FINDINGS OF FACT
PROPERTY FACTS/ DESCRIPTION: The subject property is identified as Lot 177 on
the Map of Cedar Beach and consists of approximately one-half acre in size, with 100 ft.
frontage along Sunrise Way and 106.99 ft. frontage along Sunset Way, Southold. The
subject lot is improved with a single-family dwelling situated 47.5 ft. from the easterly
front property line, as shown on the November 30, 1993 survey prepared by Roderick
VanTuyl, P.C. Close to the southerly property line is the neighbor's fence which
commences at a point approximately 40 ft. from Sunset Way and easterly to the front
property line along Sunrise Way.
BASIS OF APPEAL: Building Inspector's July 30, 1998 Notice of Disapproval which
reads as follows: "the proposed fence exceeds four (4) feet in height. Under Article
XXIII, Section 100-231, height of fences, walls and berms, fences shall not exceed four
(4) feet in height when located in front......
AREA VARIANCE RELIEF REQUESTED BY APPLICANT: The request made by
applicant is to locate a solid fence at a height of 6-1/2 feet commencing at a point 40
feet from the westerly front property line along Sunset Way, and extending east along
the applicant's southerly property line a distance of 50 feet.
REASONS FOR BOARD ACTION:
1. The granting of the area variance will not produce an undesirable change
in character of neighborhood or a detriment to nearby properties because
the fence will be constructed in what appears to be the rear yard of the property.
2, The benefit sought by the applicant cannot be achieved by some
method, feasible for applicant to pursue, other than an area variance because
the applicant has two front yards according to Southold Town law.

3. The requested area variance is not substantial and would be allowed if the
applicant did not have a road in the back yard.
4. The variance will not have an adverse effect or impact on the physical or
environmental conditions in the neighborhood or district.
5. The difficulty has not been self-created.
In considering this application, the Board deems this action to be the minimum necessary
and adequate to preserve and protect the character of the neighborhood, and the health,
safety, welfare of the community.
RESOLUTION/ACTION: On motion by Member Dinizio, seconded by Chairman
Goehringer, it was
RESOLVED, to GRANT a variance for a six -ft. high fence to be located as applied,
commencing at 40 ft. from the front property line along Sunset Way, and extending east
a distance of 50 feet.
VOTE OF THE BOARD: GOEHRINGER, DINIZIO, COLLINS, HORNING. (Member Tortora
was absent due to bereavement.) This Resolution was duly adopted 4-0.

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town Law
and the Code of the Town of Southold, the following application will be
held for public hearing by the SOUTHOLD TOWN BOARD OF, APPEALS, at
the Southold Town Hall, 53095 Main Road, Southold, New York 11971, on
THURSDAY, OCTOBER 15, 1998 at the time noted below (or as soon
thereafter as possible):
7:25 p.m. Appl. No. 4615 — P. CHAZAN and B. BOYD. This is a request
for a Variance (based upon the Building Inspector's July 30, 1998 Notice of
Disapproval), Article XXIII, Section 100-231 (Zoning) for placement of
a proposed fence which will exceed the four ft. height limitation when
located in or along a front yard. Location of Property: 280 Sunrise Way,
Southold, NY; also shown as Lot 177 on the Map of "Cedar Beach"; Parcel
1000-91-1-13.
The Board of Appeals will at said time and place hear any and all
persons or representatives desiring to be heard in the above application or
desiring to submit written statements before the hearing is concluded.
Each hearing will not start earlier than designated. Files are available for
review during regular Town Hall business hours (8-4 p.m.). If you have

REASON FOR APPEAL

is requested for the reason that

Do not use these standards for "use variance" or "special
exception." (Also attach sheets if necessary, with signatures.)
1. An undesirable change will NOT be produced in the character of
the neighborhood or a detriment to nearby properties, if granted
BECAUSE: the fence will provide privacy not only for my property
but also for the neighbors' properties.
2. The benefit sought by the applicant CANNOT be achieved by some
method, feasible for the applicant to pursue, other than an area
variance BECAUSE: plantings will not work because the area is shaded
and the only tall plantings that can be planted are the type that
deer love to eat, and we have deer!
3. The amount of relief requested is not'substantial BECAUSE
it's just a tiny little fence covering a small portion of the
side of the property (about 50 feet of the 200 foot length of the
property.
4. The variance will NOT have an adverse effect or impact on the
physical or environmental conditions in the neighborhood or district
BECAUSE it will have no effect on the neighbors' properties or
my own' "other than to provide us all with limited privacy:; no existing
plantings will be removed on either side of the fence, and no
maintenance will be required (other than possible painting of the fence)

For your review and transmittals, please find enclosed a copy
of the Legal Notice regarding your application. Our department will
publish the Notice in next week"s issue of the L.I. Traveler
newspaper.
Pursuant to the provisions of Chapter 58 of the Southold Town
Code, notice of your application and hearing must now be sent, by
certified mail, return receipt requested, to the all surrounding
property owners together with a copy of a map or sketch describing the
location and/or use of the property or new construction. Please send
the notices by 4!�,/S,,-(earlier _ preferred) . Owners of vacant property and
other properties, surrounding your project, along all sides and
abutting the boundaries of the subject lot are those as listed on the
assessment rolls. A copy of Chapter 58 is enclosed for your
reference.

PROPERTY FACTS/ DESCRIPTION: The subject property is identified as Lot 177 on
the Map of Cedar Beach and consists of approximately one-half acre in size, with 100 ft.
frontage along Sunrise Way and 106.99 ft. frontage along Sunset Way, Southold. The
subject lot is improved with a single-family dwelling situated 47.5 ft. from the easterly
front property line, as shown on the November 30, 1993 survey prepared by Roderick
VanTuyl, P.C. Close to the southerly property line is the neighbor's fence which
commences at a point approximately 40 ft. from Sunset Way and easterly to the front
property line along Sunrise Way.
BASIS OF APPEAL: Building Inspector's July 30, 1998 Notice of Disapproval which
reads as follows: the proposed fence exceeds four (4) feet in height. Under Article
XXIII, Section 100-231, height of fences, walls and berms, fences shall not exceed four
(4) feet in height when located in front...."
AREA VARIANCE RELIEF REQUESTED BY APPLICANT: The request made by
applicant is to locate a solid fence at a height of 6-1/2 feet commencing at a point 40
feet from the westerly front property line along Sunset Way, and extending east along
the applicant's southerly property line a distance of 50 feet.
REASONS FOR BOARD ACTION:
1. The granting of the area variance will not produce an undesirable change
in character of neighborhood or a detriment to nearby properties because
the fence will be constructed in what appears to be the rear yard of the property.
2, The benefit sought by the applicant cannot be achieved by some
method, feasible for applicant to pursue, other than an area variance because
the applicant has two front yards according to Southold Town law.

NOTICE OF PUBLIC HEARING
Providing notice of public hearings.
(HISTORY: Adopted by the Town Board of the Town of
Southold 12-27-1995. as L.L. No. 25-1995. Amendments
noted where applicable-)
§ 58-1. Providing notice of public hearings.
Whenever the Code calls for a public hearing, this .section
shall apply. Upon determining that an application is complete,
the board or commission reviewing the same shall fix a time
and place for a public hearing thereon. The board or commission
reviewing an application shall provide for the giving of notice:
A. By causing a notice giving the time, date, place and
nature of the hearing to be .published in the official
newspaper within the period prescribed by law.
B. By requiring the applicant to erect the sign provided by
the town, which shall be prominently displayed on the
premises facing each public or private street which the
property involved in the application abuts, giving notice
of the application, the. nature of the approval sought
thereby and the time and place of the public hearing
thereon. The sign shall be set back not more than ten
(10) feet from the property line. The sign shall be
displayed for a period of not less than seven (7) days
immediately preceding the date of the public hearing.
The applicant or his/her agent shall file an affidavit that
s/he has complied with this provision.
C. By requiring the applicant to send notice to the owners
of record 'of every property which abuts and every
property which is across from any public or private street

from the property included in the application. Such
notice shall be made by certified mail, return receipt
requested, posted at least seven ('n days prior to the date
of the initial public hearing on the application and
addressed to the owners at the addresses listed for Lhem

provision.
