%iuding the cumulative
effects thereof; among those are conservation, economics, aesthetics,
general environmental concerns, wetlands, cultural values, fish and
wildlife values, flood hazards, flood plain values, land use, navigation,
shoreline erosion and accretion, recreation, water supply and conservation,
water quality, energy needs, %afety, food production and, in general, the
needs and welfare of the people.

otherwise it will be presumed that there are no objections to the activity.
Any person may request, in writing to the district engineer, before this
public notice exp£res, that a public hearing be held to collect information
necessary to consider this application. Requests for public hearings shall
state, with particularity, the reasons why a public hearing should be held.
It ehould be noted that information submitted by mail is considered just as
carefully in the permit decision process and bears the same weight as that
furnished at a public hearing.

Pursuant to Section ? of the Endangered Species Act (16 U.S.C. 1531) and
based upon a review of the latest published version of the threatened and
endangered species listlng~ $ preliminary determination is that the
activity under consideration will not affec= those species listed or their
critical habitat.
Based upon a review of the latest published version of the National
Register of Historic Places, there are no known sites eligible for or
included in the Register within the permit area. Presently unknown
archeological, scientific, prehistorical or historical data may be lost by

Reviews of activities pursuant to Section 404 of the Clean ~ater Act will
include application of the guidelines promulgated by the Admlnistrator,
U.S. Environmental Protection Agency, tmder authority of Section 404{b) of
the Clean Water Act and the applicant will obtain a water quality
certificate or waiver from the appropriate state agency in accordance with
Section 401 of the Clean Water ACt prior to a permit decision.
Pursuant to Section 307(c} of the Coastal Zone Management Act of 1972 as
amended (16 U.S.C. 1456(c)), for activities under consideration that are
located within the coastal zone of ~ state which has a federally approved
coastal zone management program, the applicant has certified in the permli
application that the activity complies with and will be conducted in a
manner that is consistent with the approved state coastal zone management

DESCRIPTION OF WORK
The applicant's ( as listed on attached sheet) have requested Department
of the Army authorization to dredge aDoroximately 60 cubic yards of
material and replace an existing timber bulkhead in Southold, Suffolk
County, New York for the stated purpose of erosion control.
The work would involve replacing a total of 327 linear feet of existing
timber bulkhead and the dredging of an area 10 feet wide waterward
of the bulkhead to -3 feet meam low water, removing approximately 10
cubic yards Der site which would be placed behind the bulkhead as
backfill. An additional 100 cubic yards of material (from an upland
source) would also be used as backfill for the bulkhead.

RESOLVED to recommend to the Southold Town Trustees approval
with stipulations of Wetland Application No. 657 of Robert
Keith To construct a one-family house, sanitary system, drive-
way, and decks as shown on revised plans. Approximately
475 c.y. of fill to be imported to raise grades as shown on
plans. The CAC that there be no disturbance of land within
a 50' buffer area and that area be left as a buffer area and
undisturbed for perpetuity.

The Southold Town Conservation Advisory addressed Wetland
Application No. 659, No. 660, No. 661, No. 662, No. 663 and
Mo. 664 as an oran ihus motion. Applicants are: Monica Kenny,
Gilbert Pinkham, Joseph H. Williams, Nickolas Pace, Charles
M. McCormick, and Can~liffee. '~
RESOLVED to reco~n~-~ld Town Trustees approval
with recommendations for applicants to remove and replace
existing bulkheads in same location and configuration, and
dredge as requested with spoil being place as per requested
in applications. The CAC wishes all applicants be advised
that lawns grown to the edge of a bulkhead can cause water
pollution. The Council recommends that there be no fertilzation
within 20' of the bulkheads and recomraends that natural would
be best within tke 20-' buffer. Natural vegetation would act
as a filter for any ~unoff which may occur from the properties.
Lake Drive and Reydon Drive, Southold.
RESOLVED To recommend to the Southold Town Trustees disapproval
of Wetland Application No. 665 of Southold Shores Boat Basin,
Inc. to enlarge an existing, private, non-commercial mooring
facility at allow for 21 slips, one for each home owner in
Southold Shores. This shall include the addition of an additional
385' of 4' wide float docks as per submitted plans. The CAC
disapproves project as submitted. The Council suggests the
applicant extend the existing dock out to accomodate the extra
slips. The Coucnil is concerned that the configuation, as submitted,
would increase the number and size of boats in the small waterway
which could cause environmental problems.
Foo~ of Blue Marlin Drive, Southold.
RESOLVED ~o recommend to the Southold Town Trustees disapproval
of Wetland Application No. 666 of Arthur J. Bujnowski to
construct a timber groin of approximately 35' in length as
submitted. The CAC feels there is no need shown for the project,
a beach cannot be created, and project would damage downdrift.

knowledge, at present, there is not any problems with the
