In the event that such approval is necessary, the holder of this permit shal not commence operations here- under until such approval has been obtained in writing. The failure to obtain such other approval when required shall subject [his permit to immediate revocation by the Town Clerk upon receipt by the Town Clerk of written notice from such other governmental or municipal aut[forities of its refusal or disapproval. The applicant does by the acceptance of this permit, assume all responsibility for operations under- taken pursuant to this. perm t, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. By such acceptance, the applicant also agrees to indemni- fy and save harmless the Town, and its officers, agents and employees from any and all claims arising from operations under this permit and any and all acts or omissions of applicant, his agent and employees. Smith, President, Board of Trustees on 11-25-85 P.M.: NOTED: House foundation approximately 40±' landward of M.H.W. of Goose Creek, Southold. House placement similar to that shown on expired wetlands application for Dock, Ramp and Float for Lewis Edson prior to 75' requirement of wetlands ordinance as amended 4-1-85. House is placed on "Disturbed" ground in that it has no wetland indi2ator plants other than Phragmites communms (reed) and a topsoil/subsoil of upland appearance as opposed to Flood Plain ms seen on vegetated sections surrounding the house which a~e not actually part of the present work. House is not on wetland. OPINION: Information related to this Trustee supports the idea that this house location was approved by the New York State Department of Environmental Conservation and that N.Y.S.D.E.C. and that N.Y.S.D.E.C. applications and Building Permit applications to the Town predates the 4-1'85 amendments to the Wetlands Code even %hough the Building Permit was dated 4-17-85. I suggest that no benefit would result from stopping this job or .issuing a violation but that a copy of the N.Y.S.D.E.C. Permit,, Building Permit application and prior wetlands application of Lewis Edson be available for Board of Trustee review at next months field surveys. Change in position of the house will not affect wetland. However, the Builder should immediately attempt to vegetate and stabilize all exposed soil in front of the foundation using straw/hay bales and reseeding. Gordon Colvin regarding the above captioned su~ect. This Bureau will ~e inspecting the subject property but only from the ~oint of fine tuning the existing line as shown on the tidal wetland inventory maps. This is the procedure that we use in all Article 25 application procedures. A new line is not anticipated, which would in fact require a ~rmal map amendment process. At this time, I do not ~el there is any need for outside participation although if the matter did go to hearing as part of a map amendment procedure, you definitely would be notified and your input would be solicited.
