DATE OF PUBLIC HEARING: October 23, 1997
FINDINGS (PROPERTY FACTS
DESCRIPTION: This property is located in an A -C Agricultural -
Conservation Zone District, being situate on the north side of
County Road 48, Cutchogue, with 115.10 ft. road frontage. This
lot contains a total area of approximately 44,657 sq. ft. as depicted
on the copy of survey map dated May 21, 1982 under this application
and which map shows an existing concrete block building and
separate one-story frame church building.
BASIS OF APPEAL: Building Inspector's Action of Disapproval dated
September 2, 1997 for the reason that the new ground sign as built
under Sign Permit #977 has been located less than 15 feet from the
pavement and internally illuminated.
AREA VARIANCE. RELIEF REQUESTED BY APPLICANT: To approve
its present location at approximately 8 feet from the pavement and
11.5+- from the edge of the road, exclusive of gutter. This sign
replaced a former sign as noted in ZBA decision #4482 rendered
June, 19, 1997.
REASONS FOR BOARD AC'T'ION, DESCRIBED BELOW:
(1) The granting of the setback variance will not produce an
undesirable change in character of neighborhood or a detriment to
nearby properties because the nonconformity of the new sign is
:similar to the nonconformity of the existing sign, which was removed.
(2) The benefit sought by the applicant cannot be achieved by some
method, feasible for applicant to pursue, other than an area variance
because a smaller sign would not provide the visibility needed for
traveling parishioners.
(3) The requested area variance is not substantial in relation to
the existing nonconformity.

(4) The proposed variance will not have an adverse effect or impact
on the physical or environmental conditions in the neighborhood or
district because this sign replaces a former sign in similar size and
location;
(5) The situation has not been self-created because a sign has
existed in this location for many years and this sign is a
replacement as a normal course of maintenance.
(6) This action is the minimum that the Board deems necessary and
adequate and at the same time preserves and protects the character
of the neighborhood, and the health, safety, welfare of the
Community.
RESOLUTION/ACTION: On motion by Member Dinizio, seconded by
Chairman Goehringer, it was
RESOLVED, to GRANT the setback location of the "as built"
sign, as applied.

Disapproval regarding lighting, to be voted upon by the Board of
Appeals at its December 11, 1997 Regular Meeting.)

Whenever the Code calls fora public hearing this section
shall apply. Upon determining that an application is complete,

Re: Appl . #4S12 - Variance for Internal Lighting/ Sign ( Church of God)
Gentlemen:
Enclosed please find a copy of the Appeals Board's determination
regarding the internal lighting of the sign as adopted at the Board's
December 11, 1997' meeting. While the use of the internal light was
denied, an alternative is available allowing external lighting by the
installation of two small spot lights clost to surrounding areas. The
internal light which exists must remain off to comply with the code.
You may wish to contact the Building Department at 765-1802 to
determine if any other information is needed to complete the sign permit
file regarding the Building Inspector's latest Order to Remedy dated
August 15, 1997 and Notice of Disapproval dated September '2, 1997..

I have been asked whether a request for a variance to allow an internally -
illuminated sign in an AC zone is a use variance or an area variance. It is a use
variance.
State law defines a use variance as an "authorization by the Zoning Board of
Appeals for the use of a land for a purpose which is otherwise not allowed or is
prohibited by the appicable zoning regulations." Town Law §267.
Southold Town Code §100-206(B) provides that"internally illuminated signs are
prohibited, except that ....signs in shopping centers or areas zoned Hamlet
Business may be internally illuminated."
Since internally illuminated signs are prohibited in AC zones, any authorization
for such such requires a use variance. A use variance is difficult to get, and must
be judged by the following standards in Town Law §267-b:
"No such use variance shall be granted by a board of appeals without a showing by the
applicant that applicable zoning regulations and restrictions have caused unnecessary

hardship. In order to prove such unnecessary hardship the applicant shall demonstrate to
the board of appeals that for each and every that for each and every permitted use
under the zoning regulations for the particular district where the property is located, (1)
the applicant cannot realize a reasonable return, provided that lack of return is
substantial as demonstrated by competent financial evidence; (2) that the alleged
hardship relating to the property in question is unique, and does not apply to a
substantial portion of the district or neighborhood; (3) that the requested use variance, if
granted, will not alter the essential character of the neighborhood; and (4) that the
alleged hardship has not been self-created."
Note that a request for relief from size or setback requirements for the same sign
may seek an area variance. An area variance is judged by different standards.
Under Town Law §267-b these are:
"the zoning board of appeals shall take into consideration the benefit to the applicant if
the variance is granted, as weighed against the detriment to the health, safety and
welfare of the neighborhood or community by such grant. In making such determination
the board shall also consider: (1) whether an undesirable change will be produced in the
character of the neighborhood or a detriment to nearby properties will be created by the
granting of the area variance; (2) whether the benefit sought by the applicant can be
achieved by some method, feasible for the applicant to pursue, other than an area
variance; (3) whether the requested area variance is substantial; (4) whether the
proposed variance will have an adverse effect or impact on the physical or
environmental conditions in the neighborhood or district; and (5) whether the alleged
difficulty was self-created, which consideration shall be relevant to the decision of the
board of appeals, but shall not necessarily preclude the granting of the area variance.
It may be that a sign application seeks both an area and a use variance. In ruling
on this matter, keep in mind the different standards of review and make separate
decisions on the merits of each variance.

Members were not able to obtain a consensus for approval and will continue its
deliberations regarding the interior Blumination (lighting) of the sign at our
December 11, 1997 meeting. If a consensus is not reached for approval, then
the denial for the lighting issued by the Building. Inspector will remain in
effect.

under Sign Permit ##977 has been located less than 15 feet from the
pavement and internally illuminated.
AREA VARIANCE RELIEF REQUESTED BY APPLICANT: To approve
its present location at approximately 8 feet from the pavement and
11.5+- from the edge of the road, exclusive of gutter. This sign
replaced a former sign as noted in ZBA decision ##4482 rendered
June 19, 1997.
REASONS FOR BOARD ACTION. DESCRIBED BELOW:
(1) The granting of the setback variance will not produce an
undesirable change in character of neighborhood or a detriment to
nearby properties because the nonconformity of the new sign is
similar to the nonconformity of the existing sign, which was removed.
(2) The benefit sought by the applicant cannot be achieved by some
method, feasible for applicant to pursue, other than an area variance
because a smaller sign would not provide the visibility needed for
traveling parishioners.
(3) The requested area variance is not substantial in relation to
the existing nonconformity.

2) Appl. #4514 - This is an application based upon the July 22,
1997 Notice of Disapproval by the Building Inspector in which a
permit to demolish and reconstruct a golf clubhouse and.' employee
housing were disapproved on the following grounds : n ..: Being
located in an R-120 District this non -conforming building with a
non -conforming use, permitted only by Special Exception (under
Section 100-31B) shall not be enlarged, reconstructed or -
structurally altered or moved unless the use of such building is
changed to a conforming use, Article XXIV, Section 100-243A......
for approval by Variance and/or Interpretation that golf club may
have accessory employee housing.
The Board of Appeals will at said time and place hear any and all
-persons or representatives desiring to be heard in the above
applications. Each hearing will not start before the time designated,
and written statements may be submitted before each particular hearing
is concluded. The files are available for review during Town Hall
